Oh, the witness used to work with the prosecutor. That's an interesting dynamic, but they seem to respect each other.

In 1977, two separate examiners found he had no organic brain damage. 1993 attempted kidnapping, he was originally sentenced to 15 years. (It would be consistent with the charge then.) It was brought down after the defendant said his counsel was incompetent on appeal

Now, the judge had said (on Friday), that the court session may go overlong today on account of all of the witnesses they have to accommodate in one day. So, I sincerely hope that this witness will be wrapping it up shortly so we can at least get 1 more witness in today. Something tells me that they won't be going "overlong" today after all.

State is stressing the voluntary dismissal was because DS agreed to go into a treatment program.

It was the DCS recommendation that he didn't meet the requirements to be committed. Prosecutors would not have the opportunity to object to that, because of their ruling.
