The trial has adjourned for the day. Detective Joshua Mott will be back up on the stand first thing tomorrow to continue his testimony about the collection of forensic evidence.

Has Yessinia's family been on the witness stand yet? Might be hard to get testimony about previous fighting unless one of them witnessed it.

Hmmm....so what's the deal with this knife? They can't prove that it was used in the crime because they don't have any bodies with knife wounds to match it to. So that means the defence does not want it to be discussed or shown at all?

Ex-lover testifies about final conversation before Deltona mom disappeared

ST. AUGUSTINE — Kevin Dredden testified on Thursday that the last time he talked to his lover, Yessenia Suarez, she sounded stressed and her speech was slurred.

Dredden, who had an affair with Suarez, testified he last heard from Suarez when the phone call ended at 1:03 a.m. on Oct. 23, 2013. The mother and her two children, Michael Otto and Thalia Otto have not been seen or heard from since.

Dredden testified he got a text from Suarez’s phone about six hours later at 7:02 a.m.

But by then the mother and her two children were dead, according to investigators. Her husband, Luis Toledo, is accused of killing them.

Dredden said that Toledo seemed ready to fight him.

“Tell me the truth or I’m going to smack the (expletive) out of you,” Dredden said Toledo told him.

Dredden said he did not want to get into a fight with Toledo so he went into the office.

But Toledo soon followed and went through the building yelling that his wife was having an affair. Dredden said someone called police and that’s when Toledo left.

Dredden testified that later that night he received texts from Suarez’s phone in which the person texting referred to his wife by the wrong name and the messages did not seem like they were written by Suarez.

Prosecutors said it was Toledo sending them.

CSI Mott said it appears that the bathroom had been cleaned because the blood spots had signs of having been wiped. #luistoledo

Mott said he also found wipe marks on tile floor of bathroom and on the wall along the tub. He said roughly have the floor had been wiped

Judge Raul Zambrano ruled this morning that prosecutors will be allowed to show jurors a menacing looking knife that belongs to #luistoledo

Prosecutors say #luistoledo tossed the knife out his car when he saw a deputy parked at his house on the day he is accused of the killings

Mott said he found no evidence of Tyshawn Jackson having been recently inside Toledo's home. Toledo has blamed Jackson for the kids' deaths

Defense attorney Michael Nappi now cross examining Mott.

Nappi tells Mott you don't know when that spot of blood was placed on the wall. Mott says he doesn't.

Nappi asks if it was possible for Tyshawn Jackson to walk through #luistoledo house and leave no DNA. Mott said it was possible

Nappi asks you don't know when the shower curtain was placed in trash can. Mott says he doesn't

Nappi asking about "Blue Star" a chemical used to check for blood. Nappi says it can react to many things besides blood

Nappi asks Mott: You can't tell, if something was cleaned , when it was cleaned or who cleaned it. Mott agrees

Nappi asks Mott to read from the preface in his report in which he states his judgement something is blood is based on training, experience

Mott wrote it was not based on a scientific test that it was blood

Nappi now cross examining Dewees who said they tried to take photo of chemical reacting to cleaner but it didn't come out #luistoledo

Dewees said chemical reaction to cleaner is like a "flash" does not last long, hard to photograph

Now on stand Volusia Sheriff's Deputy Cristal Bustamante, who was a fingerprint tech, at time of the murders,

Bustamante said of 17 prints of value or elimination, none were related to Tyshawn Jackson, Chris Lasanta or Yessenia Suarez #luistoledo

Mott asked Parker if he could help in the Toledo case. Parker said he would ,went to home in 2015, evidence tapes, blood stains still there

If blood stain is circular blood impacted the surface at a 90 degree angle, Parker said

For oval stains the tail points in the direction of travel, Parker said

I've been concerned about the witnesses and the jurors in this trial considering LT's connection to the LK gang. It appears that his brother is also concerned...well for his own safety at least and that of his family.

Man says he fears for family's safety if he testifies in triple-murder trial of Luis Toledo

St. AUGUSTINE — The brother of a former gang leader accused of killing his wife and her two children told a judge he did not want to testify against the Latin King because he feared for the safety of his children.

Chris Lasanta was brought in shackles to face Circuit Judge Raul Zambrano late Tuesday after jury selection finished for the day at the Richard O. Watson Judicial Center in St. Augustine in the trial against his brother, Luis Toledo. Lasanta turned himself in on Tuesday after Zambrano issued a warrant for his arrest for ignoring a subpoena from prosecutors.

Lasanta, 38, said he didn't want any part of the trial and feared for his three children.

“He's accused of killing two kids and a mother,” Lasanta said of Toledo, “and they still haven't found the bodies and you want me to come and put my face all over the news and my family in danger.”

Toledo, who at one point was the third-ranked Latin King in the state, was not in the courtroom when Lasanta was brought in, but Toledo's three attorneys were.

Zambrano warned Lasanta that if he did not agree to return to court to testify, he would be held in jail until it was his turn on the witness stand, which is expected to be next week.

Lasanta relented and said keeping him in jail would mess up his life and the good job he has as a plumber. He agreed to return at 9 a.m. on Monday.

But he had one more thing to say.

“I'm just letting you guys know,” Lasanta said, “if something happens to my children, it's on your heads.”
