When you bill by the hour (like hundreds per hr), then 14 days is a lot of hours. Why give your attorney the time to work up a defense when it's just costing you a lot of money? (sarcasm) Either someone saw the big picture or someone else is missing it entirely.

Chad may never be charged with Tammy's death, but it pleases me to think that all of the insurance money will be spent on LV's defense, and CD will be alone, and broke. Without family or friends. He can go visit LV in prison and go back to his job at the 7-11 night shift.

Exactly. I wonder if Lori intended to apply for some sort of documentation following her marriage, like a passport, which required her to be in ID, but when the police came they just decided to go sooner. I'm completely ignorant as to whether she could have done this from Hawaii, maybe it required longer residency or other referees?
Apply in Person

You must apply in person using Form DS-11 if at least one of the following is true:

  • You are applying for your first U.S. passport
  • You are under age 16
  • Your previous U.S. passport was issued when you were under age 16
  • Your previous U.S. passport was lost, stolen, or damaged
  • Your previous U.S. passport was issued more than 15 years ago

Slight change of topic but I am currently pondering the logic behind Lori and Chad going to Hawaii to get married, coming back and then returning to Hawaii. I know we're not going to get an answer to this but it might be interesting to pool a few theories.

What sparked this thought was Lori telling the hired nanny on Sep 24th that she was in Hawaii (a lie) and "in about a month, when they come back, that I could work again."

At that point Tammy was still alive, Lori would rent the lock-up exactly one week later, and Tammy had the masked-man encounter the following week on Oct 9th.

If we assume Tammy was meant to die on Oct 9th, the wedding could have been planned for around Oct 26th, if we use the same 2-week model that was used after her actual death. That would be closer to the month timeline that Lori gave the nanny.

Anyway, I do think it is another clue that shows premeditation of Tammy's death and a trip to Hawaii to get married. I just don't know why they would have planned to come back and go again. Maybe it was because she couldn't clear the house out until she knew Tammy had died and she had to be back to coordinate the stuff in storage?

Wow! Good theory!

I just reread BB's filing document about this and it says she left Az straight after the attempt and her whereabouts were unknown. We believe she was the possible sister in Rexburg. She and Alex must have then returned to move her stuff out leaving the kids stuff on the kerb at the beginning of November.

READ: The court documents filed by the ex-husband of Lori Daybell's niece | East Idaho News
In trying to hone in on events surrounding the attempt on BB's life, here's condensed details from Gardener's Timeline and charging docs:

Prior to the Oct. 2 shooting: MB fails to pick up kids the kids for visitation. “Basically...he hoped that I could find his wife, whom he had lost contact with for about two weeks…They were going through a divorce and they were supposed to exchange their four kids and she didn't show up for the last meeting. And then he was the target of the drive-by shooting and he thought that he recognized his assailant as being Alex Cox." Rich Robertson (RR), an AZ-based private investigator w/R3 Investigations. RR said (Inside Edition).

Oct 2: BB shot at from Jeep

From later charging documents:
MBP leaves Arizona right after the shooting attempt.

Oct 13: BB meets with RR, private investigator. See above.

22 Oct 2019 – BB and Melani’s divorce is finalized (Consent Decree); BB requested full custody of their 4 children on the grounds that he believes Melani was behind the attempt on his life in early October; He also requested Melani not see the children without supervision; Melani did not show up for court to challenge custody of the children; (Court records; Arizona Republic). Family Court Case Information - Case History.

31 Oct – Nov 1 2019 - RR, the private investigator hired by BB, observes Alex and Melani load up a U-haul outside Melani’s Chandler home and discard children's items on the curb. "It was all kids' stuff, it was clothing, it was blankets, it was toys, mattresses, bedding materials. It was all in a pile out there on the curb with a little cardboard sign on it that said, 'Free.' Melani continues to look for her children before leaving for Rexburg. RR followed Melani and AC using a GPS tracker on their vehicle as they went to friends' houses looking for the kids on the day before they left for Idaho. "It was clear to us that she was aggressively trying to find the kids, even though she left all the kids' stuff on the curb… And she was traveling with Alex Cox, so that increased the anxiety for Brandon and his kids," Said RR (Inside Edition). (Affidavit of Probable Cause Doc).RR says. RR says he tracked Melani to Rexburg, not Boise: “We saw them loading the U-Haul they rented in Arizona and took to Rexburg and we saw where they were living but we didn’t see the kids,” RR said (KTVB7 News, AZ Family, Inside Edition).

Nov 2019 – The Jeep involved in the shooting attempt on BB is located in Rexburg and seized with a search warrant from Gilbert PD. It is identified as a grey Jeep Wrangler with TX plates and as the vehicle that Tylee regularly drove and was registered to the late CV. 3 Nov 2019 –

4 Nov 2019 - Melani and AC arrive in Rexburg, ID (Inside Edition).

12 Nov 2019, around 6 pm - LE documents say Lori’s niece, Melani (MB), trespassed onto the property of her in-laws in American Fork, UT. MB came to look for her husband BB and their kids. BB's parents took all the kids upstairs and BB told MB she could not be there. A LEO called MB on the phone and she claimed BB kidnapped her kids and she hadn’t seen them in over a month. The LEO told MB she could face criminal charges for trespassing if she returned (Fox10 Phoenix).

