Brand has been told to appear at Westminster Magistrates' Court on 2 May, but he is believed to be in the United States.

In these situations, where a suspect may be overseas, prosecutors seek to agree the defendant's return. If there is no co-operation from a suspect, authorities then consider seeking extradition.



Wonder if he will claim asylum in USA, saying he is being persecuted by left wing extremists.

How did they manage to formally charge him if he's not in the country? You have to be charged in person for these sorts of things, I thought?

Russell Brand assault trial evidence could come from lengthy ‘Arthur’ outtakes footage

A civil case brought against Russell Brand in the US has been offered hours of outtakes from his 2011 film Arthur to be used in court.

In 2023, Brand was sued by an unnamed extra, using the pseudonym Jane Doe, accused Brand of exposing himself to cast members before sexually assaulting her in a bathroom on the set. Brand and studio Warner Bros are both named as defendants. Both parties deny the allegations.

Warner Bros’ lawyer, Patrick Lamparello, also offered to submit outtakes of Brand in the film as part of evidence. He said the studio had “some hours of video outtake footage … four or five hours, it could be more, around eight”.

Filming for Arthur took place in Los Angeles, although the city’s police department said they had no open investigation into Brand. Lawyers for the comedian sought a delay in the case, suggesting there was an “overlap” with a current criminal case in the UK. Judge Shlomo Hagler rejected their request.

Russell Brand fears US prosecution over sexual assault claims​


Russell Brand fears he could face a prosecution in the US over sexual assault allegations, as his legal team attempt to delay a civil lawsuit filed against him in New York.

Court documents show that the comedian’s lawyers raised concerns that the case could “overlap” with the UK’s criminal investigation, and that it could lead to either case being prejudiced.

While the request to delay the civil case has been rejected, he has been granted an extension until 30 October 2025 to submit his deposition.

In a new statement, the police force said the Crown Prosecution Service has authorised an additional charge of rape and a charge of sexual assault relating to two further women.

The broadcaster, comedian and actor previously pleaded not guilty to five charges including two counts of rape, two counts of sexual assault and one count of indecent assault in relation to four women.

Mr Brand, 50, is due to appear at Westminster Magistrates' Court on 20 January 2026 in relation to the two new charges.
