--Continuation of the direct exam from yesterday.
--Daniel met Travis two years prior to his mission from 2004-2006 when he went to Canada. Daniel met Travis a couple of years before the mission and then after he returned from the mission.
--Daniel lived with Travis for 3-4 months after returning from the mission in Canada.
--Nurmi is reviewing Daniel's mission work with the church & has been involved with a baptism in the church.
--Baptism is done at the end of a process which includes giving up drinking, smoking, etc. to have to prove to the church that they are worthy. Justify to the world that you have changed.
--Baptismal ceremony includes talks, the missionaries and friends will have short speeches about what it means. The person being baptised is held by the arm, the person baptised is immersed in waist deep water.
--How would one be qualified to baptize a person? You would have to be an elder in the church and hold the proper priesthood, if you are a worthy then you can
--Two priesthoods, lesser and greater. If you are an elder you can baptise and give the holy ghost.
--Travis was an elder in the church.
--To be one you would have to live in accordance to Morman principles such as the vow of chastity.
--Jodi was baptised before Daniel met her.
--Daniel is asked if he had any reason to believe that Travis was not living up to the principals of the church.

--Re: trip to Grand Canyon/Sedona, Daniel doesn't remember any tension between Jodi and Travis on the trip. When they stopped in Sedona to eat, Travis made a joking comment to the waitress about him and Jodi not dating. Daniel thought this was flirtatious towards the waitress. Daniel couldn't tell if Jodi was upset but she wasn't sure how to take the comment.
--Re: Trip to Grand Canyon, it was after the trip to Havisupi (september?), Daniel believes it to be a day trip, no need for sleeping arrangements.
--Re: Grand Canyon trip, Daniel was not of the understanding that Travis was also dating Lisa Andrews.
--Reiterated there was no tention between Travis and Jodi.
--Daniel became aware of Travis and Jodi no longer dating, Travis would have UFC fight nights at his house and Jodi was not there. There were two groups of friends that did not mix.
--Daniel was aware of Travis and Jodi still spending time together, he heard about them spending time together, he knew there was tension and Daniel saw them seperately.
--Travis told Daniel they had not officially split up but Travis was going to talk to her and then she moved back to California.

--Did Daniel ever have any concerns that Jodi's interest in the Mormon church or her Baptism was disingenuous?

JA admitted to killing TA. She has several options open to her given this admission.
1) She did it but was insane when she did it.
2) She did it but was justified in the killing based on self defense. Self defense is an affirmative defense and the burden of proof ( I think) shifts to the defense to prove it with “reasonable certainty”. There is substantial case law governing this defense. I believe it is insufficient merely to claim that “I thought he was going to kill me”. There must be more than mere perception of a threat. There must be evidence that the victim was indeed menacing ie had a weapon and was going to use it (not just a feint or bluster) and was most certainly going to kill JA. JA case would be bolstered if TA had some type of weapon and had indeed struck JA with the weapon. Baring this JA cannot just say TA was angry and was swearing at me and remonstrating. TA must be seen as attacking JA in a way that would have been lethal had she not exercised self-defense. It does no good for JA to attack first and then claim she was defending herself from the reaction to the first mover. Also it is insufficient to say “TA hit me or grabbed me in a tight grip”. It might be exonerating if TA had begun choking her in a way that would have rendered her unconscious had she NOT freed herself from this lethal embrace and then launched her own counter attack. In this instance, TA was nude hence the only thing he could have done, excepting the chance of grabbing a blunt instrument and bludgeoning her, is to grab JA around the neck and attempt to throttle her into unconsciousness. Strangulation can be viewed as “attempted murder”. Bruises on the arms or face do not necessarily translate as “attempted murder”.
3) Typically in a self-defense excuse the defendant has a duty to escape or at least attempt to escape a violent confrontation. In most states, you can stand your ground if the assault occurs in home. In that setting TA could have killed JA had he remained alive and consequently TA could have been completely excused BECAUSE and on the sole basis that JA, assailant, initiated a potential lethal assault. TA even tried to flee the assailant JA. For example TA could have wrested the knife away from JA as he was being attacked and then proceed to kill her. This would have been an entirely justified homicide – no questions asked. JA on the other hand had the duty to attempt to escape TA’s menacing lunge towards her.
4) IMAGINED SELF DEFENSE SCENARIO OF TA VS JA
On its face, the imagined situation – JA’s story of TA’s abrupt turn towards murderous anger - favors a successful avoidance of a murder. First, imagine how self-defense might have REALLY PLAYED OUT in TA's bathroom in June 2008. Here, JA was dressed and standing guard at the edge of the shower stall. TA would have had to lunge with such alacrity and such precision OUT OF THE WET SHOWER STALL so as to attain a death grip on JA’s neck. In this case JA should have been utterly surprised and her “flight response” must have become delayed. In any case, the desired outcome of such a struggle is that JA engaged in an unexpected struggle, she squirms out of TA’s death grip and then in turn quickly flees the scene. In this sequence JA should have been able to show bruising around her arms and especially neck. However, JA’s “problem” in this scenario is her immediate access to TWO different lethal weapons. JA was surprised by TA’s turn to outrage and his unanticipated lunge towards her. TA, as the assailant, MUST HAVE HAD first mover advantage and the element of surprise. YET, JA managed to 1) obtain a gun 2) obtain a knife AND THEN 3) effectively use these two weapons in her response to TA’s surprise attack 4) AND THEN inflict over 2 dozen knife wounds PLUS a gunshot to the head.

