What is the purpose of this witness -- the lawyer? I have to admit, I have been zoning out and not paying attention because it's kind of boring.

Just guessing, but maybe to show why he previously got so little time and released on probation...only to re-offend again.

We may not be, but DS certainly is attentive

IMO regarding killer Baker Acting himself it would be self serving. Maybe his drug sources refused him. Mom was no longer giving him money. Anything to get whatever kind of drugs. Guess we will never know.

I totally get he is entitled to a defense during this phase but I'm running out of things to do while listening. Flossed teeth, sorted sock drawer, dusted, folded 2 loads of laundry, supper prep. Guess I'm stuck
Candy crush?

How he can say that he was in the bathroom when there is video of him throughout walmart? Does he think they are stupid!!

I think they had hours of footage and we saw a condensed version?

Seems like they are just going through his criminal history right now. DS has his hand to his face looking nervous/terrified as ever.

I was just now going to ask the same thing -- I've never seen this kind of testimony before, but I guess it's a vehicle for showing DS's record thru the years and explaining some things about Florida jurisprudence. He seems like an okay guy. No 'tude.

I wonder if it's worth cross-examination? It's stuff that doesn't seem to help that p*rvert at all, IMO.

I'm kind of getting a sense that it is the defense trying to blame the failing of the state to treat him as a mentally disordered whatever.

I found the psych stuff interesting, not because of this waste of space, but just in general. I was multi-tasking and then had to run out so I hope it's posted later so I can rewatch it.

Yes, he's shown uncomfortableness (my made-up word) all thru things today. I wonder if he is truly afraid of the death penalty, in spite of what he has said. Or maybe his cowed look is just for pity. Poor, poor man. His life has been so hard. <gag>

But, he has had about 55-60 more years that little Cherish had, and her life was just a bit tougher than his.

He could have received life in prison for the prior attempted kidnapping, as a habitual offender, but there was a plea deal for 6 years.

Please come over to my house! ;)

I am genuinely confused about this witness. I don't see the point.

Now they are discussing civil confinement.

Good point, alexwood -- you're prolly right. It'll prolly get covered that way on their closing. "Even the State didn't help him. Poor man. It's not totally his fault -- many people/institutions failed this needy man."

IMO that the State did not take him off the street. So they are partly responsible

The state of FL initiated civil confinement proceedings against DS and later voluntarily dismissed the action (dismissed April 2002).

Agree. Happens way too often.

And he is not "criminally responsible" because he was too mentally disordered to understand the gravity of his actions.
