I don't think so. I was under the impression they locked down the house soon after discovering the bike. Allegedly BM made it there late, at 9 or 9:30. I believe this is the home of his friend where he was staying.

You are right. House sealed that night.

I just looked at those photos of BM behind his truck again and is that a cut on BM’s left index finger by his knuckle? Might just be the photo but it sure looks like a cut in that one picture.

The wording suggests it didn’t come from BM, either. It was a possibility, IIRC, not sure whether this is anything more than hearsay, unless we have the email? I definitely can’t use it as evidence of BMs guilt , MOO

So who could have sent the cat email to the congregation? Who had that theory so early on, and also knew their church affiliation, and where/who to send that email to. It had to be an inner circle member, as LE did not send it. Andy didn’t send it.

I agree, especially since the surveillance cameras weren't in working order the best place for the bobcat would be directly in front of their home in case someone were to steal it.
I do wonder why the vehicles weren't in the garage tho.

I believe the Range Rovers were parked in the garage, plus maybe additional equipment so perhaps not enough room for other items.

Personally would scour roadsides hundred of miles in all directions looking in trash, ditches dumpsters etc.
MOO the only things he has done that seem appropriate to me is to lie on the ground, and be looking in trash at Poncha Market.
Although having no posters ready in his vehicle is bad.

No mountain lion obviously, so by Monday morning he and everyone should be aware it was a human predator.
MOO opportunistic human predators often throw their kills off roadsides and in trashes. MOO and that's where an honest grieving spouse would be looking.

I’m a CO real estate broker. In our licensing class it was pounded into us if our Seller asks we not disclose a stigma, we have an obligation to not disclose. We could lose our license if we do.

If it were me, I would strongly recommend to my Seller that we disclose the stigma. The Buyer is going to find out and I’d rather have them know before we go under contract. If they are going to balk better they do it now. Otherwise you run the risk the buyer will back out after you’ve taken the home off the market. In CO the Buyer has multiple opportunities to cancel the contract and still get their earnest money back. (For example, Buyer can say they are terminating the contract based on an inspection, with no obligation to specify what was found in inspection that’s causing them to terminate).

In this case, MLS Broker notes indicate the listing agent must be present at all Buyer showings. It’s possible the agent will disclose the stigma at that time. I completely understand why they wouldn’t want to mention it in the public listing information. And they may think even putting it MLS broker notes would increase looky-loo showings.

Very good explanation, IIRC advice to newer realtors, was to walk away from listing if sellers didn’t want it disclosed.
We were taught to always have our buyers ask the question, is there any reason?... seller then has to disclose or lie.

Great question! Even if directly asked the Seller’s agent cant disclose. I was never taught whether or not we should deny it if asked but outright lying is always a no-no. If it were me, I would remind the Buyer’s agent even if the property was stigmatized that’s not something I could necessarily share.

If a listing agent said that to me you can bet I’d be googling the address. And if I know someone may have been murdered in the house I’d be obligated to tell my buyer. The rules are designed so that each agent acts in the best interest of their client.

I think it’s possible the Buyer’s agent could be found negligent even if they weren’t aware of the stigma. If a complaint was made and the real estate commission and/or court felt the agent should have known they’d be in hot water. An argument could be made that any agent marketing themselves as a “local expert” should have known the history of BM’s house. Not sure it would fly but either way the Buyer’s agent would have some explaining to do.

ETA: All of the above assumes the Buyer is working with an agent. If the Buyer was unrepresented and called the listing agent directly, early in the conversation the listing agent is obligated to explain that their allegiance lies w/the seller and nothing the Buyer tells them will be confidential. There’s even a disclosure form they’re supposed to provide to the buyer. After that, their response to Buyer questions would be the same as if they were talking to a Buyer’s agent.

You might wonder what if the Buyer wants the Seller’s agent to be their agent too. In CO a realtor can work with both Buyer and Seller but Seller would have to agree to change their relationship w/agent from “agent” to “transaction broker”. A transaction broker must be neutral and can’t favor either party. IMO, given the circumstances BM would be a complete moron to let his agent do that.

Here’s the disclosure form that explains the difference between an “agent” and “transaction broker”. There’s a third, less common arrangement where the Sellers agent could continue as agent to the Seller and treat the Buyer as a “customer”. The agent continues acting and negotiating in the Sellers best interest, putting the Buyer at a power disadvantage. This is most typically used when a Buyer is purchasing a newly constructed home and the Seller’s agent works for the builder....

I can imagine why Barry was upset when he found out that MG had given her phone to LE. I assume it contained the true timeline of things related, before, during, and after the weekend in question. LE would know the details of when Barry asked MG to assemble the crew, when he texted her on Sunday, what he said about the job, Suzanne, the tools, the hotel, all of it. And I assume they asked Barry questions about the timing of each and every one of those things. It’s hard to keep all of that straight if one is not being truthful. Sure, you might mess up a detail or two when remembering, but too many errors equals boxing into timeline lies.

MG was proud of having refused to take a lie detector test. The whole segment of her story about the unlikely duo of TN and GD meeting with her to make preposterous comments because she had turned over her phone to LE lacks some credibility for me. How would anyone, including BM, know she had done that, if she didn't tell them? IMO

SPECULATION:

It is possible that the build-up of two previous experiences of doctors and chemo for weeks on end for each experience plus then a more-recent third experience with doctors and chemo plus who-knows-for-how-long-it-would-extend "maintenance" doctor visits and treatments... that SM's SO was exasperated.

Noting the content of Valentine's Day note SM wrote to her SO in which she described how her SO was always there for her, got her through the experiences, etc... and now we have this most recent, third experience and maybe SM wanted for her SO to attend with her at least this next maintenance doctor visit (the Monday after MD) and maybe at least some of if not all future visits but the SO was 'just too busy' with work and maybe wasn't comfortable in the setting.

After having received such a note from his DW but now having been called out for not wanting or simply not mentally able to continue that on-site support when she really needed it that the SO finally snapped and didn't like that it seemed she no longer appreciated 'all he had done' to accommodate her continued illnesses and needs.

I suspect the SO had a serious breakdown. Panic ensued.

Although it's taken many months so far, I believe that this will be a successful investigation as a result of their steadfast dedication to finding out what happened to Suzanne. This is my own opinion.

My heart goes out to her loved ones who are suffering such a tremendous loss of not having Suzanne in their lives. I know we all feel this way for them.

She probably has retained an attorney. The advise is always don’t take the test. Whether it’s a polygraph, roadside sobriety walk the line or blow into the tube.
NEVER ADMIT TO ANYTHING. NEVER TAKE THE TEST. Standard advise from a defense lawyer. Many reasons.

our opening post on thread #1 was May 12 - and while I obviously won't name the immediate circle who had access to her former church's email address - I think we can speculate who sent it - I'm going with door number 1 ..

It’s really a complicated issue, just another reminder why I retired. AAANNND, the procedures can change, so as a listing agent, Disclose, disclose, disclose, buyers agent, ask, research, and ask again... good realtors earn their commissions...IMO
I suppose there are a few people who haven’t heard of SM, but the recent searches reduced that group, still disclose...

Question, if BM turned his phone over to LE why would he care if MG turned her phone over to them?

He may have thought deleting them was enough.

But the scenerio that I prefer is that he had two phones.

And if there is valid reason he was living a double life financially, he would need a second phone.
