An earlier charge of DS from Spring 1990 which would most likely be the year after he graduated high school is Trespass School Grounds, Refuse to Leave.

I wonder why there is no mention of a 21-year-old's name in the newspaper articles. It seems like someone was protecting/covering for him back then, also.

Did anyone see the interview with the brother of the Wet-n-Wild life guard on the 11 o'clock news? I was flipping channels, don't remember which it was on...

The reporter is Tony Pipitone.

His 11:00p report hasn't been posted online yet but here is the link to the Click Orlando site for anyone who wants to keep checking. I imagine it will be posted soon after it airs.

Trying to find th link- I think it was Channel 6 Orlando but I'm not finding it posted yet. They also said he has hired an attorney and that the attorney will be making a public statement tomorrow.

I'll keep looking here...

Wouldn't a 21 year old already be out of high school?

Hopefully, but they still all hang out together. They were not at school activities, they were partying then going to town to look for people to beat up.

Once a 'crew' starts hanging out it doesn't matter.

If you search the Case Numbers of the two Co Defendants on this you can clearly see that one of them is the 16yr old charged with murder and the other is another person born in 1972, close in age to DS and also charged with aggravated battery. So it is definitely the right case.

NICE. If you look up the related case 1992-CF-006085-A-O , its Muradanes, Phillip Leo, 2nd degree murder aggravated battery, so that confirms Dale was charged and convicted in this assault of Tileston and Diamond.

Definitely ties DS to this case. Nice.

That has been my problem all night long with referencing the others as "teens and youths" when one is an adult! :crazy:

I know I gave truthsleuth a headache over the term "youths". :blowkiss:

I looked up Phillip Leo Muradanes' case in the Orange County Clerk of Records site, and BINGO!, listed with his documents is this:



So, of course, I checked to see who the co-defendants were.

Case 1992-CF-00685-B-O is DALE W. SMITH DOB 06/18/71.

Please feel free to look it up for yourselves. Talk about a match!

This is the only thing bugging me too. Still, I am a paralegal and know that the case #'s, Defendant #'s and names, DOB and date of crime are enough to prove to me that this is indeed the same person.

I don't work much in criminal law anymore and am not familiar with FL statutes on this kind of thing BUT...what I suspect here is this -

DS was technically 20 at the time of the crime - still of age and considered an adult. However, when you have a gang type attack with several defendants like this, it is common to plea many of them down. In other words, I am thinking there was some deal struck to treat him as a minor, instead of trying him as an adult. If that was the case, there was probably an agreement to have his record sealed....although that too might have been conditional. IOW, if he got in anymore trouble at all, all bets were off and the record would become public. There are all kind of deals that can be struck and the "conditions" are endless.

This is purely speculation on my part. Obviously I am not sure at all that is what happened, but it is the only thing that makes sense to me. It would also explain how he might have slipped through the background check re: enlisting in the Marines.

I am having a hard time pulling up the other defendants using their case numbers. I am looking to see what type of sentence they all received.

I can only pull up two others, one looks to be about 18 and another younger than 18. Neither got more than a year and it seems like they were both out before their sentences were up with 2 years probation. Anybody that is better at reading this stuff feel free to correct me.

which post? i've been trying really hard to stay within copyright limits, and only posting things I can provide links to that are public record or articles. except for when I say my opinion and try to clearly state when its that.....

so whops? again which one went poof? I have the stated residence that is in the florida DOC in cali, and I can't post anything else about it cuz it would be considered "rumor" comming from me since i'm new. and if something was poofed that i wrote, i'm probably not supposed to comment on it anyway cuz i obvi screwed up the posting rules. lool sorry.

We have absolutely no reason at all to believe he is tied to Michelle's disappearance.

I was able to get to look at them now. Interesting how they were charged differently.
