This witness did review the Walmart footage, but did not speak to DS's mother, nor the couple DS spoke with in Walmart parking lot. DS said he smoked cocaine in the Walmart bathroom.

Yes, BUF! I was going to reply, too (but spared everyone). With all that footage, is there ANY that shows him ducking into the men's (or women's) room? I doubt it.

I can't remember. Do we know if there were drugs in his system at his arrest? (Not according to him, but was he tested?)

I may be wrong, but I don't think they did a toxicity test after his arrest -- but my memory Icould be foggy. A standard test only "looks for" certain drugs. I don't know how long those drugs stay in someone's system. Maybe the defense will bring it up if they do have results from a tox screen -- but it would have had to have been a special tox test for some of those drugs he may have been taking/using, I believe. You have to specify what drugs to look for if you want results beyond the standard drug & alcohol test.

He seemed a bit cocky to me, very unlike the psychologist.

Yes, 15 min. -- we've seen it before -- an "expert's" testimony based on a 1--2 hour interview.

This case is horrific and shocking. I don't care what illness or addiction this guy has, but he is a depraved monster and should never see the light of day again.

What is the purpose of this witness -- the lawyer? I have to admit, I have been zoning out and not paying attention because it's kind of boring.

I totally get he is entitled to a defense during this phase but I'm running out of things to do while listening. Flossed teeth, sorted sock drawer, dusted, folded 2 loads of laundry, supper prep. Guess I'm stuck :facepalm:

It's bs isn't it? He gave no defense at all in the actual trial, but he's trying to spin these mitigations in the penalty phase. I don't think this jury is going to buy what the 🤬🤬🤬 is selling.
