From the Judge's order: "The instant petition has its genesis in a story unique to the anals of Criminal Court," Toomin wrote. "The principal character, Jussie Smollett, is an acclaimed actor known to the public from his performances in the television series, 'Empire.' But his talents were not destined to be confined to that production. Rather, in perhaps the most prominent display of his acting potential, Smollett conceived a fantasy that propelled him from the role of a sympathetic victim of vicious homophobic attack to that of a charlatan who fomented a hoax the equal of any twist television intrigue."

A Cook County judge on Friday ordered the surprise appointment of a special prosecutor to investigate the sudden dismissal of all charges against Jussie Smollett, saying the short-lived prosecution may have been legally invalid from the beginning.

Judge Michael Toomin ruled that State’s Attorney Kim Foxx had the right to withdraw herself from overseeing the prosecution of the onetime “Empire” actor but held no legal authority to delegate that responsibility to her top deputy.

With the deputy holding no real authority, the Smollett case made its way through the court system without a prosecutor at the helm, the veteran judge said.

“There was no master on the bridge to guide the ship as it floundered through uncharted waters, and it ultimately lost its bearings,” Toomin wrote in the 21-page opinion. “... The unprecedented irregularities identified in this case warrants the appointment of independent counsel to restore the public’s confidence in the integrity of our criminal justice system.”

The decision marked a victory for Sheila O’Brien, a former state appellate judge who sought the special prosecutor in largely a solo effort, and a political blow for Foxx, the first-term officeholder who is seeking re-election next year.

“We’ll get the truth, the whole truth, under oath, and that’s what this is about,” O’Brien told a throng of reporters in the lobby of the Leighton Criminal Court Building.

But Smollett never actually had to say it. That is the problem. The charges just went away. There was no formal admission of responsibility. Which makes the "requirement" of community service at question.
I wish I could "like" this 2X..

“Hours after State’s Attorney Kim Foxx deflected blame to her former chief ethics officer for her decision to not appoint a special prosecutor in the Jussie Smollett case, that former staffer called Foxx’s assertions lies.”

“April Perry, who served as Foxx’s chief ethics officer until May, sent an email to reporters Friday that contradicted statements Foxx made shortly after a Chicago judge slammed her handling of the Smollett case and appointed a special prosecutor Friday.”

“Foxx said she was just following “the advice and counsel of my then Chief Ethics Officer” when she opted out of ordering a special prosecutor — but Perry said the opposite to be true.”

“My advice was that First Assistant Joseph Magats seek the court’s approval and request a Special State’s Attorney appointment in this matter. I prepared a motion and order to that effect, and e-mailed it to the First Assistant on February 20. Shortly after sending that email, the First Assistant advised me that State’s Attorney Foxx determined that the motion and order should not be filed,” Perry wrote in an email.”

Records of Perry’s emails were obtained by The Post in April and back up her claims. A special prosecutor order was never filed in the case, according to court records.”

Perhaps Kim Foxx has broken a few serious rules?? Wonder if she can be disbarred for it or jail time too?

Certainly cannot/must not remain as an officer of the court, can she??

Just more of politicians electing judges to do their bidding.
I could not be in law enforcement right now. Absolutely so demoralizing.
I don't know how much more our law enforcement can take.
That's the REAL issue here.
Jessie Smollett is just another 🤬🤬🤬🤬🤬🤬🤬. Imo.
But our women and men who swore to protect us are getting beaten down by liberal policies.
The REAL issue, I repeat. Is trusting our defenders against the jerks.
Many of our politicians have turned the good against the bad ideals, on their heads.

I think most people know he was lying, and these released records will show that.

But the charges were already dropped and he is not going to be charged with anything else, most likely.

Even the phoney threatening letters---those were probably mailed by the brothers at Jussie's request. So he won't be charged with that either. JMO

Foxx is just a flat out liar. There should be body parts scattered about the streets from all of the buses rolling over people.

This case is amazing, it is like a roller coaster. Up, down, curves, loops, screeching brakes, backwards, into a tunnel...totally loving this!

And Kim Foxx! Just additional embellishment. They just need to add a mud wrestling pit in the courtroom. Foxx and her ethics officer could duke it out.

I know! When I posted that article re Foxx’s ex-ethics officer ‘blasting’ her, I was trying to remember the lies she has told regarding this case (so far and that we are aware of). She needs to go now. And ‘The Artist’ needs to be re-charged.
