I can’t remember which states were involved in the 2 cases I referred to in my previous post, it was quite awhile ago, but I’m aware it can vary from state to state.

Admittedly, law and legalese are not amongst my strong suits, but I continue to learn. Actually, I learn a lot about it here on WS, and I so appreciate everyone’s knowledge and input.
I learn something new just about every day reading here, which is great!

"Provoked Passion" Defense?
Colorado still has crime of passion defense so this makes sense.
@Momofthreeboys Thx for your post. A CO. law firm website states "The Defense (a mitigator which lowers the penalty) – of Provoked Passion" may be used in second degree murder trial.*
If prosecutor tries him only on M-1, def would not be able to raise PP defense and present evd of it, iiuc.
IOW, in a M-1 trial only, jury would not have the opportunity to convict of lesser offence, as has happened in some other cases discussed in this thread in past day or so.

As always welcoming comments, clarification, correction, esp'ly from our legal professionals. my2cts.

I take comfort in the wait.

Because for every day that we wait, so does the person that disappeared Suzanne. He’s sweating. He never knows when it’s gonna happen. Could be while he’s grilling, or in the dead of night while he’s sleeping, or it could be while he’s watching TV. A loud knock at the door, or maybe a battering ram. He has nowhere to go, he is surrounded. Detectives rush in and knock him out of his recliner. Off he goes to the police station in pink handcuffs.

A girl can dream while we wait. :D

I just breathed that in real deep and it brought me huge peace. I wish them well and I hope they get all the breaks they need to bust whoever.
I just hope that that last person that I know is out there will summon the courage to tell what they know...

Just watched the Profiling Evil Choir Practice. Chris said that he interviewed Barry and will release the interview on January 24th on his new channel. He also said he has 3 main focuses for this year and #1 is Suzanne. He made a promise to Gene and he will not let go of this case.

I'm glad he will continue pursuing Suzanne's case. Will his channel content be allowed to be discussed here?

Just watched the Profiling Evil Choir Practice. Chris said that he interviewed Barry and will release the interview on January 24th on his new channel. He also said he has 3 main focuses for this year and #1 is Suzanne. He made a promise to Gene and he will not let go of this case.

I'm glad he will continue pursuing Suzanne's case. Will his channel content be allowed to be discussed here?

It was only a short little conversation, but Mike also brought Tyler onto the board for a few seconds, who was at the search with Andy, and let him share his experience about when they got to an area they were really interested in searching with cadaver dogs. LE had told them they were not interested in that area, but it was one of the areas that got hit on by 2 different dogs. As soon as they got out and started searching, they were surrounded by black cars and helicopters with questions about why they were in that area. Tyler just said it was strange, and unlike anything he had ever experienced before.

Mike also said they that they have fed a lot of intelligence to CCSO that has to this day not been shared with the public.

Agreed! Keep the case moving by releasing the interview with Barry ASAP. No need to build suspense, Chris...this case already has plenty!

The interview will not be released on the Profiling Evil youtube channel. It will be released on a new channel "The Interview Room with Chris McDonough." I believe this new source would need to be approved.

IMO it is frustrating to have little to no info coming from LE about where they are in their investigation but we have to remember they’re under no obligation to reveal those details. I assume they feel there’s been no danger to the general public or they would have issued warnings to that effect. That’s all they owe us. If the Moorman family is dissatisfied with the investigation, I assume they’d let the Sheriff and other agencies know how they feel. Andy hasn’t been shy about speaking with media and I believe he’d speak out publicly if he was truly upset with the way the investigation has been handled. If locals are unhappy with Sheriff Spezze’s handling of Suzanne’s case, they can make their feelings known in the voting booth.

I’d love to know if they were able to retrace BM’s path(s) all weekend, what evidence they’ve gathered and when there will be an arrest but I respect LE’s stance, which is to say nothing that might jeopardize their investigation and keep working toward an eventual arrest. I’m confident that will happen.

We all would love our questions answered. However, sometimes it’s in what LE doesn’t say and more about what they do and don’t do. If they have a person of interest and are still gathering evidence, they won’t tip their hand to appease the media and public. POIs tend to get sloppy and over confident when they think they have gotten away with something.

I suspect LE is playing the mouse trap game right now. Keep the POI playing the game until the trap slaps down.

The POI had some advantages regarding secret hiding places and time. SM may never be found. I hope LE has talked to hunting buddies about hunting spots. LE has said they have conducted searches that media and the public hasn’t known about. Some searches we have seen. Those searches are major clues.

We just have to be patient. That is the hard part for everyone seeking justice for SM.

Agree, it was very interesting that LE told the searchers they were not interested in a location, but then when the searchers started searching that location, CBI descended upon them and moved them on their way. I wondered if CBI had the location under surveillance?
