What you said was 'very, very, drunk to block out what you are actually doing' which sounds like the definition of what a black out is IMO. I do think that being so drunk that you don't remember what happened should not be looked at as severe as someone who plots and then carries out a murder. Heat of passion vs cold, premeditated.
I thought JS blamed her condition on Abilify. I understood that prolonged use of this drug can cause someone to shake like JS did so I don't know if that was the cause of her shaking or it was alchohol withdrawl. I'm sure this trail will have plenty of medical opinions.
Yes....but you can be very, very, drunk and not be in a blackout! Plus she was an addict, she wasn't just drunk, she was in full-blown physical addiction to alcohol. You don't get the DT's unless you can't physically cope without it. In that scenario, it's highly possible she wasn't in a blackout, but who knows?
BTW....You are not 'non-functional' in a blackout! You have emotion, thought, intent, and the ability to carry out intended actions based on those cognitive aspects.....which is why it does not meet the criteria for an insanity defense. Blackout simply means you cannot recall what you have done. But as others have said....she seemed to have a recollection of where her children were.......so obviously not in blackout.
