The cases against Trump should have gone to a jury-- they would have decided the outcome. Instead, since Trump was elected president, there was no way these cases could go forward. Mr. Trump has avoided accountability his entire life by using our messed up courts -he uses the get of jail free card every time. One thing he is good at is manipulating the court system.
I agree, Jack Smith has been manipulating the court and innocent people for millions of dollars for years. I do hope information is released, especially the interview with Biden on his classified documents, stored in an unlocked garage, and Obama and why they weren't charged.

I think we're going to see and hear a whole lot in the next 6 months. I've had my eyes on Jack for the past 20 years.

Are you talking about the interview with Biden and Robert Hur said he was to old and incompetent to face criminal charges while he was running for re-election?

Moo … all elected officials have documents. I give the benefit of doubt.
When I packed up my office of 20 years, I didn’t personally go through every document. Much stuff was just thrown in boxes haphazardly. After 10 years of storage in my basement corner, during Covid, I did. Yup, there was stuff (copies/not original) that should not have been packed and I shredded. Nobody gives a hoot about old Outdated material, confidential or not.

Didn’t one of the astronaut secretly keep a moon rock?

A federal judge has temporarily stopped special counsel Jack Smith from releasing his report into the two indictments he brought against Donald Trump, Reuters reports.

The decision was handed down by Aileen Cannon, the Trump-appointed federal judge in Florida who presided over his case for allegedly hiding classified documents, and ultimately ordered the indictment dismissed. Here’s more on Cannon’s latest decision, from Reuters:

U.S. District Aileen Cannon, who presided over the now-dismissed case accusing Trump of illegally holding onto classified documents, directed the Justice Department not to release the report until a federal appeals court rules on a request from Trump’s two former co-defendants in the case.

Lawyers for the co-defendants, Walt Nauta and Carlos De Oliveira, who were charged with obstructing the documents investigation, moved late Monday to block release of the report.

Nauta and De Oliveira argued the report would improperly interfere in their case, which remains ongoing.

Smith led both the classified documents case against Trump and a second prosecution accusing Trump of attempting to overturn his defeat in the 2020 election. Both cases have since been dropped.

Mr. Nauta & Mr. de Oliveira conspired to delete footage from security cameras after the Dept. of Justice issued a subpoena asking for surveillance footage of the basement where it said confidential documents were held. In the court documents, Mr. de Oliveira is claimed to have texted another employee who was the director of information technology that "the boss" wanted the server deleted. The documents allege that Mr. de Oliveira later met with the employee in a small IT room, told him their conversation should remain private, then pressured the man into obliging his request after the employee told Mr. de Oliveira that he did not have the authority.

7/26/24 Update: As Special Counsel Jack Smith’s appeal in the classified documents case against Trump gets underway, a federal judge here in Atlanta has set a date for Smith to file his opening brief in the case. Smith must file his brief by 8/27/24. Trump’s attorneys then have 30 days to respond to that brief. Following that, Smith had 21 days to file a reply. If the appeals court rules in favor of Smith, then that would result in the reinstatement of the indictment against Trump & even conceivably the reassignment of the case to a different judge.
8/12/24 Update: Trump is set to sue the Justice Dept. for $100 million over the classified documents raid on his Mar-a-Lago estate, according to reports. Trump's lawyer Daniel Z. Epstein wrote in a legal memo that the raid showed a "clear intent to engage in political persecution" & also "tortious conduct by the United States against Trump." The FBI's raid on Mar-a-Lago took place on August 8, 2022 & hundreds of pages of classified documents were removed. As a result, Special Counsel Jack Smith indicted Trump on 37 felony counts, including willful retention of national defense information, conspiracy to obstruct justice & false statements. Trump pleaded not guilty to all counts. Judge Aileen Cannon, a Trump appointee, threw out all the charges earlier this year, ruling that Smith's appointment was illegal. Smith is currently appealing that decision. Epstein is requesting $15m in legal fees for Trump’s Florida legal defense & $100m in punitive damages. Epstein’s paperwork is an administrative claim – it is not a lawsuit. The Justice Dept. has 180 days to respond before team Trump can move forward with filing an actual lawsuit. Also, the judge presiding over Trump’s classified documents case – who notably has issued ruling after ruling favorable to him – actually denied his request for a hearing challenging the legality of authorities’ search warrant against him, suggesting maybe it wasn’t so bad a search after all.
8/26/24 Update: Special Prosecutor Jack Smith filed appeal re the dismissal of Trump's classified records to the U.S. Court of Appeals/for the 11th Circuit. Summary: The Attorney General validly appointed the Special Counsel, who is also properly funded. In ruling otherwise, the District Court deviated from binding Supreme Court precedent, misconstrued the statutes that authorized the Special Counsel's appointment & took inadequate account of the longstanding history of Attorney General appointments of special counsels. Asked that case be remanded to Court for further proceedings.

