Do you think the Bobcat and trailer were part of the LE search at the home? I've considered that because it was off the trailer. If it were Barry's what did he do, bring it back with him at 9:00 Sunday night? Was he doing work at his house in the week after Suzanne went missing? I guess with what we've seen that wouldn't be surprising, but super poor form when your wife has been abducted to be working on your driveway o_O

I wondered too whether the bobcat was LE's. After all, in that helicopter video there were no Morphew vehicles visible (we couldn't see into the garage, but the two vehicles in the parking area were both LE. My assumption is that all Morphew vehicles had been taken for inspection by LE. If so, why not his bobcat and trailer as well?)

I do not mean that everyone must buy Barry Morphew's version of events hook, line & sinker, but I hope that everyone simply watches & listens to him without being preoccupied with how to use his words & demeanor against him. After all, this is what everyone has been clamoring for for months now.

I would've advised him to NOT speak because I'm convinced that people do not want to hear him speak to learn information; they want him to speak so that they can turn his words & demeanor into cudgels to use against him. I hope I'm proven wrong.
Can I at least raise an eyebrow if he’s wearing a wig and sunglasses, and stops periodically to inhale helium from a balloon? :p

MOO FBI Evidence collection from earth moving is a much more involved operation. Like the Salida property search, Gannon search and Vallow search. MOO the bobcat would most likely be BMs.

If the spouse of the missing person has an attorney and that attorney has practiced criminal law for at least 6 hours, there is no way they would agree to this interview under these circumstances unless:

1. They were confident in their client's alibi.

and/or

2. They were given info by LE indicating their client was cleared and not a POI

IMO

or you have an arrogant client. I am sure if Barry was cleared his attorney would be having a press conference.

Thanks for checking the Statutes! I only referenced MN because there was a difference in IN and CO law and I thought the discussion said that CO followed Uniform Code like MN. I guess I wish it was in MN because I know the particular scrutiny MN gives these cases. Being that the reporting software system they developed was meant to serve as an example for other states. And sometimes the oversight seems to be hawkish, but given the fraud that can occur I think it’s a good thing.
Also I noticed the statute you listed puts it as a “limited conservatorship” and I guess my concern was that BM was moving to make the limited to a full on Guardianship.

This stuff is obviously complicated but I think it very important to recognize that even for states following Uniform Code, the UGPPA completed by the Uniform Law Commission goes back to about 1997 --when nobody ever dreamed about missing persons --let alone including them in Uniform Guardianship/Conservatorship.

In other words, just as we've seen with Indiana tweaking their own IC to change their definition of "incapacitated," does not mean that other states have followed suit. Off the top of my head, I know that CT has not.

A good attorney would not hold a press conference. They would set up an interview to help humanize their client and show the client is grieving the loss of their loved one.

I have some really arrogant clients, but believe me when I tell them to do or not do something, they almost always adhere to my advisement. That would be especially true in a potential murder case.

An uncontrollable client prone to being a control freak would have spoke out to the media within the first couple of weeks...IMO

Just another tidbit about the Bobcat tractor.
Sorry Im hung up on that today. LOL

For any tractor and especially for a lighter weight one like the Bobcat, what they do is they will put counterweights in the back to counter the weight of the scoop bucket on the front that is used to pick up heavier objects.

That way the tractor itself will not tip forward which can happen when not enough counterweights in back. My neighbor has a Kabota and his tractor came with the weights that he slips on the back on a rack for that purpose.

On the bobcat at SMs place, there appears to be a red colored box looking thing on back as well as the bucket scoop on front which is resting on the ground. That red colored box looking thing could be used to put counterweights or heavy rocks in it for counterweights. (3:07+ in the attached link). It could also be for some other purpose as Im not totally sure.

Anyway, just another tractor type tidbit how they can pickup heavy loads on the front without having the tractor tip forward.

I think you're assuming the attorney has a compliant client that follows the instruction of their counsel. Scott Peterson had the best money could buy (i.e., more than 6 hours of practice) and he certainly went against their advice! MOO

The equipment in question is a "skid steer". The brand is Bobcat. John Deere makes a better skid steer. The equipment would not be very effective at digging holes in hard and/or elevated terrain...IMO

I can't tell you how much I hope you're right that that may be the case with SM. Unfortunately, the statistics show that women keep abuse from friends and family, out of embarrassment and/or repercussions.
Again, hopefully that's the case.

Just like his vehicle(s), taking BM's equipment required a search warrant. LE would only have custody of what the court approved.

If the spouse of the missing person had been advised by their attorney not to speak to the media, he has been compliant to date.

Something has changed and I doubt it was a controlling client who just now decided to ignore their attorney's advice after three months.

I'm curious to hear if the recent allegations from the anonymous family member will be addressed in the interview?

Forgive me please, but no one is “clamouring for months now” “to use his words & demeanour against him.” His words and demeanour stand for what they are obfuscations and misdirection. He has not been forthright and that is the crux of the matter. No clamouring.

With respect to what he dishes tonight and how it is received, depends largely on whether or not his statements are credible and mesh with what little we do know. It will also depend on the questions asked. Will he give us the WHOLE story or are we going to be subjected to more nonsensical ramblings? Will he address anything of any import with respect to his movements on May 9th and 10th? It won’t be long now and we’ll know. If what he says makes any sense at all, or gives me reason to think I was wrong about him, I’ll be the first to admit it. I’m not here to crucify him, I’m here to find out what REALLY happened to Suzanne and that there is justice for her and her family. Up until this point, nothing he has said or done gives me the feeling he’s being upfront and honest.

So we wait........

@GordianKnot stated that Barry's in "damage control" mode. That is a definite possibility. However, I also think that if the government had enough evidence to prove Barry guilty, it certainly would've arrested & charged him by now. Whatever Barry says tonight certainly can be used by the government against him: Why give them anything that they could possibly use?

If I was his attorney, I would've advised against thid interview. I don't think that he gains anything. I've always believed that in circumstances such as these, time is on the suspect's side: witnesses die or move away, evidence is lost, memories dim, officers retire. If I was Barry's lawyer, I'd tell him that starving an investigation of information is the best way to fend off any charges.

IMO, his time to sincerely make a public appeal has passed, long passed. To speak now would be foolish.

His silence in the last three months has been deafening.
