To me, that is flawed thinking. SS abused Maddie in MANY episodes and for years prior to the "capital episode". His treatment of her should most definitely be considered during the murder trial -- imoo. SS, it's time you just faced up to being the horror that you actually are.

Now, perhaps the defense will argue that unless the capital episode occurred, the other episodes that resulted in a conviction prior to the murder trial would perhaps never have been known about.

Still that is on SS and a direct result of his own actions. Actions have consequences. Consequence him!
I agree, and I dont want to say too much because I'm not sure I understand this whole process myself with these motions. I am guessing that they're anticipating a conviction on the SA charges, and that conviction will become an aggravating circumstance in the murder trial., and the state has said they will pursue the death penalty if there is a conviction in the murder? , and then I believe ( the jury gets to decide if he gets the death penalty and that's where the victim impact evidence might be a concern? Nothing else makes sense as to why they'd want to eliminate victim impact evidence if the Jury has nothing to do with sentencing. IDK?? , I'm waiting for a lawyer to give some insight, because this (strategy) is way over my head.

no doubt. And it's just the defense doing its duty. From what we've heard and seen, there was only one person driving her around and moving her from the car to the trunk, then fixing a flat. Videos of just one adult. Plus, his phone . . . how reasonable can the doubt possibly be?

There were at least 2 other adults in the house, maybe 3. I don't recall if there was 1 or 2 roommates there at that time. I just know there was 1 for sure as she heard things going on in that room that night. She also saw tools on the kitchen table, and saw SS doing laundry for the first time in his life. Which led me to think... I hope he gets laundry duty in prison. LOL

not very reasonable ( IMO)
but maybe these lawyers have found another way to make it look like there was another person who had a part, in something??, and use it as a mitigating circumstance. I don't know , some lawyers are pretty smart. I just watched the netflix special on OJ, and how those lawyers were able to completely spin that whole trial.

This evidence is great for the videos and the disposal of her body. I'm hoping there will be more evidence on who murdered her.

Yes, there were other adults in the home but one of them sent her daughter upstairs to sleep with an adult man so she could sleep better.

yes, who went into her room in the morning to " put the dog on a leash" and woke her up anyway.
Thats weird to me, if she told him " I needed some good sleep" and she sounded desperate when she explained that part to the cops. why on earth would he go into her room and put the dog on her bed to leash it??
wasn't the point of him driving maddi to school was so she could get more sleep? even tho she had a 10:15 blood appt? so what extra sleep would she get? an extra hour? big deal.

IMO he came up with a lie "I was going to take the dog out" ONLY because she woke up when he was in her bedroom. It's also my belief that wherever he was in her room it was past the bathroom that he uses, so he couldn't very well say "I came in to use the bathroom". She woulda been... "Then why did you walk past the bathroom???"

Which leads to the question... just what was he doing in her room when her daughter was slumped dead in the car outside? Cuz it was something, and VERY important to him IMO, or he wouldn't have risked it.

And it begs another question.... did he walk the dog without being asked (Doubt it!) about as often as he washed clothes that the roommate made a comment about?

Pg 36:

"REDACTED stated she saw Stephan in the residence at that time. REDACTED said Stephan was acting odd and going upstairs and downstairs, and in and out of the apartment that morning. Stephan was also washing clothes, which she has never seen him do.

but that exact phrase is in the police reports also. just so many to go though to find where it is. eventually, I will but My point was: who shut off her alarm? and at what time? Could "removed from notifications" just mean someone hit snooze? because that would be a whole different story,

In that interview where they gave her derivative immunity, the interviewer asked her many questions about whether or not she got out of bed when he went into the room. She said no, many times, she didn't want to do laundry, Stephan said ' don't get up go back to bed ,I got this" or something like that, and in one of those .pdf's, it talks about a phone being taken off the holder around that time and it says more but I will find that pdf before I put out misinformation. when I find it I will post it.