9/4/24 update: A retired federal judge is among those asking an appeals court to reassign former President Trump’s indictment on charges of mishandling classified documents case to a new judge. In documents filed with the 11th Circuit Court of Appeals, two groups of legal experts& former government officials say U.S. District Judge Aileen Cannon should be removed from the case. Former federal judge Nancy Gertner & two legal scholars, Stephen Gillers & James Sample say rulings by Judge Cannon & her numerous delays have raised “well-founded concerns that she may be biased against the Government’s case & unable to manage that case impartially.” They’re seeking permission to file an amicus brief. Gertner & the legal scholars were joined in the motion by the government watchdog group, Citizens for Responsibility & Ethics in Government (CREW). They say if the appeals court overturns Cannon’s ruling, it would be the third time it’s reversed her in “a seemingly straightforward case about a former president’s unauthorized possession of government documents.” They say Judge Cannon’s ruling ignored the “plain text” of the Appointments Clause of the Constitution which allows the Attorney General to appoint a special prosecutor. Her dismissal of the charges they say are “in clear defiance of binding Supreme Court precedent & the plain text of Congress’ statutes.” They’re asking the Appeals Court to reverse Judge Cannon’s ruling & to remove her from the case.

11/7/24 Update: Special Counsel Jack Smith is in active talks with senior leadership at the Justice Dept. evaluating ways he can end his prosecutions of Trump after he won the election. Smith is not going to wait around to be fired by Trump. Intention is to have the 2 cases (in Florida & DC) brought to an end before Trump takes office so they are in compliance with DOJ Office of Legal Counsel policy prohibiting the prosecution of a sitting president.
11/14/24 Update: Special Counsel Jack Smith has now moved to halt his Florida case against Trump, telling the 11th circuit to hold his appeal of Judge Cannon's dismissal in abeyance. Just as in DC, he says he will inform the Court of the result of its deliberations & if appropriate, file its reply brief no later than 12/2/24. The Government has consulted with counsel for the defendants, who do not object to this request.

1/9/25 Update: A panel of judges on the Eleventh Circuit Court of Appeals, in a ruling Thursday night, denied an effort to block the release of special counsel Jack Smith's final report on his two investigations into Trump. The Eleventh Circuit, in its decision, declined to immediately overturn Judge Cannon's temporary injunction, instead ruling that the Justice Dept. can file a separate appeal if they want to release the report earlier than this Sunday, when Cannon's injunction expires. Attorney General Merrick Garland, in a letter to Congress informing them Wednesday that Smith had concluded his investigations, acknowledged that he was, at that time, barred by Judge Cannon from releasing the report outside of the Justice Dept., but that he intended to make Volume One of the report, regarding Trump's efforts to subvert the 2020 election, available to the public once he is "permitted to do so" by the courts. Garland, in the letter, confirmed that he plans to make available Volume Two of the report, pertaining to Trump's classified documents case, available to leaders of the House & Senate Judiciary Committees for closed-door review as soon as the Eleventh Circuit permits him to do so. "Consistent with local court rules & Department policy, and to avoid any risk of prejudice to defendants Nauta & Carlos De Oliveira, whose criminal cases remain pending, I have determined, at the recommendation of the Special Counsel, that Volume Two should not be made public so long as those defendants' criminal proceedings are ongoing," Garland wrote.

Aileen Cannon is slapped down again: she is a perfect person for Trump to promote! ( notice I did not describe her as judge Cannon because IMO she is so far biased towards Trump she is not acting like a legitimate judge)

Donald Trump would have been convicted over 2020 election, says special counsel​

Report by Jack Smith says evidence ‘was sufficient to obtain and sustain a conviction’ had Trump not won re-election in 2024

Donald Trump would have been convicted of crimes over his failed attempt to cling to power in 2020 but for his victory in last year’s US presidential election, according to the special counsel who investigated him.

Jack Smith’s report detailing his team’s findings about Trump’s efforts to subvert democracy was released by the justice department early on Tuesday.

After the insurrection at the US Capitol on 6 January 2021, Smith was appointed as special counsel to investigate Trump’s efforts to overturn the 2020 election. His investigation culminated in a detailed report submitted to the attorney general, Merrick Garland.

In it, Smith asserts that he believes the evidence would have been sufficient to convict Trump in a trial if his success in the 2024 election had not made it impossible for the prosecution to continue.
