1. Autopsies are finished, sealed and have been delivered to Prosecution and Defense.
2. SW did not leave a will, her official probate was filed by her parents last week. One of the questions on the document asks is deceased had any surviving children. Box beside the question was checked, “No.” Also, CW’s address was listed as, Weld County Jail.” Documents were sent to CW at the jail. Big question is who owns what in the house? They had some very expensive assets. The section for estimated value of real estate was left blank, and estimated value of personal property was left blank, too. Expected annual income for SW was left blank. Family asked for emergency hearing on probate. SW.’s father said he wants to take care of SW’s affairs, he said some are, “Time sensitive.” Not sure which ones are time sensitive, but in the documents life insurance and a car are mentioned.
3. Guest, Defense Attorney, Parag Shah explained, when you die without a will, your spouse normally gets everything, but if your spouse is the reason you’re dead, that’s a challenge family members can make in court. Since the husband did this someone else needs to be in charge. SW’s father is requesting to be person who handles estate. CW has a timeframe to object. CW could use some money. He may not want SW’s father to take over. There is statute in Colorado saying wrongdoer isn’t entitled to victims’s estate. CW may be angry about this, but his criminal attorneys may not be versed in probate law, CW may not be able to afford probate attorney, so he may not object.
4. Next step in probate case, there is a telephone hearing scheduled between Court, CW, and SW’s parents. Most likely CW will be advised to take the Fifth and not say anything. He should just file a written objection. Horrible situation for all to sit through.
5. Guest, Author, Donna Kaufmann, explains similarities in accusations between CW and Jeffrey MacDonald. MacDonald used a kitchen knife and ice pick. JM had several appeals. Both CW and JM were having affairs, both had 2 daughters, both wives were pregnant, both were possibly sexually involved with men. 2 days before her murder, Colette MacDonald called family and said she wanted to come home, she couldn’t stand JM’s cheating anymore. Her family advised her to stick it out. Nicole Simpson’s family gave her the same advice when she told them she couldn’t stand OJ anymore. SW may have done the same.
6. Guest, Forensic psychiatrist, Dr. Daniel Bober explains 4 Types Of Family Annihilators.
1. Self-righteous killers - hold mother responsible for family breakdown. They believe the mother let the family down. Maybe she had an affair, maybe she did not tend to the family in some way.
2. Disappointed killers-Believes their family has let them down. Could be a child dating out of faith. Like an honor killing.
3. Anomie killers - see the family as a symbol of economic success until an economic reversal changes the situation. The family being poor would reflect poorly on the father.
4. Paranoid killers - Desire to protect their family from a perceived threat. System is after them in some way, like a legal threat or CPS.
Overwhelming theme is narcissistic injury to father who believes family is like trophies in a display case, and his image is being tarnished. Father sees family as extension of himself, he feels threatened and acts out violently.
5. AB lists family killers. John List, Ronald Gene Simmons, Charles Stuart,
Phillip Austin, Robert William Fisher, Scott Peterson, Neil Entwistle, Josh Powell. Majority of family annihilators are men, 81% of annihilators kill themselves. New theory about these crimes, as women have become more independent and more financially stable the men feel like they’re losing their position of authority, and their power structure in the family, and the theory is that there’s a backlash against women’s independence.
6. These are not men who were not unsuccessful, from outward appearances seemed to have it together.
7. CW fits into the top two reasons, but we don’t have all the facts, yet.

2. Lust
3. Lucre (money)
4. Loathing (may be self-loathing)
Every single motivation for murder fit in these categories.
9. LE starts an investigation based on the “Rational Choice Theory.” Every one of us that could potentially commit a crime acts in our own best interest. We do a risk reward cost benefit analysis. Can I get away with this and if I don’t get away with it what is the cost to me? What is the penalty? Then they get down to motivation.
10. In CW’s case all 4 L’s apply.

3. “I wonder if she was buried with her wedding ring, or did he remove that beforehand?” Huge fact that would matter. If he did remove it, he probably removed it so she wouldn’t be identified once she decomposed if she was found.

Why are people complaining about it all of the time? The ACA? I was never on ACA but I read about people being so disgusted with it thar Congress is getting rid of it.

I am confused
Because too many middle class Americans went from excellent coverage at $400/month to dismal coverage and exponential deductables at $1300/month.

I'm sorry but I do not understand the question. If you mean putting out anything positive about the defendant would only result in those people being dismissed by the prosecution, that is not how it works, IMO. It is more ideal for the defense for the general consensus of the public to be either neutral or unsure of guilt. Right now, it is strongly lopsided in MSM because the evidence out there supports it. IMO

Medicaid is for the poor. Depending on the policy , it might make sense for her to have the kids on his. Depends.

With the numerous health issues she has and being pregnant, I would think health would be at the top of the list of concerns, Medications. hospitalizations, doctor visits. Yow!

And if you do not have good coverage, the things you need may not be covered. Scary scary business.

