Defense Motion to Seal Penalty Phase Discovery Documents

I truly intend no disrespect to anyone, but after reading many negative comments about Dr. Krop, I feel I have to speak up and say something.

I don't know what happened exactly when Dr. Krop was disciplined in the referenced case, but I will say this. Dr. Krop was involved when my husband was going through a divorce from his first wife. He did right by my husband. We also consulted him a couple of years later about how our getting married would affect my husband's daughter, and what we could do to make it "less traumatic" for her. He gave us invaluable advice that, 30 years later, I still use in my every day life.

I'm not defending whatever it was Dr. Krop did to be disciplined, but I could never consider him [an unusual person] or a less than credible expert. He has been around for a long time, and during the tenure of his career has done MANY good things for MANY people. Even good guys make mistakes.

Snaz thank you for sharing that with WS. One case certainly can not define Dr. Krop and I am glad that you had a good experience with him.

That said.....his reprimand can be used to discredit him upon cross examination (if he takes the stand). That is the nature of the trial beast.

Both prosecution and defense counsel seek to discredit each others experts. Sometimes they do so by simply exposing inconsistent opinions and findings. Reprimands give them heavier ammunition for lack of a better term.

As for the name calling.... I don't think it was directed at Dr. Krop. But, I agree and I think we are better than that. So folks offer thoughts but don't be mean about it.

Thank you for sharing your personal experience. You're exactly right - even good guys make mistakes. His entire career should not be defined by one reprimand. Though as Sots said, it can be offered to the jury for consideration in re. how much weight they give his testimony.

I am happy he was able to help your family and you still reflect on his advice.

I don't see the many negative comments you speak of...but do see people reading the facts as they are now. I think there is frustration with the "types" of people the defense employs...and let's face it...everyone has a price. The disciplinary action against Dr. Krop was pretty serious. He can no longer serve the courts in providing custody evaluations. Now, look at how this could be used against him (part and parcel of what goes on at trial) and you will see why there may be a silver lining in all this.

RR0004, I really do understand how and why people feel the way they do... I just felt it appropriate to say that whatever happened later in his career, he is known for having done a lot of good work, as well.

Thank you for posting the link to the hearing.
AF says she is asking the court to "continue the temporary sealing of the penalty phase discovery" until after the trial phase is over.
She's asking that any new penalty phase discovery would be joined with the already existing penalty phase discovery. Somehow I got the idea that something more complicated was going on. :crazy: Does anyone know the terms of the original sealing? Is it until after the trial phase?

AF's point about the penalty phase discovery having nothing to do with the trial phase actually does make sense. In general, if someone is found 'not guilty' that discovery would have no bearing on the case. The Defense is still fighting the Sunshine Laws though and the Judge has told them again and again that that's not his call to make. But she rattled off some case where it says the court can make an allowance so, :waitasec:.

Well he has been disciplined - and all you are offering is anecdotal and imo unconvincing. There is no way he should be taken seriously in anything regarding this case, unless he has met Caylee.

Dr. Krop is a penalty phase witness. He is a psychologist. The only testimony he would give would be in regards to Casey. There would be no need to have ever met Caylee to testify regarding Casey's mental health.

I'm confused...I thought the order for the JAC to keep Penalty Phase witnesses private meant he granted this motion. So how long until we all get to see this list?

At the hearing Judge Perry said he will take the matter under advisement and rule on it later - I thought for sure he would seal these records. Obviously I know next to nothing about the law and after having read the Judge's order I now understand why he didn't seal the list. I'm still stunned though. Things have certainly taken a downward spiral for Team Casey lately.

Mrs. Finnell seems capable of respecting the judge's ruling and until she proves otherwise, I assume she will comply in a timely manner, perhaps over and above the other defense team members objections.
