In Idaho the prosecutor has a choice, GJ or the court. Both can be sealed so wonder what the benefit is?
Possibly secrecy—they can explore evidence without disclosing it to defense attorneys and the press, which could “contaminate” potential jurors.

When I hear “grand jury” I immediately think of the Jon Benet Ramsey case, where prosecutors went to a grand jury seemingly to have an excuse not to prosecute John and Patsy. (JMO as they refused to prosecute even though the grand jury recommended indictment—a recommendation the DA kept from the public until leaked by a grand juror years later.)

In this case, secrecy seems the more likely motive as the DA doesn’t appear to be bending over backwards to protect Lori and Chad.

I sincerely hope secrecy is the driver and not a lack of confidence that they have enough evidence to convict.

I'm not going to get too excited until I see something solid enough for Nate, Justin, and the other reliable reporters to say something.
What if they were asked by their sources not to report on it? They would have spoken up by now.

If it's being kept that confidential, I would hope they'd respect that. Leaks are so often a source of misinformation and mistakes. There's a time and a place for digging out secrets, but waiting on a grand jury doesn't seem like one of them.

East Idaho News article discussing grand juries, which were on hold for much of the last year due to COVID. Idaho just began permitting them again. No mention of the Daybell case in the article.

Interesting unlike info posted earlier on this thread, this article says if Grand Jury doesn’t indict DA can still take the case to a magistrate court for indictment. Not sure which is true.

I believe also GJs in general are prosecutor friendly, and give them the most latitude with evidence to get the ball rolling.

Grand jury is automatically sealed. Grand jury can supeona folks. Prelims cannot. Grand jury is very different rules. See above posts earlier this am.

I’m surprised the local news orgs have’t picked up this Grand Jury info yet. I hope it’s accurate.


If indeed true, it could be that someone who got a summons notified press. It could be, as stated above, that Justin and Nate will not publish now as they do not agree that this should have come to the public as grand jury trials are private.

Perhaps they have values that do not allow them to publish, and Court TV does not?

Speaking of values... even Nancy Grace :eek: and her channel has no comment either way... IYKWIM!

Scott Reisch's only commentary about it (on Twitter) was: "Nothing is official yet."

Lori Hellis made a very informative newsletter post about grand juries vs preliminary hearings. Interestingly hearsay is allowed to be used in grand jury hearings.

ETA: Isn't Nancy Grace with Fox, just like Justin Lum? Perhaps they have the same rules.

Even if a summons went out, and a person who recieved such for a special seating, where did Court TV get the information as to for Tammy... in addition to Lori and Chad for their headline. MOO, it's not like when you get a summons it tells you WHO and what the potential charges are.

Hmmmm... nothing from any other news source still.

I'm interested that Court TV, almost 24 hours later, as being the ONLY outlet and no one else has picked up on such.

Even Nancy... who picks up anything off the ground has not published. MOO

MOO, I just doubt it is one of the jurors or jury pool.
MOO If it is leak it needs to be vigorously investigated, like the Gannon Stauch leak.

It came from "multiple unnamed sources" which implies more than one leak.

In every jurisdiction I've lived in, a Grand Jury is empaneled -- called by the circuit -- for a set time period, usually 6 months.

This could be a specifically arranged Grand Jury, I didn't read the careful list of Grand Jury regs in Idaho posted up-thread. The answer is likely contained there.

I am confused. Court TV stated Tammy Daybell also. Would the Prosecutor in Madison County be involved in this same Grand Jury? How could Tammy death and autopsy be involved with Rob Wood ? Thank you

This is a Fremont County Grand Jury I believe, the county of the Daybell's residence.
MOO since Ron Wood is the Madison County prosecutor for the disappearance they have a lot in common to prosecute, but it sound complex to coordinate.
