Jurors are free to take their lunch break -- or to continue deliberating while they eat; it's up to them.

Here we are---this man wanted to hurt America and fellow Americans---yet in this country a criminal defendant is afforded rights that his country of origin does not. We are given attorneys ( public defenders ) , and judgement by our peers...We have a right to a defense.. So the country he wished to destroy offers him rights not afforded in much of the world. Why do terrorists label us as the bad guys !!!! I will never understand the supposed logic of madmen...
IMHO

Sorry folks,... still waiting....
Court official just popped in to say.....
still nothing,..

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
.@mrk21000 @courtchatter We are told we will have a 20 minute heads-up prior to any development (verdict or even a jury question).

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
.@TSurette No, this jury will not be sequestered (at least that is what we've been told).

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
Jurors can end their day at 4:30pm.
Judge will prob ask to see them all before they go home, assuming nothing happens in next hour.

Alysha Palumbo @AlyshaNECN · 1h 1 hour ago
7 hours of deliberations and still no sign of a verdict in the marathon bombings trial @NECN #Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 1h 1 hour ago
We are hearing the judge is about to call jurors in to say goodbye for the day; no verdict...but standby. #Tsarnaev

Alysha Palumbo @AlyshaNECN · 1h 1 hour ago
The defense attorneys are in courtroom 9 as the judge prepares to check in with the jury @NECN #Tsarnaev

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
The prosecution team is now also in courtroom 9, as we await the end of the 1st day of deliberations @NECN #Tsarnaev

Alysha Palumbo @AlyshaNECN · 1h 1 hour ago
#Tsarnaev is back in courtroom 9 as we continue to wait for the jurors to check in with the judge. Should happen soon @NECN

Alysha Palumbo @AlyshaNECN · 1h 1 hour ago
The jury is in the courtroom @NECN #Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 1h 1 hour ago
Media allowed back into court; lawyers here too. We wait.
#Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 1h 1 hour ago
#Tsarnaev enters, his lawyers smile at him, they chat.
He seemed to quickly scan the (nearly empty) courtroom gallery.

Jim Armstrong @JimArmstrongWBZ · 1h 1 hour ago
Judge: "It's time to call it a day."

#Tsarnaev

Alysha Palumbo @AlyshaNECN · 1h 1 hour ago
Judge says the jurors sent two notes with questions & he will share them with attys & give them answers tomorrow @NECN #Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 1h 1 hour ago
Jury has sent two notes, we just learned. Judge says he and lawyers will answer the questions and respond tomorrow.

Jim Armstrong @JimArmstrongWBZ · 1h 1 hour ago
Judge: Don't even think about this case tonight; take the time to yourself. No research.

#Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 1h 1 hour ago
Judge excuses jury for the day.
We remain.

Jim Armstrong @JimArmstrongWBZ · 1h 1 hour ago
The 2 notes from the jury were written at 4:25 and 4:30, judge says.

Jim Armstrong @JimArmstrongWBZ · 1h 1 hour ago
That's it. We won't know those questions right now.

#Tsarnaev leaves.

Alysha Palumbo @AlyshaNECN · 1h 1 hour ago
So after more than 7 hours of deliberations the jury has NOT reached a verdict @NECN #Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 39m 39 minutes ago
.@Jovan333 This isn't the death penalty part - that's next (assuming he's found guilty on at least 1 of the 17 DP counts)

I think there is something like 30 counts so they have to go through and rule on each count. If they are doing a proper job, that takes time, imo.

At federal court (take THAT, @MBTA_CR) nice & early, ready for day 2 of #Tsarnaev jury deliberations.

Jim Armstrong @JimArmstrongWBZ · 3h 3 hours ago
Hopefully this morning Judge O'Toole will reveal the contents of the 2 notes (questions) jurors sent late yesterday afternoon. #Tsarnaev

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
I'm inside courtroom 9 as deliberations continue in the marathon bombings trial @NECN #Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
Media is allowed in courtroom; lawyers are here, but we await #Tsarnaev, judge & jurors.

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
But before deliberations begin this morning, attorneys and the judge are expected to answer the jury's 2 questions @NECN #Tsarnaev

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
#Tsarnaev is in courtroom 9, greeted by his attorneys with smiles as he sits down @NECN

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
Judge's clerk calls all the attorneys into judge's chambers, we assume to review the 2 jury questions from yesterday.
#Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
Lawyers emerge from judge's chambers...
And...we wait.
#Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
#Tsarnaev enters - black suit coat, blue sweater. Takes seat with lawyers and immediately they are laughing and talking.

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
#Tsarnaev strokes his goatee, and Miriam Conrad leans closer to share some information.
Waiting for judge and jurors now.

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
8 members of the public have chosen to be here; benches for survivors and families are largely empty. Courtroom is mostly media/lawyers.

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
The jury and judge are coming in to courtroom 9 @NECN #Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
Jury and Judge enter.
#Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
Judge: have you been discussing this case outside of jury room, avoided media?
All vigorously say yes.

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
1 jury question: can a conspiracy pertain to a sequence of events over multiple days or just one event? @NECN #Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
Their 1st question has 2 parts.
- Can a conspiracy pertain to a sequence of events over many days or just one event, the jury asked.

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
Judge: the answer is for you to decide. A conspiracy can be limited in scope or over a long period of time. Depends on facts.

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
Judge says it's up to the jury to determine duration and scope of the conspiracy @NECN #Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
(If I had to guess, they are pondering the charge that directly connects the murder of Sean Collier to the Marathon bombings themselves.)

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
Counts 1, 6 and 11, the jury also asked the sub-parts; do we need to consider all parts & be unanimous?

