I appreciate your logic and excellent recap of the current situation. I even tentatively agree with your general conclusion. My only worry is how many elephants can we fit into that Orange County Courtroom? Will they have to build a larger one or are they going to stack them on the railings, hang them on the walls and suspend them from the ceiling? Oh my, I wish I could share the picture in my mind . . . and to think I can't even stand one single elephant in the room with me here at home. :eek:

I agree with your comment "elephants in the courtroom" but what drives me nuts is that according to how the legal profession polices itself, there aren't any elephants in the courtroom - yet. And this particular elephant with all it's smelly droppings more than likely will not make it in to this courtroom.

I can see the herd in the courtroom, you can see it, but the legal rules for lawyers conduct says - nope - none here - perhaps one very far out there on the horizon - but nothing has made it in the door.

Makes me crazy! Which is why I do the big happy dance every time HHJP utters or pens the words "denied".

I'm thinking something crazy. And the video of no comment has me thinking this, with the secret little smirks and smiles between CM and JB. What if the complaint, which can be filed by anyone, was filed so later on, after ICA is ICA on DR, the attorneys can appeal stating that the impending investigation took their attention away from their client.
I know, crazy, huh?

I agree we have seen lots of things that Baez has pulled that have disgusted us and have us questioning his ability, but we are talking about what the court, HHJP, and the Bar consider legal.

AZ and others have said over and over again that sleazy behavior does not reach the bar of being removed from a case as long as ICA repeats she is satisfied with her representation.

It is my understanding that it is only this event that will be considered by the legal community as questionable. So if there are any appeals, while I will bow to more experienced opinions, it would only be this particular piece of "evidence" that would be appealable - although it will probably never see the light of day in a court room at ICA's trial.

So I don't think it warrants removing Baez from the case, but as Bill S. says, the bar for Baez will be a lot higher when he is submitting anything at all to the court, than it has been in the past. I think HHJP will have Baez in a lock-step, however I'm assuming the offender is considered innocent until proven guilty - even and especially by the Bar.

So far, we have rumors, a document of a depo, and a lot of assumptions. Not enough to pull Baez. And Baez can't step down even if he wanted to. Rock - meet hard place. :loser:

While I agree with you that JB will not be removed from because it may adversely affect the case, I do believe he will be sanctioned in some way after the trial is over. Even this publicity could have a very negative impact on his clients case and that's not good.

However, it is time for him to step aside an let CM take over, not only is he DP qualified but he is much more respected than JB (although the bloom is off that particular rose also).


JB days as a lawyer are limited IMO, for whom the bell tolls Mr.Baez...

I just had a very random thought.......

While reading LB's second deposition, could the reason JB is being investigated/complaint filed be because the defense was made aware through it's investigators that LB's original signed statement from 10/2009 was impeached by her walk though with MS & AL? In their pleadings, and all the refiled TES motions after May 10, 2010, the defense continued to stick with LB searched the exact spot when they knew this was not true?

To me it seem like a misrepresentation of material fact. Just my opinion.

I look at JB as more of a mascot for the defense. He likes to dance around, taunt the opposition, and ends up laying on his back, screaming and kicking, when the game doesn't go his teams way.

I don't see how Casey could win an appeal with the ineffective counsel argument?

I just pictured him in a giant chicken suit, on his back on the ground, flailing around! :rolling: Thx for the laugh!!

BBM-I dunno, CM is actually starting to look like a "normal" defense attorney at this juncture! I might be starting to (shudder) like him, at least in contrast...

Gagging at the thought...in lieu of disbarment, his license can be suspended for a period of years, and I am wondering whether that suspension can be put on hold until after the trial, whereas it seems disbarment would have to be a kinda on-the-spot thing, once the determination is made.

I told you it was crazy. The complaint would have to be something that could not be proven or a false complaint.

That was recently retired Judge O.H Eaton Jr. from the 18th Judicial Circuit Court in Seminole County (Sanford, Florida)

I don't know why anything should be delayed until after ICA's trial- if he needs to be disbarred do it now. I find that akin to letting an unethical/incompetent Surgeon go ahead and do a life-risking operation before you pull his license, because you don't want to disrupt things....:banghead: If he's not fit to be in the profession kick him out before he costs someone their life.

That is brilliant Nums. That depo is a gold mine. For Andrea Lyon to have been on that walkabout....no way in the world the defense lawyers can hang Mort out as the sacrificial lamb and claim they worked off of his assertions only. There is no plausable deniablity.
I always think I have heard it all, but that Andrea, God bless her, in her Hush Puppies was out there in the woods would have been something I never could have guessed. :floorlaugh:

That is what we learned in the depo, Laura, her lawyer, Mort and Andrea went out to the woods to retrace her steps, literally.
That Laura's lawyer was with them matters. So he is a witness to the fact that never ever did Laura walk them by the magic spot. We know this because AFTER Laura and the Scooby Doo crew retraced her steps, her lawyer asks Mort and Andrea...ok so just where out in theses woods was the baby found?
The need for that question does not arise if you had came upon the magic spot on Laura's path. No two inferences can be drawn from that. I guess now we will wind up having to have him deposed, too, just like Joe Jordan's lawyer.

Jose asked Laura if she was aware that he, Cheney and Cindy had received investigative subpoenas due to this investigation. I hope Mort and Andrea sure got ones too. You just can't make this stuff up!!!
