No it's not good but I do admire Neil Robertson for correcting it. He realised that the software was not working as it should and re-did the tests on the phone. He could have just not bothered and let his initial finding rest. IMO he is a man of scruples. :twocents:

I do agree, but I'm pretty sure they actually relied on it as evidence in the first bail hearing - not a good look unfortunately.

With all due respect as someone who's a bit of a bush counsellor I don't think anyone would know how they would react in these kind of traumatic circumstances. How do you even know that the police comments about the statements (or lack thereof) from the BCs are even true? Especially given the wrong information from the police in the rest of that article?

What is a self appointed" Bush Counsellor"

I think all those barking dogs were dingos.

Conversely, women other than Allison who have gone missing have not had the same amount of coverage or effort put into being found. This is because of the 'high profile' GBC himself has worked to achieve, Allison's past (Miss. Brisbane), and the white woman syndrome.

Mostly this has been brought up to understand their cultural positioning as different to mainstream Queensland = 'othering' - a normal part of human nature

Like or lump it, life today is a series of sound bytes.

GBC was not named as a suspect for a very long time

Technology is a steep learning curve changing daily. Similar IT forensic challenges were observed with experts in the Casey Anthony case.

It comes with being 'high profile ... if GBC was an onion picker in Withcott this wouldn't be the case. If you put yourself out there as flashy and successful, and a role model in the public eye, you have to be prepared for it to all turn fickle.

MOO IMO BAAH

whose the onion picker in Withcott ,, we may have met in the pub

Don't know any more, I'm just a cynical old observor and we'll have to wait and see if the speculative similarities have any basis in fact. I'm just big on having an open mind!

lots of wind blows thru 'open minds'... its always best to apply Occams razor... it narrows the indiscriminate theories from cluttering up clarity and analysis. I didnt notice a lot of 'open mindedness' on who else had the motivation to murder Allison. ? .. One thing is not speculative. Allison is dead. You would agree ?

Have we just been led astray here.......hmmmm......

Anyway, I think today answered some of our questions about the case. I'm definitely craving access to the full transcripts. Hopefully those who attended can share some more info when they have time to sort through their notes. Thanks to everyone who contributed today.

Alioop, by this do you mean that they might ask him if he would rather plead guilty?

Maybe but it might be just that he not continue with the committal. He may plead guilty though in the near future. I haven't been following that thread today so I am not really up on what is happening, just answering the questions hypothetically.

How did this mistake happen and why was it leaked and stated as fact.
Not good.

Just re the Facetime call that never happened: it was an error, the error was recognised, and the software was updated when the company were notified.

<modsnip>

Now that Neil Robertson has given his evidence, the Facetime call error is "out there". The exact means by which the error occurred are, once again, something that can't be discussed as it has not been reported by MSM, and it is also quite technical. Mr Davis's attempts to portray Neil Robertson as somehow an unreliable witness is likely to backfire badly on Mr Davis if he hasn't read the full report. But I'm sure he has - so his attempts to attack Robertson's credibility are, to me, a sign of his desperation.

And if GBC is committed to trial, then I'm sure that the prosecution would be going into a heck of a lot more detail re Neil Robertson's report.

Remember that today was all about the defence cross-examining witnesses based on their statements or reports, so Davis's questions would have been very selective to try and cast doubts. That will be much harder to do in a real trial, I suspect.

All of this IMHO of course...!

From Alioop: I don't understand why the media did not publish this info about the facetime call being an error. They knew as soon as they saw the second bail hearing documents that was the case so why not publicly state so. It did not prejudice anyone to release this info, and in fact the opposite. Why did the media hush it up.

An excellent question Ali - possibly because it was deemed too technical, possibly due to contravening an agreement with the software company, or maybe they simply overlooked it? Who knows? But the fact that it wasn't reported in MSM meant that we couldn't discuss it in here.

So if the FaceTime call is disproven and there is the possibility of accomplices. How did the accused round up the help? Any ideas?

