If Adam had access to the house at 6:30AM on 7/13 then why wouldn't he have had access at 3:00 AM of the same morning. Did Rebecca or Jonah give him a key to get in after 3:00AM but before 6:30AM?

Who said he had a key ever? There is no evidence Adam wanted or tried to access the house prior to his discovery of RZ's body. No evidence he was ever given a key by anyone. LE haven't said he had a key to the main dwelling. You are asking me to speculate on something that has never been raised as an issue by LE. THEY know the time the computer was accessed and they know who had access to the house.

Excerpt from Rebecca's autopsy report:

"...There are many punctate, linear and slightly irregular abrasions on the back, extending from the neck to the mid buttocks..."

Does anyone know how the cactus plant would cause punctate wounds to Rebecca's neck and upper buttocks? If her hair was under the noose and tee shirt then it was held in place and covered her neck and upper back. There is no way her neck and upper back could be wounded by the cactus with her hair, the rope and the tee shirt covering it.

Also, the same for her upper buttocks. Her hands were tied behind her back and would have been positioned over the top of her upper buttocks so how did the cactus scratch her there?

He didn't speculate that it was a cactus that caused the injury, he said the wounds were consistent with RZ landing on "plants." Plural.

I did not ask for speculation per se but intended to pose a rhetorical question. If Adam got into the house at 6:30AM then would he not have also been able to get into the house at 3:00AM?

When she was purported to be cut down?

How did landing on plants cause scratches to her neck? Her neck was covered with her hair, the noose and a tee shirt wrapped around it three times.

How did landing on plants cause scratches to her upper buttocks? Her hands were tied behind her back so they covered her upper buttocks and would have shielded that area from injuries.

The forensic examiner based his opinion on his training and experience. I don't believe he was merely speculating. I haven't seen any evidence that it was something else.

What ever happened to science and logic? If SDSO was investigating a murder as opposed to a pre-determined suicide then they would have tested the computer keyboard for prints and DNA. I believe I ought to move this post to the evidence not tested thread.

BTW, I do believe the forensic examiner did more speculation on this issue than actual examination and investigation otherwise he would be able to show the proof of what he alleged.

Thursday July 14, 2011

Investigators were waiting Thursday to determine if a woman who died in the historic Spreckels mansion was murdered, took her own life, or somehow fell victim to a strange accident.
“We haven't even confirmed this has been a criminal matter,” said San Diego Sheriff's Capt. Tim Curran.

While they waited to classify the probe as a homicide or a more routine death inquiry, everyone seemed to agree on one thing: the puzzling circumstances surrounding the death of Rebecca Nalepa, also known as Rebecca Zahau.

Impossible to come to that conclusion. RZ was in the house and she could have failed to lock the doors. You have yet to provide a link to support your claim that Adam wanted in or tried to enter the house prior to his discovery of RZ's body.

But she didn't land on plants, as Mittymick pointed out above. Adam purportedly cut her down, no?

I'm not the ME, who was there and saw the plants, saw her neck, saw her hands.

Her hands were tied behind her back but I find it highly unlikely her hands covered all of her buttocks.

The ME didn't say she landed on the plants. I wasn't there. I don't know how tall the plants were.

I never stated that, as you wrote,..." Adam wanted in or tried to enter the house prior to his discovery of RZ's body."

I wondered whether or not he had access to get into the house at 3:00AM. Adam told the police that he went into the house at 6:30AM. If he had access at 6:30AM then didn't he also have access at 3:00AM? That is a question. You are not obligated to answer it if you don't know.

Is this a fact or not? The term "likely" does not denote what would be known as a fact but in fact is only speculation. Are you quoting or paraphrasing the SDSO statement?

"Likely" is a term accepted by the courts when testimony is from forensic experts. It is impossible to evaluate circumstantial evidence with 100% degree of certainty.

You brought up the plants. I asked how Rebecca got scratches to her neck and upper buttocks.

Her hair, the noose and the tee shirt wrapped around her neck three times would have protected her neck from scratches. Likewise for her upper buttocks. Her hands tied behind her back shielded that area.

You are not required to answer these questions if you do not know. The questions are not directed at you specifically.

The computer keyboard could have been analysed for prints and DNA to determine if a person or a "cookie" accessed the computer.

I must be tired. Or dense. Both, I guess.

Because I'm reading the above statements posted by you, and I see they contradict each other.

Please clarify?

You did state as a fact that Adam had access to the house. Where has he or anybody else ever said he had access to the house whenever he wanted?

If you are going to keep implying the man is a killer, please provide a link to show Adam KNEW the house was unlocked and that he could enter at 6:30 AM or any other time or that he even wanted to.

The autopsy report stated that she had scratches on her upper buttocks not lower buttocks.

Her hands were tied behind her back and covered her upper buttocks. How did she get scratches on her upper buttocks when her hands covered that area.

If you don't know the answer then your are not required to try and answer the question.

We know he had access to the house. He entered the house, according to him, to retrieve a knife to supposedly cut Rebecca down. He's telling us he had access.

My question is...seeing as he had no problem accessing the inside of the house to retrieve said knife to cut Rebecca down then...who's to say he had no access hours earlier???

Do you think someone else in the house opened the door to the kitchen for him?

Eeks!!!I never said any of that!!!

I wrote that Adam told the police he had access to the house at 6:30AM.

I then questioned whether Adam did not also have access to the house at 3:00AM as well.

I find your reaction to my pondering stunning to say the least.