Medicaid has changed. States that accepted Expanded Medicaid through the ACA now have income limits that are fairly high. For example, average income in my state is $29,000 for a family of 4. With Expanded Medicaid, that family can earn up to $37,000 and still receive it. The fact that she had children would have worked to her benefit; even without her being covered, both CO and NC have low cost (and free) medical insurance programs for kids. There are also other ways that people can qualify for it. We are on Medicaid right now, not because we are "poor", but because our medical bills equaled more than $85,000. Last year we bought through the Marketplace and our premiums were very low.

The point is, there were options for SW and insurance IF they had divorced: purchasing an income-based plan from the ACA marketplace, Expanded Medicaid depending on whether she stayed in CO or returned to NC, keeping the kids on CW's policy, etc.

This is all speculation at any rate. We don't even know if insurance was at the forefront of her mind.

And depending on relationships, people can be biased in favor or against someone. We don't know because we don't know the relationships.
I thought she said she had been friends with CW since high school but also knew SW.. I got the impression she was close with him and not with her. Imo

<modsnip - do not tag the member whose post you are quoting> I think any and all VI's who claim to have had contact with SW and CW whether they live in CO or NC or anywhere for that matter, should all be taken at equal face value.
Whether a person is geographically close or not, does not determine the closeness of that relationship and what is being disclosed between them. And similarly, friends who live nearby CW and SW may not have any clue as to what is really going on with SW or CW hence the overall consensus that people never saw this coming with this family.

In all fairness the interest rate could vary up to 10% as well . When I did my figures I included link so anyone else could figure as well. I did mortgages for over 12 years . It is my experience most use FHA to have a small down payment and the credit score rating can be substantially lower some loans require up to 720 as a score. In the long run unless you put 20% down they cost more. We also know HOA fees and insurance for property can be added to this figure which I did not. I did account they paid the MIP upfront and closing cost both of those if not paid can make payment more. It may have been when financed they both made more money since she had a hospital job she retired from to work LeVel orbperhsps LeVel made more for her I am not sure.
Yes, I understand that your guess at the payment amount is merely an estimate.

The Lindstrom guy is a neighbor, though. My neighbor and I help each other out, but I can't tell you any significant things about her. I know her name. I know she has two daughters (whose names I don't recall). I know she has three cats. But other than that.... she seems nice. We have superficial conversations. I don't really KNOW her. Not in the way I know my friends, where I could tell you their favorite color, what they like to do for hobbies, and where they hang out on the weekends, etc And wasn't NT the husband of one of Shanann's friends? I know NT's wife A, sold Thrive.

But if someone got a new motorcycle, yup. He knows all .Color. Cylinders. Whatever.

True. But she also knew about CW and his AP, from the start. So that makes me think she was much closer to CW than to SW. So I have to think that her opinions concerning SW might be a bit biased, in favor of CW.

Respectfully, she corrected this post long ago & said her wording had been inadvertently misleading. She did not mean to imply she knew about the AP before anyone else. I’ll try to find the post & add it here.

Respectfully, it has been said it was a simple personal impression by someone who does not know CW. We all know this does not equal evidence of sexual orientation, so I do not see how picking this apart goes to motive. IMO

Agreed. Also note that with any VI or any unverified poster with any knowledge of the people involved, just because a question is asked doesn't mean it is required to answer.

In general, no one should feel put on the spot or as if "I'm not comfortable answering that, thanks" isn't a respectful answer. All info we have from any direction is given voluntarily.

You’re welcome. I did a lot of research into this at the beginning & agree with you. I believe this is also why they were not paying HOA dues.

I agree. Chase Bank always seems more than willing to loan you money for the equity in your home. The HOA problem is a sign the finances were out of control. Unfortunately, those MLMs require too much investment on the part of the seller. People get in over their heads before they realize their business has tied up all their cash flow.

I was under the impression the Lindstroms lived in the same area. I consider everyone on my street and surrounding cross streets as "neighbors".

Oh that's right! That came into play with the Sheila Mack case!

So the slayer rule will be invoked during the probate proceedings and a determination as to whether there is a preponderance of the evidence as to the killing will take place in probate court and be a part from the criminal determination. Hmmm.

I wonder. CW will have to invoke. Will that be grounds to suspend probate proceedings until after the criminal case concludes or does it mean that info that the state otherwise can't discuss prior to trial can come out in public probate proceedings?

Let's see what happens.

Not if they were divorced. It is the insurance company that makes the rules. Not him. Not the judge. Not the company he works for. If they get divorced, someone has to pay COBRA. COBRA is the cost of his insurance that was what he received for the family. That is where the judge decides . Who pays what towards COBRA. And the deductibles and copays.

COBRA was a law that was made so people could keep their insurance while they searched for other insurance if they lost the job that provided insurance for them. COBRA used to be 18 months. Now it appears to be 36 months.

Of course when unemployed, it is difficult to pay those high premiums when you do not have a job.

No they don't. They don't have to pay for COBRA coverage. The ACA is vastly cheaper than COBRA. Exponentially. And covers the same in state's like CO.

The court could also order him to pay half any premiums related to the prenatal care of Nico. And her premiums would be factored into support.