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
Q:if there are subparts to question & they only need to find one affirmative to find him guilty do they have to answer all? @NECN #Tsarnaev

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
Judge says yes they need to answer all subparts of the questions @NECN #Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
Judge: if you find #Tsarnaev guilty on first part, you must answer all sub parts AND be unanimous on the sub parts.

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
2nd question: What is the difference between aiding & abetting; is there difference between the two? It seems to us like they are different

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
The jury's 2nd question was does evidence have to prove #Tsarnaev BOTH aided & abetted to find him guilty of that @NECN

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
Judge said "aiding & abetting" is a single concept @NECN #Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
Judge: Aiding and abetting is one concept, one thing. You must consider them together.

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
That's that; judge tells jury to get back to work.
Before they are escorted out, defense asks for sidebar.
#Tsarnaev

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
After a brief sidebar the jury resumes deliberations at 9:30am @NECN #Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
Sidebar ends, no word about what it was about.
Jury goes back to work at 9:29
#Tsarnaev

Alysha Palumbo @AlyshaNECN · 2h 2 hours ago
It's difficult to analyze the jury questions but it's clear they are focusing on the legal language in the jury verdict slip @NECN #Tsarnaev

Jim Armstrong @JimArmstrongWBZ · 2h 2 hours ago
So the jury had questions about Counts 1, 6, and 11. Here they are:

1, 6, & 11 are the conspiracy charges (jury asked re: what the timeline of a conspiracy can be & if they have to be unanimous in sub-parts)

abet

"verb (used with object), abetted, abetting.
1.
to encourage, support, or countenance by aid or approval, usually in wrongdoing:
to abet a swindler; to abet a crime.

Synonyms Expand
help, aid, assist; promote..."

http://dictionary.reference.com/browse/abetting
--------------------------------

AIDING AND ABETTING (AGENCY)

"The guilt of a person in a criminal case may be proved without evidence that he personally did every act involved in the commission of the crime charged. The law recognizes that, ordinarily, anything a person can do for himself may also be accomplished through direction of another person as an agent, or by acting together with, or under the direction of, another person or persons in a joint effort.

So, if the acts or conduct of an agent, employee or other associate of the person are willfully directed or authorized by the person, or if the person aids and abets another person by willfully joining together with that person in the commission of a crime, then the law holds the person responsible for the conduct of that other person just as though the person had engaged in such conduct himself.x Notice, however, that before any person can be held criminally responsible for the conduct of others it is necessary that the person willfully associate himself in some way with the crime, and willfully participate in it. Mere presence at the scene of a crime and even knowledge that a crime is being committed are not sufficient to establish that a person either directed or aided and abetted the crime."

2/2 Those questions apply to every count vs. Dzhokhar Tsarnaev and give no hint how close jury is to a verdict, @PeteWilliamsNBC reports.

You Could Buy the Tsarnaev Trial Transcript. Or You Could Buy a Range Rover.

"...Patrisso offered a “rough estimate” of the cost to obtain the transcript, based on the estimated length of the trial. Her estimate is based on the fastest transcript turnaround.

• Estimated 68 days

• Roughly 5.5 hours per day

• Approximately 225 transcript pages per day

• That’s somewhere in the neighborhood of 15,300 pages.

• Total projected cost: $92,565...

...It’s probably because you can’t type 225 words per minute."

@JimArmstrongWBZ does Tsarnaev talk to his attorneys much?

Jim Armstrong @JimArmstrongWBZ · 6m 6 minutes ago
.@AndreaWBZ All the time. When he first arrives, during sidebars (w/ whoever stays w/ him at the table), during breaks, before he leaves.

AndreaWBZ ‏@AndreaWBZ 6m6 minutes ago
@JimArmstrongWBZ does he seem to initiate conversation w/ them or the other way around?

Jim Armstrong @JimArmstrongWBZ · 6m 6 minutes ago
.@AndreaWBZ Both. He leans over to talk sometimes, other times they engage him.

So are there jurors that are considering him NOT GUILTY of some of these charges?

So are there jurors that are considering him NOT GUILTY of some of these charges?

Sounds like it, but maybe some just want some kind of clarification of the law; some of the jury instructions could be a little confusing to some, but it's all there in the jury instructions in black and white, IMO:

The jury instructions:

http://ftpcontent2.worldnow.com/whdh/pdf/150402-tsarnaev-jury-instructions.pdf

On pg 15:

"...All remaining counts (aiding and abetting)*

I just instructed you that three of the counts in the Indictment charge the defendant with
conspiracy. The remaining counts charge the defendant with committing substantive offenses.
In all of those substantive counts, as they are called, the defendant has been charged both as a
principal and as an aider and abettor. Before I instruct you on the elements of the substantive
counts I need to explain the meaning of aiding and abetting.

A person may be found guilty of a federal offense if he aids or abets another person in
committing the offense. To “aid or abet” means intentionally to help someone else commit an
offense. For you to find the defendant guilty as an aider or abettor, you must unanimously find
that the government has proved each of the following three elements beyond a reasonable doubt:

First, that someone else committed the charged offense;
Second, that the defendant took an affirmative act in furtherance of that offense;
Third, that he did so intending to facilitate the commission of the offense.
To be guilty of aiding and abetting, the defendant need not have participated in each and
every element of the offense, so long as he facilitated, or assisted, some part of it by words, acts,
encouragement, support, or presence. But he must have participated in the offense as something
he wished to bring about..

In every count where the defendant is charged both as a principal and as an aider and
abettor, you may find him guilty if you unanimously conclude beyond a reasonable doubt that he
was either a principal, an aider and abettor, or both..."
------------------------------------------------------------------------

I went down the jury instructions and was able to say guilty for all, even the murder of Officer Sean Collier.

I hope not I hope they are just taking their duty seriously and considering each charge in there own right. There may be some charges they are confused about in legal terms.
