How common is it for an innocent spouse or close relative to not show up for a vigil?

Why would a innocent spouse not go?

Is it appropriate to ask if any other family members were in attendance at the vigil? I am speaking of those that reside in Indiana. I don’t want to turn this into a sniping witch-hunt but I admit I am curious if there is family division there. If one party is guilty in a family, the rest don’t deserve to have their lives exposed just because of their bloodline.

IMO the most compelling reasons for not wanting to have voice recorded would be to do with:
the information being held in perpetuity;
ready availability for repeated analyses addressing different questions, using a variety of analytic techniques;
rendering the contained information static/permanent - there would need to be very good reasons for subsequently changing the content (e.g. temporary amnesia, caused by head injury).

- afraid of being recognized

I didn't think it was necessary to show motive in any state.

Good point - I really don't know. I didn't know missing persons could so rapidly be put on a Guardianship so quickly, so maybe Indiana would be different?

But basically, I think judges can generally have jury instructions telling them it's not necessary to find on a motive. This would put a damper on a defense attempt to say "but there's no motive!" Defense could still cast doubt on motive, but I think judges can instruct jury not to consider same. I don't think much or any of the evidence in Gannon Stauch's case (as listed in the arrest affadavit) was about motive.

When people are bat-doo crazy, it's often hard to find a motive that any rational person could understand.

Being generally controlling and prone to rage attacks is not a motive, but if demonstrated by evidence in court, it would show something important about the defendant. I think - I don't know for sure.

Thank you for your contributions. I was wondering what your thoughts are in regards to BM's recorder interview by TD. He seems to have trouble expressing himself. Perhaps he is having trouble keeping his story straight? Perhaps something organic going on? This is a link to TD interview. TIA.

love it. i'm so happy to hear/see movement from the moorman's! if i was close by i'd totally show up to help them search. sounds like they want any and all persons who want to help, to come help, and i think it's a spectacular idea.

last night i was thinking about some things. does anyone know if they did any searches, besides on the actual job site dig, in that general area around the job site? i started thinking, if there was a construction site near my house, and i heard machinery running at midnight, i would just assume that's where it would be coming from, the site under construction nearby. but since (for now) we are unsure that they found any real evidence there, what if the machine-running was a red herring to cover up another machine running nearby? or what if there was not really a machine running on the job site, but close by the job site and still within earshot or the neighbor?. since the neighbor didn't go out to look, and when she did, the noise stopped, what if she was only assuming that's where it was coming from? she didn't actually see anything on the site, did she? (and on top of that, she had hearing problems). (hope that makes sense, and just throwing out some ideas).

i really hope they will search in a radius around the job site/neighbor's house, since we know for a fact, a machine was indeed running that saturday (or friday) night. that machine was doing something that night, and most likely it was something suspicious.

This is pointless unless the task force gives them locations in which to search. I hope they have areas of interest in which they can deploy these people. I don’t think she’s anywhere near that house.

So I’m happy this is happening, but skeptical it will result in anything fruitful.

MOO, but perhaps LE has a wealth of GPS data over select days of interest before and after SM’s disappearance. The perp is probably a busy guy so much of it could be innocuous to the point that it’s hard to justify dedicating resources to the effort even though the legwork needs to be done.

The searches don’t necessarily have to be just for SM’s remains. Perhaps there’s an “Albany Avenue”-esque element to this case too. (I’m thinking the perp is most comfortable following a playbook. Not that FD’s book is the one you’d want to tear a page from, lol...)

It’ll probably become obvious if LE is tacitly supporting the search effort once it gets underway. And time is of the essence now. Once the snows come that will be a game changer that only benefits the perp.

Despite that, he’s the best family spokesman I’ve ever seen. As long as you aren’t looking for a spokesman who speaks, and draws attention to the case.
