Well, all I can say is that with this groups obvious obsession with washing stuff, they all have a great future sweating it out in the prison laundry washing sheets and prison scrubs!

The most reduced she could get was the 15 years because it's the minimum mandatory not the full sentence. She could have gotten alot more.

The Judge could have sentenced her under the Youthful Offender Statute. I checked her priors and none of her sentenced under that Statute.

According to the Florida Times-Union the Judge said that "the Youthful Offender Statute is for young people who are pressured or led astray by peers.

"That's not the case here," he said. He said the second charge was not a simple possession charge.

"What she did was engage in trafficking," he said."

But the Statute does not say anything about that.

958.04 Judicial disposition of youthful offenders.--

(1) The court may sentence as a youthful offender any person:

(a) Who is at least 18 years of age or who has been transferred for prosecution to the criminal division of the circuit court pursuant to chapter 985;

(b) Who is found guilty of or who has tendered, and the court has accepted, a plea of nolo contendere or guilty to a crime which is, under the laws of this state, a felony if such crime was committed before the defendant's 21st birthday; and

(c) Who has not previously been classified as a youthful offender under the provisions of this act; however, no person who has been found guilty of a capital or life felony may be sentenced as a youthful offender under this act.

IMO, the Judge is sending a message to that entire group because of Haleigh.

She might serve more time on drug trafficking than murder....

I've seen 12 year olds dealing drugs on street corners before. They are in possession of them, take money for them and if caught, won't give up the parent, sibling, aunt or uncle who has them doing it. It still doesn't make them the "ring leader".

IMO there are VERY few people who would trust Misty with their money or drugs for these transactions. And she seems to have to make a lot of phone calls to account for her whereabouts during them. While I don't think it will drop her charges much ( a plea deal might) it very well may implicate someone else as an accessory in a few of those charges.

A note on the YO thing- I know a young man currently involved in a capital murder case- which IMO is MUCH worse than drug trafficking. His lawyer was confident that he was going to be able to get the boy YO at 17 years old, until the boy (out on bail) got caught commiting another crime. And this young man DID have a prior record.

I do think holding them on the drug charge for information about Haleigh is abusing the justice system though. I want to see justice done for Haleigh as much as anyone else, but I just hope mixing these two cases doesn't backfire on them.

It's just like I said, they better all hope there is a deal offered and the judge chooses to accept it otherwise I'm afraid they are going away for a long time.

I think what she got was pretty fair. She was caught on tape doing the deed. She plead no contest, and probably threw herself on the mercy of the court. The judge gave her the minimum sentence. Without the tape recording of her being a total jerk, he could have possibly dropped the charges to a lesser offense. (not sure about this) She was really asking for it, in my opinion. If I lived in the area, I'd make a note of this judge's name, so I would remember to vote for him in the next election.

I am hoping that this is a wake up call honestly. I hope that someone will say okay, I'll tell you where Haleigh is and what happened for a reduced sentence. I would much rather see justice for Haleigh than see these idiots sit in jail on drug charges and Crystal never knowing what happened to her baby.

Maybe it's just me. I remember when the call was released how Hope sounded as if she didn't understand why her lawyer plead no-contest
and here we are today, she is facing 15yrs. I wonder if she will appeal and get new counsel? Yes, she may of signed documents stating she understood but what did she understand is the question? What did her attorney lead her to believe or what state of mind was she in when she was explained what no-contest meant? I agree, she should be punished for her crime. But when I see at all the monsters that kill and get 5-10yrs or the sex offenders who get a few years or probation, well it just makes me feel that our justice system is so corrupt. Not that I am defending Hope. Just saying, if they are going to give a dope head 15 yrs, they need to give killers and Sex Offenders worst sentences.


I feel the tape shows she did not understand what a plea of no contest meant for her. She may have grounds for appeal given plea of no contest was not entered into knowingly or voluntarily. If her attorney failed to inform her that her plea would result in mandatory minimum sentence of 15 years, this omission may constitute ineffective assistance of counsel. I am not familiar with FL statute, but I would check into this if I were her family. Any FL attorneys on Websleuths? Feel free to weigh in.

Please know, I feel she should be punished for her crime. But I also feel she deserves to have adequate legal representation. Was this a rookie attorney? :waitasec:

Someone may need to remind her she will most probably be experiencing long-term consequences of menopause before she is ever released.. Perhaps then she will understand more fully...JMO

Earlier, my mouse stopped working. I was completely paralyzed for a while. Anyway, I thought that Hope's earlier charges, before the trafficing charges, were for possession. Ron pleaded NOLO at least three times for his earlier charges and did not see any sentence other than time served or one day. Are these other past charges for Hope that I'm not aware of? Before the trafficing charges?

In 15 years time, they may have pay raises within the prison system, and then it may only take her 159 years.

Yes, it seems pretty clear that he was taken there to specifically witness this, not so much as a character witness. I can't think of a single other case that I have seen where a prisoner in shackles served as a character witness! They wanted him to see the results of his influence and behavior and to know how seriously these charges are going to be treated. It seems clear that if this case resulted in a 15 year sentence, that the others should expect to be getting even longer ones than that.

Or maybe he was there to volunteer to do Hope's time but changed his mind when the judge gave her 15 years. Ronald probably thought she'd get 30 days and he would be the hero by volunteering to do her time for her.

Didn't she tell her mother in their phone conversation that he had volunteered to do her time for her.:dance:

Truthfully, based upon Hope's actions on the UC tapes, I was surprised at the 15 year sentence. I was thinking 5 years at most.

I almost think if there are no arrests in Haleigh's case prior to these hearings, that LE will be happy to take whatever measure of justice they can get. But I am hopeful that we get some arrests SOON. But I am always hoping. :)

I think there's going to be quite a few guilty/no contest plea deals going down. I believe these people know that if they tell the truth, about Haleigh, it will only serve to increase their sentences, not lessen them.
