3.08pm: Mr Davis said while police obtained a log from Baden-Clay's phone showing a particular interaction, there was no proof the phone was recording the log accurately.

''You couldn't certify that that function was working properly,'' Mr Davis said.

''All that you could say is that it did download that information.

''You can't say that that function was working properly on that telephone.''

Mr Robertson disputed that, saying ''the log files themselves were there''.

The court heard forensic examinations found Baden-Clay's mobile phone was placed on charge at 6.31pm April 19 and taken off at 6.50pm, going from 36 per cent charge to 43 per cent charge.

The court heard there were other charging interactions at 8.45pm and after 1am the following morning.

Mr Robertson said some of the know-how on examining the phone came from forums used by members of the forensic community.

''So there's really nothing to back that up,'' Mr Davis said.

Wow - Davis is REALLY getting desperate here, and I suspect that he may be painting himself into a corner as far as the magistrate is concerned..... Don't forget that the magistrate would have the WHOLE report, not just the bits drawn out by the defence questions. <modsnip>

Now talking about the "Find My Friend" application that Baden-Clay had on his phone.
 
They just had on Ch 9 news that the lady who approached GBC today was a friend of Allison's. I missed if they mentioned her name.

It seems strange language to use by this friend - don't love you, hate you. Seems more of an intimate statement to make. BUT I am definitely NOT suggesting there was anything intimate there at all. Far from it. Just something I wouldn't say to a friend's husband.

Yes... to me it was like an ex lover, someone who once told him she loved him..but now saying 'I don't love you, I hate you'.. But if it was a friend of Allisons I am not implying she was having an affair with him. Just that when this womans comments were first reported, that my thoughts were as I said, an ex lover?

It could be something innocent like she supported him after Allison went missing and told him she loved him blah blah.

She is setting him straight now thats for sure haha.
 
Am I correct in thinking that in the Jill Meagher case, the hearing was cut short because there was enough to substantiate a trial (including a confession to some charges)? I know someone asked the question earlier about whether GBC's hearing could be cut short if there was enough to suggest a trial is warranted, but I can't remember what the answer was.
 
I spoke to a neighbour of GBC's this morning who lives behind their rental property in Boscombe Road (a few houses back) and they didn't hear anything that night. All the noise must have been coming from the front of the house.

By memory, the stairs at the front of the house, the landing up the top I've often thought that she was thown over and off the stairs there.

The second day of the committal hearing of Gerard Baden-Clay began in dramatic fashion with a woman yelling in the court, &#8216;&#8216;I hate you!&#8217;&#8217;.

The blonde woman, who is understood to have been a close friend of Allison Baden-Clay, approached Mr Baden-Clay in the enclosed glass dock of Court 17.

&#8216;&#8216;I don&#8217;t love you, I hate you,&#8217;&#8217; she yelled in front of the court.

The woman, who was wearing a ribbon in Mrs Baden-Clay&#8217;s favourite colour yellow, declined to speak to media or reveal her name outside the court.

I've heard from a friend who is there, the woman also argued with the sister!

And he can't see his parents there today.
 
It's quite evident to me that Davis is playing his role of defence lawyer very well. Trying to instill that element of doubt with each and every witness. Well it's not working for me and I feel that Mr. Davis will become more desperate as the hearing progresses.

Ali, does the prosecution question the witnesses at all or are we just going to be subjected to the defence questioning them?

The prosecution is questioning them first though not a lot as their statements have been tendered in evidence. Then the defence is cross examining based on their statements. We are just really hearing about the cross examination.

IMO She may have initially felt sorry for him when Allison first went missing and may have expressed some affection to him - sent him flowers or a card. She may now have changed her point of view and taken this opportunity to express it. To me that makes perfect sense.

oh dear.. the woman who was formerly employed at Belle Real Estate,,one of Gerards , or , more accurately, Toni's contenders for Gerards 'charms'.. often referred to as Chinwoman, was blonde.. blonde in the extreme.
 
How did this mistake happen and why was it leaked and stated as fact.
Not good.

No it's not good but I do admire Neil Robertson for correcting it. He realised that the software was not working as it should and re-did the tests on the phone. He could have just not bothered and let his initial finding rest. IMO he is a man of scruples. :twocents:

Thats how I see it too as I cant see any woman outing herself like that.
