I think you have to look at motive. Why are the children missing and why has Lori refused to simply comply with the court to show that they are alive and well? At this point, I believe the children are not alive and that is why she continues to obstruct. She can't produce them. I believe the children's disappearance has to do with Charles' death. I believe Lori wanted to be free of them and they posed a threat to her future plans. This to me, is the only reasonable explanation, because if she could produce the children, it is in her best interests to do so, and Lori's pattern is to always do what is in her best interests. MOO

I am not so sure. They stayed with her for 7 weeks after CV was killed and then moved with them to Idaho for another 3 weeks. Then Tylee had her 17th birthday and maybe they then both moved to a homeschool type prep school or even separate schools. Or even a school for JJ that Tylee could work at as she was used to dealing with JJ. That way Tylee would be working and JJ could be resident at the same school. JMO.

They must know they are not going to have a better time on Maui. It's not like Dateline didn't show there. I'd say this is likely a stepping stone and we'll hear soon that they've moved on already.

I'm glad to see them reacting to the pressure.

It must be so hard for Chad to be receiving negative publicity. In my opinion this megalomaniac must be getting desperate, and his mind will not be resting. I still think he will throw Lori under the bus and try to save his reputation. Will that happen before he is arrested for the murder of Tammy, or after, is the question.

If the kids, God bless them, are alive, I think he’d be eager to stop the press hounding them and he’d reveal where the children are. If and when they are ever arrested, she won’t show a drop of loyalty judging from her psychopath-like history. IMHO.

This is a pretty significant misrepresentation of what i posted.

1. Criminal offences are defined by actus reus - i.e the physical elements/actions of the offence

2. If you commit the acts, with requisite intent you, commit the felony - end of story. So if the kids remain hidden (let's assume), then she will commit the felony where it is her intent to deprive the state of its custodial rights.

'Due process' is not directly part of the offence I am afraid. What is of course always relevant is mens rea - i.e intent.

As I already posted, the Judge's order of itself does not trigger the felony. Rather LV will commit a felony when she first knowingly acts to deprive the state of its custodial rights. In other words, the Judge will order that LV reveal the location of the children to law enforcement so that they can be brought into the state's custody. When she fails to so reveal, she commits the felony. I already stated as much.

We should also note that in the case of State of Idaho vs Vallow our liberatarian damsel is already being afforded all due process and is no doubt represented. Indeed the case is national news. One doubts she can pretend to avoid knowledge of the outcome by refusing to speak to her lawyer

But of course, the legal system has seen every stripe of absconder down the years and was not born yesterday. Law Enforcement will arrive on her doorstep to enforce custody rights pursuant to the Court orders, no doubt with a copy in hand. That will be all the notice that LV ought to be afforded.

Let's not pretend she needs days or weeks of notice to give up the game. She only need say the word.

In my highly over valued opinion, when she does not do so, she will knowingly commit a felony offence.

What evidence does the state have that the kids are in danger, which is presumably the reason they want custody? If they are in hiding then all L will have to do is give evidence they are alive, but not necessarily evidence of where they are. She will clearly wait for the last minute possible to do this if the kids are safely hidden. If they are dead then she will fail to produce anything then be arrested. My question is how long will this take?

I agree it is one way for her to have knowledge. But the question is rather, did she have actual knowledge? So while I agree no law says she must monitor a court action in which she is most likely represented by counsel, it will be hard to pretend she doesn't know the outcome.



Again the scenario I am specifically suggesting is that local LE will arrive on the doorstep, with a copy of the Court order, and say "Mrs Vallow/Daybill, the Court of Idaho has assumed emergency custody. Here is the order and we are now here to enforce it. Please immediately advise where the children are"

At the moment she refuses to tell them, she commits a felony and she can no longer deny knowledge.

Nor does she require time to comply. She can answer immediately.

It is the action of continuing to keep the location hidden that is the actus reus. She need only say where they are. so LE can go get them. She does not need to bring them to Hawaii, not travel to where they are.

If she reads here she sure would have knowledge. Can the kids get their own attorney? I mean the custody is just for JJ right? They could even be in completely separate locations IMO.

Good point. What if she says Chad has taken them into hiding with one of his rich prepper associates and she doesn't even know where they are. Would the court go after him next?

Ever heard of "don't cut your nose to spite your face." If kids are in school or whatever, all she has to do is show proof to LE. KW and LW won't have access to kids because they are not guardians. So why exactly wouldn't she have done that? Also, she didn't need to hide Tylee to spite KW and LW.

I have a sense that he is as much psychopath as she is. The difference between them being that reputation and leadership was/is everything to Chad, meaning that he will move on to plottting against her before she thinks of plotting against him. My gut tells me he is the mastermind of the whole plan. He is not afraid of her for one thing. That is a very big thing, if you think of what he knows about her. I think she thinks she is irresistible to men so she might be taken off guard. Let's see.

Alex Cox, the brother of Lori Vallow, suddenly died on Dec. 12. Cox killed Lori Vallow's ex-husband Charles Vallow in self-defense weeks before. This is the third suspicious death surrounding Lori Vallow and the disappearance of her children. Rexburg kids Tylee Ryan, 17, and 7-year-old Joshua “JJ” Vallow have been missing since September 2019. Police say their mother, Lori Vallow Daybell, and her new husband Chad Daybell, lied to investigators about where the children are.

Thx for the 411 on the 911... but counting, I think Alex is the 5th suspicious death surrounding Lori and Alex? Not counting the kids who might add it up to 7. You have their sister, who Alex was there when she died and used her credit cards for a shopping spree while she lay there dead... her ex Joe, then Charles, then Tammy. Between Charles and Tammy, the kids went 'poof'. Oh, and there was a murder attempt on BB. Then finally, (hmmm maybe not finally) Alex croaked suspiciously. That Lori is a real black widow, sucking the life out of everyone she touches!

Been following along and I am still confused why some formal charges cannot be levied against her if she was the legal guardian of the children. I thought of a charge that sounds valid if she did not file a formal missing persons report right after they supposedly went missing. On top of that, it appears she moved away without the children not long afterwards.

The charge of "Child Abandonment" seems like it could be a valid charge if all of that is true. Im not sure of the details of what she did or did not do around the time of their disappearance but I think Child Abandonment sounds about right unless she can tell where her children are and they are safe.

Farfetched here...and obviously MOO--but one thought had occurred to me that maybe she was leaving that stuff in the storage unit to be picked up by someone to take to the kids if in hiding... I can see the over-the-top pain of keeping the dog...but all the stuff left in the storage unit was usable childrens' stuff.

Excellent point. I didn't think about beneficiaries on the account. However, I think that unlike life insurance retirement type accounts, at least in some instances, have requirements that if you're married the spouse has to be the beneficiary or approve putting someone else. This might vary depending on state or company administering the account or other factors, but if I'm not dreaming this up (I won't rule that out either) then it might not be as easy to cover himself here. He might also have viewed the million dollar policy as specifically for use to take care of JJ and that's why he changed it.

I would think that the clearer heads of L and KW would have alerted employer administration regarding any retirement accounts or such... Not sure how long Charles worked for his company...have we ever shared that data......... But, unless it was a lot of years, retirement accounts might not even amount to much. MOO