Landline phones? I would think that GBC and his parents would have had landline phones - and I haven't seen ANY evidence regarding phone records from those....

Indeed! Given the very close relationship between the police and the media (they tend to feed each other) one does indeed wonder. Could it be that they were "encouraged" not to???

Thankyou for your reply. :)
So if the lawyers think things are looking grim they might just pull him aside and advise him on a different approach?
If he is determined to get off though is he likely to just plod along as he is?

Sorry for the questions, just thinking aloud i guess.

DAY two of the six-day hearing to determine whether Gerard Baden-Clay will face trial for the murder of his wife Allison has begun.
4.04pm: Court adjourns for the day.

3.48pm: Mr Robertson said the testing computers he used were not connected to the internet, and any phones or devices examined were taken to ''radio shielded rooms'' where they could not connect to cellular or blue tooth devices.

He said Baden-Clay's phone and the test phone were both ''working fine''.

Logging information picked up from Baden-Clay's phone came back in GMT time, the court heard.

Analysts had to add 10 hours to bring the logs in time with Queensland.

So, this information was known to both sides, for some time, and neither of them thought it only fair to let NBC , and the media know about it. I'm sorry, but that's just not good enough.
Bad Bad Bad. Not happy Jan !

I do agree Aunty - but I just can't understand why NBC never made a statement?

I wondered that too. But why nothing mentioned yet? Not a good feeling.

...oh and of course all us forty-something-mothers-of-young-children spend our precious evenings watching The Footy Show like NEVER! And when preparing for a huge conference the next day with a "just done" do, we go for our normal 2km walk, whilst wearing a item of clothing that provides warmth that has to be pulled over said coif, knowing that we have soooo much time to prepare lunches when we get back and pulling warm clothing item back over head because between 6 and 7 there is lots of time to do all this -NOT!! But wait, suicidal and depressed women are concious of their appearance, just raring to go to conferences and successfully run busy households with happy adjusted children - NOPE!

I am getting so angry at the assumptions and inferences being made about Zoloft takers. I was one and there is no shame except that as a strong woman, you feel angry that you need medication. If Allison had feelings that were what I experienced, then she was not suicidal and probably not even depressed- just anxious, overwhelmed and exhausted. She is a hero to have risen above his philandering and while assisted by medication, 90% is the strength of her character. I ache for those beautiful daughters of Allison's. There is no way in 100 million years that she would have left them.

Trying to catch up here but wanted to take the time to say awesome comment. It is commonsense!!!:rocker:

Yes always though it was a bit sus that it was "discovered" at the 11th hour just before the the bail hearing and seemed to be used to strengthen the suspicion that there were accessories afoot!

I don't know if they were true or not, and as the case unfolds I guess we will find out just how much the parents assisted the police and what information they were able to provide.

While I don't know exactly how I would react, and I never said there is a 'right' way but I believe that in one way or another, as a parent, if I believed I could assist with proving the innocence of my child, I would do anything in my power. I say this with no knowledge of the statements provided, only from what had been reported thus far. Time will tell.

  • #398
Even if no records can be shown that GBC called his family that night, we have to remember that he could have just driven there to ask for assistance.

hmm open mind? I think you have pretty much decided that the police are 'not to be relied upon' and are dicking around the Baden-Clays. Are you comfortable with this view or just being a devils advocate for the purpose of stirring things around. Please don't use this so called cynicism and contrariness as an excuse to hide behind your point of view - if you believe in justice for Allison then shout your point of view from the rooftops as we on here do. Just don't get aggravated- show why you believe - this is why we are here! For that reason only!!! NONE of us have personal vendettas against anyone. Yes the majority of people here have a similar but differing perspective from you so show us your open mind. Seriously telling us the case resembles Azaria (from which new policing policies were probably developed) and then stating the police haven't done their job because hey they are corrupt and only want a result makes you equally responsilbe for supporting these facts.

We believe Allison was innocent - if you believe differently you can always show us how!