14 Nov 2019 – Lori’s brother Alex Cox drives their niece Melani (MB) back to BB’s parents’ home in a 2020 Kia Telluride. BB’s family calls 911 to report MB is there again, ringing the doorbell, banging on the door and yelling and she was seen going into the garage. BB’s father yells “Get out of my house! The police are on their way! Get away from my door! Now!” then he tells the 911 operator “Somebody tried to kill my son three weeks ago, and we believe that she’s involved in it.” Police say they found MB coming out of the garage when they arrived on the scene. BB's family say MB brought a court order saying she could take the children. At this time, BB was in AZ. Police cited her for criminal trespassing and told her to leave the property or she would be taken into custody. Police later found cause for a domestic violence enhancement and determined MB should be arrested. MB turned herself into AFPD and was booked into Utah County Jail for the misdemeanor. She was released on $2500 bail the same day. Alex posted $1950 for MB’s bail (Arizona Republic, Utah County Sheriff's Office Booking records, Fox10 Phoenix).

27 Nov 2019 – Neighbors watch as the FBI raids 3 units at 565 Pioneer Rd in Rexburg: Lori's Apt #175, Lori’s niece Melani’s Apt #174 and Lori’s brother Alex's Apt #107 in the same complex. LE breaks the front door of AC’s apt to get inside and finds there is nothing inside except for a couple of small items in the garage. Note: A neighbor stated #174 belonged to Lori’s sister, but the affidavit reveals it was Melani’s unit (Fox 13 Salt Lake City, local News 8; Affidavit of Probable Cause Doc; East Idaho News).

30 Nov 2019, 5:23 pm – Lori’s niece, Melani, marries Ian Pawlowski (IP) at Lucky Little Chapel in Las Vegas, Clark County, NV. Melani’s Uncle Alex (Lori’s brother) was the witness for the ceremony (Clark Co Marriage Records; Fox10 Phoenix, Post Register).

What is this for? The file date is 18 Feb so it can’t be for yesterday’s motion, can it? I hope her district judge is a hard core female as well!

The video is worth checking out if you want to get a feel for the magistrate judge, and the process. It is long! I couldn't listen to all of it. The District judge in the video is male, and I wonder if he will be the District judge on this case, or will assign them, assuming there is no change of venue. Anyone know?

So, from records/MSM/court docs, we know:

Melani missed a visitation pick-up of her kids prior to BB shooting attempt on Oct. 2. Wonder why? What other things was she doing that were occupying her time?
After the shooting she left AZ right away for Rexburg;
After the shooting, BB goes into hiding with his kids; doesn't hear from MBP;
Oct. 22: Divorce from BB final, she's a no-show at custody hearing in AZ.
On Oct. 31-Nov 1 MBP goes back to AZ to clean out home where she was living; puts kids' stuff on curb. Goes looking for her kids at places in AZ with AC. (Creepy!)
Nov. 4: Arrives in Rexburg with AC.
Nov. 12: MBP shows up with AC to BB's parents' home in Utah demanding kids. Cops called.
Nov. 14: MBP shows up again with AC at BB's parent's home, cops called. MBP eventually arrested.
Nov. 30: MBP marries IP one day after AC marries ZP.

What was she going to do with kids in Rexburg when she didn't have any of their stuff?

Sure seemed like the other two blindsided him and what he was doing on the team to begin with was unclear. His specialties sure don't seem pertinent. I will say that if I was looking for someone in the areas he normally works in that based on the reviews I'd figure he'd be good as long as I was straight with him and upheld my side of the bargain. MOO.

He, or his office, is certainly not the most attentive to detail seeing as this quote is the first thing one sees when clicking on that link:
“Don't get ‘throw under the bus’ Contact us today to protect your rights!”

I believe it’s thrown. I know I’d be embarrassed if my large print slogan in red typeface had a grammatical error. Someone should tell them. MOO

Oh, right; I would assume that lawyers disagree all the time. But a disagreement that made one party want to bail out of the case completely after just a few days made me think that perhaps I was missing something here about why a difference of opinion abt that 14 day timeframe was likely to be so critical, and that maybe it was obvious to everyone else!
When Brendt Christiansen's lawyer bailed fairly early on it was thought that it was an indication of the weight of evidence, plus the cost of course. Hours of surveillance tapes and an undercover witness were just part of the complexities. Plus the fact he had privately confessed to a university psychiatrist that he had dark murderous thoughts. The public defenders office took it on and managed to save him from the DP just about. Ying Ying's remains were never found. I am wondering if this is going to be as complex, especially with the possibility of some involvement with psychiatric institutions around the time of the CV divorce proceedings. MOO.

