Question for those familiar - in this situation would they assign a public defender based on proximity, or is the whole state fair game? I imagine this will be a very long trial prep and trial process, would be unfortunate for a PD team from far away to have to stay in hotels that whole time.

Well, they can't take someone off another death penalty case if the case is highly active (approaching or in trial). So I'd think "availability" and "willingness" would be two main factors.

It does happen that attorneys in this situation rent homes or apartments in the venue. If the person is from Boise (largest number of available attorneys there), it's about 5 hours away, a real inconvenience for a person with a family. If they do get two Boise attorneys, they could meet up in Boise on weekends, as well.

I am guessing that on that list of PD's who are qualified, there are several who will jump at this chance, though.

Kohberger arrived in Pennsylvania in mid-December, LaBar said. His father flew to Washington to make the drive back with his son in what LaBar said was a trip planned before the start of the school year. LaBar said father and son left Pullman sometime between Dec. 13 and Dec. 16 in an effort to beat the incoming snowstorm. “Bryan isn’t denying he was in Pullman through mid-December,” LaBar said. He also said he assumes law enforcement has his GPS data available through his mobile phone.

A man who attended DeSales University in Pennsylvania with Kohberger during their undergraduate studies recalled a tall, awkward student who often spoke over professors in a superior manner.

“He’s definitely articulate but stuck on minor details and pointing out flaws in what he professor was saying. Sometimes he made good points. There times people were like ‘can you please shut up so we can move on? It’s not really relevant,'” the former classmate recalled.

@pittsburghgirl The last thread closed before I could respond to your question about why the dad should have to provide proof of buying a plane ticket before the murders. First, I feel like you think I’m implicating his father, and I absolutely am not. I have said several times I don’t think his parents knew anything, and I feel so bad for them. I only think it’s relevant because if it was a hastily planned trip to get that car out of there after LE said they’re looking for a white Elantra, it’s just one more indication of BK’s guilt.
I don’t know who bought the ticket, but really the only way to prove it was pre planned is for the plane ticket to have been obtained before LE was looking for the car. If it was bought later, it’s really just BK telling his lawyer that. Either way, I mean this as an indication of BK’s guilt—not his father’s. I think he asked his father to come, and I don’t think his father knew anything.
All I’m saying is right now we only have BK’s word through his lawyer that they had this trip to take the car to PA at Christmas pre planned and I’m not accepting that as fact only coming from him. It may very well be the case though, and that’s fine.

So yeah, it's reported, base on more than one interview/source - and one of those sources is NOT anonymous. No one in his family has denied it. It appears to be an open secret in his home peer group.

Up to you to decide whether those news organizations are misleading the public or not. It's a pretty serious thing for them to do (well the DM doesn't care, but I'd think CNN/MSN would want accuracy).

Anyway, I think the discussion is an interesting one. The choice of heroin as a drug is fascinating.

As I believe it to true I do wonder if that has an effect on him now, or if he is on prescription medication to stay clean.

That extradition across state lines, arrested in PA on an ID warrant there is an extradition clause in United States Constitution. A person charged in any state with treason felony or other crime who shall flee from justice and be found in another state shall on demand of the executive authority of the state from which he fled be delivered up to be removed to the state having jurisdiction of the crime.

If you’re arrested in another state, and if you do not waive extradition (which you can waive it)you get sent back to their state. Then the governor executive authority of ID will issue a demand to PA to deliver the person to them at which point they can seek habeas corpus remedy and say that they are being illegally held and at that point you have to have a hearing to determine whether or not the arrest was lawful or not. This is a very low burden on the government- there are four things you have to show 1) whether extradition request documents are in order (did you mess up the documents number) 2) Whether the person has been charged with a crime in the demanding state 3) Whether the person named in the extradition request is the person charged with a crime (confirm their identity) 4) petitioner is in fact a fugitive from requesting state - are they in different state than the one which they were charged.

If all are yes, you get extradited and that is why you always waive extradition otherwise you sit in jail. Extradition will get things going.

They have had extradition cases that have taken weeks because of the administrative red tape. Hopefully there will be no delays and it is unlikely in this case because of the national attention it gets.

I wonder how much involvement Kohberger actually had with Dennis Rader (if any)... is it certain? It seems likely there were Desales instructor references/discussion... and, it's possible he became fixated on BTK.

Interestingly, IIRC, Rader didn't sexually assault any of the victims but his semen was left at the crime scenes. I've wondered if Kohberger did the same (although, considering the time frame of these murders, it would have been... uhmmm... quick. )

I felt so sad for Rader's daughter while watching that interview

For those wondering about Idaho's program for death penalty certified public defenders, there's information at this link:

It also includes a roster of those qualified in the state.

The county of the trial (Latah?) doesn't need to have their own DP certified public defender. Murder is covered by state statutes, so attorneys can probably be assigned from anywhere in the state. At least that's the way it works in OH.

Drawing from questions in the prior thread about an Idaho defense team for BK, I think it safe to say whether the death penalty is sought or not, Latah County will most likely be required to contract with a private lawyer for BK, paid for by the county.

Latah County has previously been under fire before by the ACLU after state counties were not consistent with how public defenders are provided for indigent defendants.

"We just have a variety of different systems at the counties, without necessarily sufficient support from the state when it comes to resources or even having a standard system ... to ensure they are actually delivering fair justice to those they represent," he said.

According to the lawsuit, only seven of Idaho's 44 counties have public defender's offices, two small counties share an office and one county, Washington, doesn't even have an office or a contract for indigent defense.

The other 34 counties provide indigent defense under a contract with a defense attorney or firm. Nineteen of those counties - including Latah County - operate under fixed-fee contracts, despite that practice being banned since 2014.

"Public defenders are financed by the county, and I think we have provided very exemplary service to those who need it," Latah County Commissioner Richard Walser said. "I am not at all saying that's spread over the whole state, though. There is a huge variance in what is being done."

I’ve been wondering the same thing. Heroin seems a bit extreme IMO. I have to say, I don’t know much at all about users, but I would suspect they wouldn’t ‘hold it together’ as much as BK appeared to. And because I know I will get comments on that, what I mean is, would he be able to hold down a job and study if using heroin? Even if the suggestions are past use, that’s a pretty impressive turnaround for someone addicted to arguably the hardest drug of all. MOO, could be wrong.

Edited to say thanks @10ofRods for your further comment on this. I was unaware of the reporting on it. Though I must say, if I was the family of BK, heroin use would be the last thing I would be bothered about denying. I’d be so devastated and horrified by the accusations I would my mouth unless I was shopping emotional support and sympathy for the victims.

Unprofessional of that professor to try to resolve disputed grading in this way. Why not just use the normal procedure? ( they must have one) Why make it a confrontation?
