Those pages have not been up for weeks. I check. Regardless, it is heartbreaking knowing what we know now and reading back.

The page has been up since April 19 because that's when one of my comments reappeared. So yeah a few weeks.

Are the murder and arson trial plus motion to suppress still set for May 14th? Anyone know?

  • #143
Checking tonight ...
Next calendared date is still the 14th, for motion to suppress and jury trial.

I see a subpoena to appear in court was issued to Det. Wendell HC Loo by Robert Rivera on May 1. I'm thinking he was the investigator in charge?

There can always be a continuance if they have cause for one on the court date. I hope not. I have seen lesser trials be continued over and over, ones where the trial was going to cost less money though.

Thanks for your answer and your promptness, Pua.
I hope Charli's family is holding up well.

Indeed, wishing them extra strength. I imagine it's very painful yet much desired for things to move forward. It's better to get on with it than to stay in limbo. I just hope all goes as it should. I am hopeful.

Any news in Hawaii from the scheduled motion and/or trial today. I can't find anything.

  • #147
I can't find anything either, was hoping for news here.
I checked the Judiciary site just now, and the two things calendared for today still show as today, with no update on the resolution. It is normal for the update to lag a day or even two after the court appearance.
I am just surprised it is not in the news if it happened.

THanks Napili. From that link at http://www.mauinews.com/page/conten...r-recalls-Capobianco-conversation.html?nav=10

"During the conversation that lasted "not more than 10 minutes," Natividad said Capobianco "said he was the ex-boyfriend of Carly Scott and the father of the unborn baby.""It was reported to me that she gave him a ride to Keanae to take him back to his vehicle and after doing that, they both went on their way," Natividad said.
He said Capobianco reported last seeing Scott at about 5 p.m. Feb. 9, 2014.
Family members have reported last seeing Scott at about 10 p.m. that day at her sister's home in Haiku."

I think the article got one time wrong and maybe both times. Media so far and her family reported her family last saw her just before 8pm that day. Possible SC did actually tell the officer he last saw her 5pm though and later changed his story to Charli got to his house 8:30pm. That would be a reason to want that interview suppressed.....

Could be the media fudged the times in the beginning of the investigation until they identified their suspect. Best part of the article is the officer saying that he went to SC's home on the morning of the 11th just to ask if he'd seen Charli, just like the officer had done on the other four or five missing person cases. He said the interview was about 10 mins and SC said he was the baby's father. What a dick.

So the motion is continued until May 28th. Sigh.
Sounds like they only got to interview 1, at his home. Part 2 should be the police station interview on Wed. the 12th.

At least one of those times we know to be wrong. The family has clearly said she left the sisters at around 8 PM, not 10 PM. For me, that makes the other time suspect as to whether SC really said 5 PM he last saw her.

As to the police showing up uninvited and unannounced, so what? That's what they do. I've had the same experience numerous times, whenever a crime happens in the neighborhood, a car will suddenly appear with an officer at the door and a serious official demeanor requiring that I talk to him right now whether or not he just woke me up. Which has happened on multiple occasions. They don't care. They want answers. They want to know if anyone knows anything or heard or saw anything. They had good reason to think SC was an important person to ask. Just doing their job.

Thought you might like to see the court minutes from the hearing.
The whole thing lasted 22 minutes, with only 14 minutes of direct examination and no cross exam.

Hey everyone. Sorry for any confusion or inconvenience--couldn't get here before now and I was reading the morning paper but put up the link for perusal...Front page headline and photo, by the way.
Observations (fwiw):
1) Yes, clearly seems a routine missing person visit.
2) Should we assume that the article mis-reported all of the significant times? According to the article, the officer stated that C. Reported last seeing Scott at about 5PM Feb 9 -- and then reports C. telling him, at that time, that "she gave him a ride to Keanae to take him back to his vehicle and after doing that, they both went on their way" (This would blow even bigger holes in C.'s ever-morphing narrative.)
The article also explains, "family members have reported last seeing Scott at about 10pm that day at her sister's home in Haiku". This in contradiction to what the family has already reported, so it does put into question today's reporting. So for now, consider that part an error. But, if C.'s early morning statement is correctly reported, these are huge time discrepancies and risky exposure and to try to throw it out would seem like a desperation move by Defense.

I assume the times he said are what they are trying to suppress. Certainly she couldn't be at two places at once and his lie is huge evidence.
