What great line of defense could they have? He traveled around with both cells phones during the killing and the aftermath, he sent phony texts, and then he lied to several important people, pretending to be contact with her, after she was murdered. And he shared his murder plans with someone with a big mouth.

I don't see many options for constructing a solid defense.

Yeah. If they had evidence that could remotely point to KK it would have been their best defense.

This is very good for the state.

And @MassGuy is right. The I had a bad childhood is not an actual defense at all. Unless it supports total insanity at the time of the crime.

Instead, it goes to mitigation. And in the US it seems to me it actually doesn't work that often.

I read a book by a psychologist who studied kids charged with murdering their parents and his assessment was that in pretty much all the cases the kids had been subjected to intolerable and extreme abuse.

However, except for one kid who was able to walk slowly in front of the jury and show them the scars that crisscrossed his body, it didn't seem to result in a reduction in sentence even though in many cases the killings were practically self defense.

I think it's more likely to work with juveniles though and young women.

Yes, Thanksgiving behind bars will be so sweet. Hopefully he'll be getting the same old mystery meat he get's at every meal, with just a big plop of God only knows if that's Gravy on top!

That’s a common strategy, but not an effective one (anecdotally atleast).

I can’t imagine any member of the jury being swayed by abuse accusations directed at PF’s mommy (or whoever).

The evidence is strong, the victim sympathetic, and the killer a vile monster.

This guy won’t score any sympathy points from the jury.

He'll garner no sympathy whatsoever, because he's a completely unsympathetic character.

Of course, that won't stop the defense from doing their darndest to get the strings section tuning up their violins in the jury box.

We've joked here often about the kick PF took to the head from the long-suffering horse who'd finally had enough of the rasp, but I do actually wonder if PF's defense team will try to drum up sympathy by claiming PF suffered a TBI and is less culpable for his actions as a result.

His defense team really has been hog-tied by his stupidity.

Fortunately, stupidity isn't a defense.

His defense is going to be grasping at straws.

They'd just better make sure those straws they clutch at aren't from the discolored bale of hay found in the barn where PF hid KB's body.

I love knowing that even if the bat is not found and shown to the jury, the metal pole from the aborted plan will be entered into evidence when KK testifies. (Please tell me I didn't dream that KK left this at the ranchette fence.)

DA May will surely want that picture reinforced in the minds of the jurors.

The fact that the defense clearly realizes that it’s just not viable, makes me wonder what the hell their strategy is going to be.

Most of us knew it wasn’t viable from the get-go, but it’s pretty shocking that the defense would basically admit that by throwing in the towel.

I think the odds of a deal just went up.

I think a deal offered by the DA would require PF to:
  • Confess to killing her.
  • Disclose how he killed her.
  • Disclose the location of her remains.
PF will never do all that.

PF won't take a plea deal, he's been willing to keep his mouth shut (except for the allowed statement to the child welfare worker woot woot!), roll the dice, and hope that there will be at least one brain dead juror hold out.

I still think the F family mentality is "they don't have a body, they can't prove anything beyond reasonable doubt", keep your mouth shut, good ole' boy mentality.

He's the most unsympathetic and uncaring defendant I've seen in a long time and thankfully that will be obvious to the jurors as well.

Yeah, I wouldn’t be shocked by that.

Fortunately, that has just about as much chance as working than the “KK did it” defense.

In other words, zero.

I was talking generally. Most news reports have been like what is below in which I see things like (snipped by me from your Post #149):

"The missed court deadline would appear to cap speculation that Frazee will try to pin all the blame on Krystal Kenney, the woman who pleaded guilty and awaits sentencing for cleaning blood at Berreth’s town house at disposing of her cellular phone."

I don't much like words like "appear", etc. Erring on the side of caution in case they are wrong, they should not need to if sure...

As for McCallum, if that is the case and someone said it who is absolutely in the know and he being the PIO and is certain about it, then I am very happy to hear that!!

On a new note, I wonder where KK will stay to be "available" for weeks throughout if necessary... With her aunt, driving back and forth? With Ma F? At a motel with an entourage to shield her from media? Is there a motel next to Sonic or one with a restaurant and room service? Should be quite the trial and busy in Teller County, make your hotel and courtroom seat reservations now. Be sure to ask about the hotel's cancellation policy just in case--not that I think PF would make a deal but who knows what is coming next...

Maybe hearing aids one can turn up or an amplifier would help as well as the acoustics are not great I hear... :)

TELLER COUNTY, Colo. - Krystal Lee was named an alternate suspect in the Kelsey Berreth case Wednesday.

According to Colorado Court public information officer Rob McCallum, the defense filed for an alternate defendant on the 17th.