I don’t know what they were so butt-smackingly happy about, though, if they knew AxC had just missed a million-dollar shot.

Are you sure you're a lawyer, AZlawyer? This comment made me LOL (literally), and so I'm wondering if perhaps you are actually a stand-up comic.

You may be onto something interesting, Tortoise. I can't make any sense of Lori's lies to the babysitter. I'm still stuck on wondering why she needed a babysitter at all on Thursday, Sept 19th. JJ would have been in school during the day so we can assume that the babysitter was only there after school and evening hours. What was going on that couldn't be done while JJ was in school? Why didn't Lori have anyone else who could watch him, considering she also moved to Rexburg with her brother AxC, a friend and Tylee? Tylee was missing since Sept 8th, so she couldn't watch JJ. AxC supposedly went with Lori to the airport-- why? Was AxC traveling to Mesa with Chad? Is that why he went to the airport instead of supervising JJ for Lori? We don't even know who the friend was who arrived in Rexburg with Lori, AxC and the kids on Sept 1st. I have theorized it might be ZP. If it was ZP living there too, then why couldn't she watch JJ? Was she also going somewhere Sept 19th? Melani hadn't moved to Rexburg yet so she's a no-go to watch JJ. It seems important that Lori didn't ask a neighbor or someone at her church. She chose a stranger, possibly hoping the nanny wouldn't be connected to her and would move on forgetting all about Lori and JJ. I'm trying to figure out what was going on that was so important that all of Lori's local "cult" members couldn't watch JJ on Sept 19th and she had to get a sitter for that evening. Hopefully, the FBI already knows the answers to our questions. MOO.

She lost custody of the kids by not turning up on the 22nd Oct. She then returned to clear out the house in Az on 31 Oct and leaves kids stuff on the kerb. She had lost the kids at this point. When she showed up the 2nd time at the grandparents place she said she had a "court order" but this has not been seen so we don't known the truth of that at all.

The thing that stands out to me the most here is that she didn't pick up the kids for a planned visitation right before the shooting. At the time both she and BB were living in AZ. Why???

Haha! That hilarious I looked at his site and didn’t catch that myself. Now that MM is the only attorney left I absolutely believe she will get a new criminal attorney. There is no way that she only deals with MM from here on out. She is looking at spending real time in jail and also more charges pending in my opinion.
I believe that she either lied to the other two attorneys or she wouldn’t agree to pay them what they wanted for the upcoming court hearing. She wants that cash in the bank incase someone puts up collateral for her!
No judge in his right mind would allow her to go to a criminal court and have an attorney who doesn’t do criminal law day to day.
Maybe she has already been approached by another lawyer who has offered his services pro bono. Like I have said before these high profile cases usually end up with the attorneys on the case becoming famous and on tv as lawyer pundits.
We will have to see who ends up being her real lawyer going forward.
As a judicial clerk for 20 years it’s unheard of to have a lawyer who is not a criminal attorney represent you in criminal court. MOO

I wasn't referring to the recusal, that was probably merited. I was referring to his cordial demeanor, passive behavior and decision to lower bail.
2 Children have been missing for 6 months, this woman smugly, and arrogantly celebrates life while several have dropped dead around her.
Elcox was flat out wrong in her comparison to other cases where people get low bail. How many cases like this show up nationwide, much less in Rexburg? This is rare, unique thing and there needs to be absolute maximum pressure to prove the children are alive, immediately.

I don't care who the judge is, but justice delayed is justice denied. LVD and CD should not be in a position to slap the court around.
They are proven liars and live lavishly at the expense and horrific demise of others!
They need a BULLDOG JUDGE, a BULLDOG PROSECUTOR, ROCK SOLID EVIDENCE, and go ahead hire a bunch of lawyers that will try every trick under the sun. Just be sure to freeze all of their assets based on the evidence. Ill-gotten gains should not be spent on defense. Freeze it until it's all decided. RICO, etc.

Nicely put! I wonder if the insurance company has frozen Chads bank account as of late..... maybe that’s why the lawyers have withdrawn? I doubt we would know so it could possibly be true.... I imagine with all of the media coverage they applied to freeze his bank account until at least TD’s results are in. They may never get the full amount back but at least partial is better than nothing. JMO

We are talking about rural Idaho. There are not a lot of competent criminal attorneys in rural Idaho to pick from. Most of the criminal cases are slam dunk, domestic violence, some drug stuff. And it looks like many of them don't want to touch this mess, with an uncooperative client.

Which is probably why LV wanted a change of venue to Boise. It would be easier to find and afford criminal attorneys there, who don't have to drive or fly to Rexburg at $300 an hour, that adds up quick.

So I’m catching up, haven’t been on since about 8 ish yesterday evening. My 6 year old threw up dinner (fingers crossed it was a fluke) so I’ve been snuggling. So basically after the judge passed the case to another judge, 2 of her attorneys (including pit bull in heals) walked away from the case? Anything else? I plan on reading up, just thought someone might give me a summary.
