What a minute. I thought when the defense went with an affirmative defense (Insanity) it was on them to prove she was insane.

How else would they do that if they didn't produce doctors?

I don't know about anyone else but this defense attorney is so boring to listen to. I am already getting sleepy and zoning out. LOL!

IMO

You're right, the burden to prove insanity is on the defense. But they can't produce any doctor because she's obviously not insane. She's just another vicious, vindictive killer who was out for revenge. She not only knew what she was doing, she wrote it down so she could go back and enjoy her handiwork all over again.

I can't imagine any streets in Tampa that would fit that criteria. That's one thing that makes me lean (slightly - still on the fence) toward insanity. She shot him, while driving the car, in a very public place. Maybe she thought her hand had been forced, since he saw the gun.

They lived in New Tampa, on the outskirts of the city of Tampa. There are large ares that were unincorporated.

Here's a map of the area (hope this link works)

To me when the defense attorney talking about the letter she sent to Caylx is totally irrelevant.

What does that have to do with murdering her children much later on?

What were the circumstances of the 9-month hospitalization?

she was in a voluntary study at WR in DC. (she wanted to enroll)

What would be really good is very clear and concise evidence -- beginning in Sept 2010 or so...and leading up to and highlighting the week or so before the murders -- that would indicate her state of mind...

...all this other stuff is just succeeding in putting the jury into a coma ...by time she gets to the important stuff, they will not be hearing anything she's saying

I think to pay attention to this Def. Attn. you needs ALL forms of "coke" to keep alert (and you know what I mean ).

ETA- Like Scarface quantities.... :giggle:

Yeth I do  When I first heard the 'say hello to my little friend' I thought he meant to partake of that pile of white stuff on his desk until I looked up and saw he was blowing the carp out of his mansion. By the way that house has come up for sale for a whole lot of little friends... 35 million of them.

Under the M'Naghten Rule (which Florida uses to determine insanity), the burden lies on Prosecution to disprove that the defendant:

"1. Did not know what he or she was doing or its consequences, or

2. Although he or she knew what he or she was doing and its
consequences, did not know that it was wrong."

M'Naghten Rule can be found here;

Oh thank you.

That makes me feel better because I do think the state put forth very convincing evidence supporting she was sane at the time.
