The way the state structured their closing, it almost felt like they shifted the burden to defense. I think defense boxed themselves in with this stillbirth theory and putting on a case. They should've just sat on their laurels and argued the state can not prove the baby was born alive, and left it at that. By bringing shoddy experts, useless character witnesses, and beating the drum so loudly for this stillbirth theory, they've allowed the burden to be shifted somewhat. They also made their client look desperate.
I thought Knippen's closing was effective. I thought he hit all the points. His indignation was just right.
I have no doubt the baby was born alive and she likely suffocated it. She stifled the baby's cries just like she stifled her labor pains. I am not unsympathetic towards her. Just looking at Kim's body language makes me angry on behalf of BSR. Because of her age and circumstances, I don't think she should do life for this but I think she should do time. Even if she's not found guilty on aggravated murder, I hope she's found guilty on the remainder. If she walks away from this, it'll be because of jury nullification.
