Trial was set to begin on 4/6/20 reset for 6/15/20 & cancelled due to guilty plea on 9/20/20 & now has new attorneys, plead not guilty on 1/7/21.
Trial was set to begin on 3/16/23 continued with no further dates available. Found competent to stand trial 7/23/25.

7/22/25 Update: No info yet on competency hearing which continues on 7/23/25 @ 11am. 7/23/25 Update: On Tuesday, after years of delays in the murder case, Jorge Barahona, Nubia’s adoptive father & alleged killer, was in Miami-Dade County court when he smiled at his defense attorney before a competency hearing. Jeniffer Rohrer, a psychologist, testified via Zoom before Miami-Dade County Circuit Judge Andrea Wolfson, who will have to decide if Barahona is competent for trial. Rohrer, a defense witness, testified that she had examined Barahona in August & September of 2023 & concluded that he suffered from a psychotic disorder, but she did not arrive at a specific diagnosis. Judge Wolfson, who declared Barahona incompetent for trial last year, will also have to consider three other evaluations. Lina Haji, a psychologist, is among the two experts who evaluated Barahona & believe he is competent to stand trial this time. “He has never displayed any indication that he is out of touch with reality ... Mr. Barahona has always been able to articulate & verbalize that he is charged with murder, that he is facing the death penalty,” Haji said. Miami-Dade County inmate records show corrections booked Barahona, then 53, on March 23, 2011. County court records also show that the case that County Circuit Judge David Young had presided in closed on March 23, 2011 & the charges were transferred to the case that remains open with five additional charges. County corrections records show Barahona, now 58, was a Metrowest Detention Center inmate. The 20 charges he faces: First-degree murder, eight counts of aggravated child abuse with great bodily harm, eight counts of child neglect, abuse of a corpse, attempted first-degree murder with a deadly weapon & aggravated child abuse with great bodily harm. Judge Andrea Wolfson made the determination after he was evaluated by three doctors, & two found him incompetent. Barahona was transferred from the county jail to the Treasure Coast Forensic Treatment Center, a state mental health hospital, where he has since been evaluated multiple times, including by Dr. Jennifer Rohrer, a forensic psychologist hired by his attorneys.
7/23/25 Update: Miami-Dade Circuit Judge Andrea Ricker Wolfson said Barahona can stand trial for the 2011 murder of his 10-year-old daughter, Nubia Barahona. The defendant in one of the most notorious child abuse cases in Florida history is mentally competent to stand trial. The ruling clears the way for trial proceedings to resume after years of delays. "At this point in time, it's the court's opinion that Mr. Barahona is competent to proceed & all parties should continue trial proceedings," said Miami-Dade Circuit Judge Andrea Ricker Wolfson, who made the ruling after hearing expert testimony from doctors & mental health evaluators. The latest ruling follows over a year of ongoing assessments. 7/25/25 Docket update: Order-Adjuging the defendant competent. 7/29/25 Docket updates: Sealed Order. Letter re defendant. A status hearing is scheduled for 9/19/25 @ 9am.

Plead guilty to 1st degree murder & aggravated child abuse on 3/4/20. Plea deal gives her a life prison sentence in exchange for testimony against her husband. Sentencing will be after she testifies against her husband as agreed.
Trial was set to begin vacated. 2/21/20: Defendant found competent to stand trial.
