Judge previously ruled the the defendant's phone was seized without proper warrant. State doesn't intend to use her phone.

They're going after the Cloud, as it were. AT&T has records. Location data. And the State has a warrant for that data.

Defence Counsel seems to be accusing Atty McGuinnes of lying to the Court or certainly misleading on this cell phone issue.

Defence Counsel is now claiming ATT data had been destroyed based on retention and State essentially pulled a 'fast one' on the data and is in fact 'fresh' and not from time of prior info pulled by the State from the tainted warrant.

JS is arguing that, before the other judge, the State represented they had not presented PC warrant before any other judge.

JS is calling the State deceptive or negligent.

JS citing AT&T records erasing after 13 months.

McGinnis pulls up the transcript to refute JS.

McGuinnis is calling out the Defence Atty misstatements aka lies and is reading from the prior hearing on the cell phone.

Great strategy to deal with continued lies imo from Defence Counsel.

JS now saying he misspoke 5 minutes ago....

Now JS is blaming the volume of discovery.

Defence Counsel is now backpedaling on his mischaracterisation of State.

Moaning begins on the terabytes of data dumped on Defence. Defence was waiting for the "Cliff Notes" report and so it was his choice to delay.

Just pure laziness imo from Defence.

Atty McGuiness imo needs to do a 'bombs away' on Defence Counsel on the ongoing lies and mischaracterising that always seems to happen. Defence can't even be relied upon to properly restate the record which is something I find absolutely shocking.

He is absolutely off piste vs the line of discussion imo.

Not sure what he is saying now....

But, you know its bad as its one back bending "thrust" at Judge R after another....non stop.

Essentially accusing State and CSP of misconduct.

State interrupts. Defense has gone far afield. JS is raising the spectre oof misconduct. That the State misrepresented itself by seeking a warrant without mentioning a prior warrant. JS is stuck on the unchecked box.
