Defense Motion to Seal Penalty Phase Discovery Documents

  • #141
This is really the crux of the matter. Because the defense wanted the ability to keep asserting their position in the media, they basically argued vehemently against the gag order when the SA was requesting it. Normally my inclination would be that the Sunshine Laws are preventing the defendant from receiving a fair trial due to pre-trial publicity, but this could have been taken care of early on (before Caylee was found).

Yeah, so they try this on appeal, I'm certain it will be shot down for their response to the gag motion. You can't say you want it and them complain after you have it. Ain't gonna work, Baez.

She seemed to be barking out orders to both her defense counsel before she left and I took that smirk as a "I'm so shcrewed " look. I watched it again and I swear it looks as if she was on the verge of tears. Very emotional.

BBM: Such as "I want to see you in my office by 3pm today, and don't be late again. You know I don't like to be kept waiting." That kind of barking?

Something along those lines. She was not a happy camper! I've tried to get more screengrabs to illustrate my take on the emotions i saw, however, the video keeps hanging, freezing and after four attempts, it is so fhrustrating and I'm so mad I can't even swallow!
I love the stills WFTV made at the beginning of the hearing. I wish they would zero in on her exit.

The regularly slated status hearing last time left me somewhat unsatisfied, but this last hearing was like those completely unplanned get-togethers we sometimes have with friends that turn out to be much more fun than a planned event. I left the hearing and the discussion feeling far more satisfied this time around.

The only thing I could see that might explain Baez's self satisfied smirk this time around - well two things actually - first I suspect he thought he looked pretty fine in his new expensive suit, and second, he seemed relieved it wasn't his turn to take the floor and be in the critical spotlight - although he managed it twice anyhow.

I don't think he is going to be able to get his motion together to get Kronk in the door, and will expect him to whine and complain and of course blame it on someone else besides his own ability - especially if Mason really is sitting on a beach somewhere (eeuuwww now there's a mental picture).

I mean honestly - how was Baez supposed to know, when he is working night and day for his client, that the judge was going to swan off on holidays when there is critical work to be completed (insert eye roll).

Interesting that Mrs. Finnell was not aware on her first appearance in court that the judge already ruled he was bringing in a jury from another county. That does not mean that she has been denied the right to a jury of her peers, that argument on her part is silly imo. Many times folks have juries from other locations , so she is howling at the moon on that one, imo.

I do wonder why she didn't just ask for specific reluctant witnesses names to be sealed. Is she going to be yet another lawyer in this case who doesn't bother to review the judge's prior rulings. If the defense would have the law clerks do this, they could predict the judge's likely position on matters. It is the oddest thing I have ever seen that they skip this imperative step.

Uggggggh, I missed the hearing today. If anyone has links please post - in the meantime I will keep looking...........BUT............

from what I have read here - why would they not want the witness(s?) that could help prevent the needle to be known? I mean, gosh didn't JB say she is innocent? So why not do damage control by letting those influential people help sway us bloggers and posters back to the truth? Unless, someone told a fib and their nose is growing. Seems to me, they would have more to gain and NOTHING to loose, since those horrible bloggers and web sleuthers have already done their poor little innocent client in.

NEWS FLASH JB - KC did HERSELF in!

Come on now, don't you remember JB wants to save all that for trial? He's been saying for two years that she's innocent and he has the evidence to prove it -- it'll be his big "shock and awe" at the trial. I think it makes sense to keep the evidence that'll prove your innocence secret while you sit your butt in jail and the true perp is out there somewhere . . . . <insert sarcasm here>

IMO, with all the media spewing everyone on the defense side has done, they have NO RIGHT to ask for anything to be kept under wraps. And I wish Judge Perry would point that out!

I agree with those who made the observation that KC seems overwrought during this hearing. In other hearings she seemed to be "pretending" to be interested. In this hearing she was totally 100% engaged (and very concerned looking). The "death" part might be getting to her and or the what they know that we don't know thing is vexing her. My money is on incest/molestation from an early age. The reason she won't wave at CA is because she now blames CA for never helping her and treating her like a brood mare to help CA feel like a young Mommy. I really can not wait for all this to be a book. (A good book, written by a good writer). I wish Ann Rule would write it! It is so complex, she is the only writer who should re-tell this uber-complex crime story!

ITA, except I think Stephen King might be best to tell this story...

BBM Thanks, I looked at it several times and thought WTH is she doing? It looked as though giving them strict orders. Now, I am going to have to go back and look again to see her on the verge of tears.

As she finishes barking out the orders, she heads out, gets that look on her face, tries to shield it from the cameras and as she nears the doorway out, it looks to me as if she is getting ready to let loose with the boo hoos.

I thought that might be a boo hoo too, but after watching it a second time I think it is actually a self satisfied smirk. She seems to be very pleased with herself about what ever it is she told her 2 lawyers before she left the room.

Did anyone noticed there was a motion to withdraw filed with the clerk of court and also granted? I noticed it on the current news thread. Wonder what that's about?

"Dr. Jeffrey Danziger practices addiction psychiatry, geriatric psychiatry,
forensic psychiatry and psychiatry in Maitland, Florida.
Dr. Danziger graduated..." snip from link:

I see he's a forensic psychiatrist but I wonder if he's going to say Casey was an addict? Her friends didn't seem to indicate she was addicted to anything, just the "usual" partying (jmo) indulged in by kids in her age group, but with this defense team you just never know.

Very interesting that the Defense listed 3 more witnesses after asking to have all the witnesses for the penalty phase sealed.

Dr. Harry Knop - very interesting article here about him:

Dr. Jeffrey Danziger - I can see he is mentioned in a previous post on this thread

How about sex addition?

Brilliant!

ETA...The defense is looking to suppress her sexual activity, no? So I guess they won't claim she was a sex addict but I wouldn't put anything past this team.