Who knows early in the morning, after waking up accidentally, that there is to do laundry at all and that it seems important, to do it immediately? Sleepy JS would have known?? How come? - If JS knew about laundry, she also knew exactly, what the reason was for that important laundry, which had to work on in a hurry: it had to be dirty bed linen, what else, and it had to disappear into the washing machine asap. Probably the laundry would have had done during the night already, if there weren't the roommates, who would have wondered about it or would have felt disturbed in their night's rest.

her issue was that the dog pee's when he gets excited, so when stephan came in the room, and was "leashing the dog" on the bed, she was worried the dog would pee on the bed and then she would have to do laundry. She was startled, she said she woke up or sat up to help him and he told her to lay dow, go back to sleep or whatever.
When that interviewer asked her something around her thoughts at that time, did Maddi come and say goodbye, does she usually come and say goodbye? Was she worried or concerned and she said no, her main worry was that the dog didn't pee on the bed. IOW: You should assume she has no knowledge of maddi/her condition.(allegedly)

I don't believe that dog ever went for a walk, so what was Stephan doing there in the bedroom? Causing a ruckus when she needed desperately to sleep? Was he shutting off her alarm? Was he looking for Maddi's shoes?
About those Crocs, she likely didn't wear those Crocs to her birthday party, so its not as fishy to me that one was in jenn's room, ( as if something happened in jenns room,) she could have worn them the day's before and left them in Jenns room? scattered amongst the other scattered things, but he only found one I guess. Then he dumps it all, along with her backpack in the complex dumpster and then tells the cops he sees her rifling through her backpack when he dropped her off !!!, He tells them he thought she may have been looking for earbuds even though he just told them she left her phone at home. He forgot about the part where he returned home after already getting to the school until asked, and then he explains they had "time to kill" because maddi " 86'd" the Mcdonald's idea, so they returned home again to get the "clicker" but he never thought to pick up her phone.
He gets the gold medal for being the dumbest criminal.

I can't find any mention of JS saying she didn't want to do the laundry (if the dog peed on her bed, or for any other reason) after looking at several different docs. Here is what I found about SS waking JS up when he went in to her bedroom to "walk the dog". *eyeroll* at that lie.

Pg 56: JS stated she was woke up the next morning by Stephan attempting to put a leash on their dog. Stephan told JS to go back to bed because he would take care of walking the dog. So, JS went back to sleep.

Pg 72: JS states she does not have any further communication with Stephan or Madeline after the last text from Stephan stating Madeline has built her nest. The next time JS sees Stephan is when he is trying to put the leash on their dog in the morning time of 02/26/2024. JS states she does not use her phone or gets up during the night because she was sleeping the entire night. JS confirmed that she only got up out of bed when Stephan was trying to put the leash on the dog, but Stephan told her to go back to bed, so she laid back down and went to sleep.


Lastly... Pg 32 of 896: I asked JS what time she had woken up on February 26, 2024, to which she stated she believed sometime between 0800 and 0815 hours because Stephan had gone into the room to put the leash on the dog. JS got up to assist Stephan with placing the leash on the dog because she did not want him to pee on the bed.

Pg 67: Madeline`s phone was plugged in to charge on 02/25/2024 at 2338 hours. Madeline`s phone is unplugged from the charger on 02/26/2024 at 0704 hours. The phone is then powered off at 0716 hours. This pattern of Madeline`s cellular phone use is not typical of her normal day. Which shows this activity was not physically done by Madeline. On 02/26/2024, at 1055 hours, is the next time Madeline`s cellular phone is turned back on, which coincides with the 8 steps it moved at the same time. Stephan and REDACTED would have been the only people in the house at that time, and per REDACTED’s statement, she was inside of her bedroom during this time and only seen Stephan while he was doing laundry

I could not find anything from multiple sources about JS not wanting to do laundry. Not that it can't still be out there somewhere and I just don't have access to it to search. All I remember, and am able to get my hands on, is a roommate stating that SS was doing laundry Monday morning, something he NEVER does.

I think he went in to JS's room to get MS's phone, made up the dog story when JS woke up. I wonder why he didn't throw it away too.

Ive brought this up before but cautiously. because it says notifications were removed ( which means what exactly?) and that it was consistent with her daily activities, how can that be consistent to get up at 9:19 if she was driving maddi to school everyday? and had to be there by 8:30? Maybe its just the report writing?? not super clear.
