I have a ques about this immunity deal thing. I understand about the 5th and immunity from your words. The part I am having a problem with is how does the SA know what the witness needs immunity from. Does Lee (for example) go to the SA and say this is what I know give me immunity. What if authorities say no. Then they have the info and Lee has no leverage. Are hints given? Clues? How does this work?
I am not an American lawyer...but I think we have something a bit similar where I come from. As I understand it, what they were talking about on NG is a type of immunity that is very limited....where I come from, to get around the equivalent of the 5th, in criminal proceedings the Judge can grant a certificate to the Witness which protects them against having the evidence they give used against them in future proceedings, except for proceedings for perjury, if the evidence is false. If the police can make a case without the person's evidence, there is nothing stopping them from doing that, but they can't use that persons evidence at the other proceedings against them.
It seems in Florida, the witness is given that protection automatically on being served with a subpoena.
ETA...there is a different type of immunity for prosecution against specific crimes...this is granted by the prosecuting authorities, usually after a statement is received from the witness....we call them "induced statements" where I come from, and again, they have a clause that they cannot be used against the person, then would generally name specific crimes. However, if the witness doesn't give evidence in accordance with their statements, the immunity deal is over and the state can prosecute them.
IMO, the As all have zero credibility, and I doubt very much any immunity other than perhaps the standard limited witness immunity, would be given to any of them. As a prosecutor you would have a hard time arguing to a jury that any of those people are reliable and truthful witnesses.
