Gagging at the thought...in lieu of disbarment, his license can be suspended for a period of years, and I am wondering whether that suspension can be put on hold until after the trial, whereas it seems disbarment would have to be a kinda on-the-spot thing, once the determination is made.
You will notice that JB would not be the first of KC's attorneys to be disbarred or removed from practice during the course of the case. Todd M was disbarred and it did not slow things by so much as a day.
I almost think it would be better for all concerned to deal with JB before trial. Ineffective Council really does not become an issue until trial. She has at least two rock solid DP qualified attorneys who should already be fully up to speed. At least on all of the legal and ethical proceedings in her case. JB really is the lowest ranked most inexperienced lawyer on her team. Eliminating him before trial may delay things a very short period. Probably less than 30 days. Keeping him in there raises more appeal issues that it solves.
One would hope that at this point JB and CM are truly considering going and having a long meeting with KC, where they politely ask her to please dismiss JB from her employ. he is doing more harm to the client and the case than any possible good. This is her life on the line. It's time for him to fall on his sword and let the big kids take over.