To explain this overkill taking place during TA’s defensive behavior almost requires a flight of fancy and the invocation of a sequence that one might see in the movie “The Terminator”. Here, JA engaged in a colossal violent altercation manages to “miraculously” grab a knife and/ or gun in such a way as to turn the tables thus consequently blunting TA’s attack. JA manages to finally land an injurious blow to TA in such a way that TA’s strength and rage are neutralized. JA must then claim that TA – despite slowing down and bleeding from either chest, head, or back wounds – WAS STILL ALIVE AND ON THE ATTACK. IN ADDITION, at this juncture THERE STILL WAS NO ESCAPE FROM TA’s BATHROOM OR BEDROOM. Bleeding, TA relentlessly advanced toward JA. JA, in utter panic, launched her wild maneuvers with the knife. Adrenalin surged through her terror stricken heart. Finally with superhuman strength JA landed a knife slash to TA’s neck . This blow led to fairly quick exsanguination and an end to the imminent threat of death to JA

EXPLANATION OF POST MORTUM BEHAVIOR
After this murderous confrontation between TA and JA, JA was standing beside a bloody corpse. She was IN SHOCK and overwhelmed with panic. After realizing that she had survived and that she was standing witness to a grisly blood spattered crime scene she vaguely thought that no authority or third party listener would believe such an extraordinary event. JA’s mental apparatus then switched to “flee” mode. Still filled with terror, she dragged the corpse to the shower to clean her former “beloved”. She wanted to quickly distance herself from this grotesque encounter as if to deny its actuality. From the early clean up, crime scene staging, the camera photo deletion, and disrobing from her blood soaked pants and shirt to the point of speeding north to SLC, JA was in a kind of automatic fugue state. She managed to psychologically dis-associate herself with the person who had to kill the beloved TA. This explains her blithe voice mail to TA at 11:30PM and her seeming indifference with the new male suitor in SLC.

EXPLANATION OF ACCESS TO GUN AND KNIFE
JA felt she needed a gun for self-protection while making the drive from North California to Pasadena then to Mesa. The gun was in her purse. The knife was used in the kinky sex acts using ropes. After the imaginative sex with TA, JA dressed and put the knife in her pocket- as a convenience. Because she planned on leaving Mesa shortly, the gun was also put into her pocket so that it could be safely stored in the car after departing in the rental car.

HAIR COLOR, PIGTAILS, AND GAS CAN
JA had been told TA fantasized about sex with her in a way that JA poses as a little girl with brown hair and pigtails. JA dutifully obliges.
TA calls her and tells her to “hurry up to Mesa”. JA decides to oblige and she obtains gas cans so that she would not be delayed at a gas station.

INITIAL POLIC INTERROGATION
JA acts out as if innocent since she has dis associated herself with the act of self-defense homicide. She has blocked the TA homicide out by employing a psychological defense mechanism. She lies because she believes no one would believe that TA was abusive and had attempted to strangle her

5) JA could maintain she acted out of abrupt rage. TA and JA got into a combative heated argument when he was in the shower. TA knocked the camera down and became enraged. Out of anger JA shot and slashed him. This sequence speaks to “heat of the moment” crime and might be viewed as manslaughter or second degree murder.

Defence Case-in-chief
Day 3

DANIEL FREEMAN, JANUARY 31, PART 2

--Daniel began to hang out with Jodi without Travis. It was when he was living back at home with his parents, his brother and one of his sisters. Jodi also had relationships with the other members of the family. She came by for dinner and helped a foster sister with her photography homework.
--Daniel discussed spirituality with Jodi.
--Daniel does not have any reason to believe that Jodi's conversion wasn't genuine.
--Daniel did not have a romantic interest in Jodi. To him she became a sister in his family.
--After Jodi moved to California they would talk on occasion they would talk when she came into town. Sometimes Jodi would stop by the house.
--Daniel contacted Jodi after Travis was murdered.
--One of Daniel's friend's went to the house and told him and he called Jodi.
--When Daniel spoke to her over the phone he didn't know what to say, he told her that Travis had been found, the other end was silent, Jodi became emotional and started to cry on the phone, after two minutes he hung up so she could be with herself.

CROSS EXAMINATION
--re: spirituality/baptism. Daniel wasn't present so he wouldn't know her motivation to be baptised. One of the things people give up is sex and Daniel didn't know that Jodi was having oral sex at the time of her baptism.
--Hyatt called Jodi around 2300 hours the night Travis was found. Daniel told her that "Travis was gone" and then there was a moment of silence and then Jodi started to cry and mumble "oh my goodness". Jodi sounded disbelieving. Jodi did not confide that she had killed Travis. Daniel gave Jodi the opportunity on the phone to talk but she did not say she killed Travis.
--re: Travis having a talk with Jodi. Travis said that he was going to have the talk with her about breaking up.
--re: Trip to Havisupi, did not start very well. Daniel looked in the backpack that was full of Jodi's things. He went through the backpack and started taking things out. Travis was present and so was sister Freeman. Daniel went through the backpack to lighten the load. Jodi came down from upstairs and saw the items that had been taken out and she got upset. No other reason for Jodi to be upset other than the backpack items. The items taken out were lotion, makeup, hand sanitizer, hair things, 10-15 lbs of different things. Travis made a sarcastic comment, then Jodi said something back, became emotional and she went upstairs and then Travis went upstairs. Daniel could hear them talking and then he went upstairs after about twenty minutes. Neither of them were happy. This all started because Daniel had went through the backpack. They then all went on their trip. Travis was driving, Jodi was in the passenger seat. After some time the tension in the car faded.
--re: photos in Havisupi or Grand Canyon, Daniel remebers "a squawk" that had something to do with taking pictures.
--re: Havisupi trip. Everybody had a hammok and a sleeping bag. The first day when they went to go swimming in the waterfall, Travis and Jodi were talking and Daniel could tell that they were having a disagreement. Daniel and his sister took off and swam somewhere else.
--Travis put the trip to Havisupi together. Daniel didn't have anybody to go with so he asked his sister to go. Travis didn't want to be alone with Jodi on the trip. Travis liked it when Daniel or his sister was there because it wasn't as physical. Martinez is reminding Daniel about earlier converstations years ago where Daniel said that Travis asked him to be there in a chaperone role.
--Travis is 5'8" and Daniel is 6'2". Travis was fit, always working out. Jodi is slightly taller than Travis.

--re: being a "chaperone" on the trip. How does the church view two people who aren't married travelling together? Officially it's frowned upon but as long as they aren't sleeping in the same room it is okay. If there are other people there it wouldn't be suspicious.

Somebody in the position of being an elder would not lose their status of an elder in the church they would go to a disciplinary council who would decide if they would be kicked out of the church or they would be given a probationary period. Probation means they cannot give prayers or take the sacrement. Sanctions can include excommunication.
--re: knowing if Jodi and Travis were boyfriend/girlfriend. Daniel heard from people that Jodi was stalking Travis but he never thought it. Jodi would talk to Daniel's mother about their relationship.
--Daniel's impression was that Jodi loved Travis. Martinez objects.
--Daniel spent a lot of time with Jodi and Travis. She was confused about her relationship with Travis. The defence is trying to get an answer from Daniel that Jodi loved Travis.
