I haven’t looked at the sentencing guidelines for his offenses. Apparently you have. You should have bolded the part of my post you are debating.

The point of my post, as I stated, was that there is so much disparity between the opinions of supporters of Jussie and those who heard the same evidence and had a completely different view.

A jury convicted Smollett on five of those counts, each of which carried a maximum of three years in prison.

Judge Linn reviewed the penalty during the hearing and clarified the law does not provide for 3 consecutive years for each count.

Jussie Smollett Proclaims Innocence, Reacts to Jail Sentence in Chicago Courtroom

Actually considering all the lies I think he got off very lightly. He could have gotten years.
I think the judge threw the worst sentence at JS. The "years" would have been at a state prison. Instead he has to spend 5 months at Cook County Jail, a much worse sentence. Based on JS's reaction, Cook County Jail is his worst nightmare.

Notice how he randomly started screaming - I'm not suicidal. IMO that is because he fears being killed in Jail.

Two good articles describing conditions at CCJ.

"Judge James Linn noted he had two sentencing options: either a probationary period with up to 180 days in jail, or up to three years in prison," Keegan explained, adding that Smollett received the best deal available to him.

Jussie Smollett sentencing: Legal experts weigh in after actor learns fate

OK, given the defense requested protective custody which the Court granted, I think JS's post-sentence courthouse antics emphasize this was simply one more live performance by the convicted liar.

From the link:

Jussie Smollett will be held in protective custody -- as requested -- while serving his time behind bars.

Judge James Linn ordered the actor's 150-day jail sentence, and specified he'll serve it under protective custody. According to legal docs, obtained by TMZ, Judge Linn says Smollett and his team requested the protection.

The goal of protective custody is to protect an inmate from any form of harm while they serve their time.

All an act -- JS knew in advance he was going to be protected!!

The sheriff's office released the following statement Friday afternoon:

"Mr. Smollett is being housed in his own cell, which is monitored by security cameras in the cell and by an officer wearing a body worn camera who is stationed at the entrance of the cell to ensure that Mr. Smollett is under direct observation at all times.

"As with all detained persons, Mr. Smollett is entitled to have substantial time out of his cell in the common areas on the tier where he is housed, where he is able to use the telephone, watch television, and interact with staff. During such times out of cell, other detainees will not be present in the common areas.

"These protocols are routinely used for individuals ordered into protective custody who may potentially be at risk of harm due to the nature of their charges, their profession, or their noteworthy status. The safety and security of all detained individuals, including Mr. Smollett, is the Sheriff’s Office’s highest priority."

Foxx's inflamatory language is offensive and dangerous. Excerpt from her piece:

"What is most frustrating is that my cooperation in a process I knew was illegitimate sets a precedent that can be weaponized against progressive prosecutors determined to break the cycle of inevitable outcomes."
What is "the cycle of inevitable outcomes." ?

So is she saying that it was inevitable the the outcome would be that Jussie would be held accountable for his illegal actions? And she was trying to break that cycle?

That is how these new 'progressive prosecutors' seem to be working nowadays. Taking away the need to pay bail, taking away being charged for 'minor' crimes like theft, robbery, mail theft, etc. Their solution to 'breaking the cycle' of minorities being incarcerated is to stop charging them for breaking the law.

So whenever he is allowed to come out and watch TV and use the phone, no one else is allowed to do so? Isn't that going to piss off the other inmates even more?

How long can they give him that kind of elite treatment?

It might be a good idea if they confiscate Smollett's bed sheet so he can't hang himself.

I'm sure he will get that kind of treatment for 150 days or however many days he actually serves. Housed in the county jail, I think his protective custody similar to when other defendants such as Scott Peterson or Aaron Hernandez were held in jail pending their trials.

ETA: I recall learning about AH's protective custody when it was reported how when he'd been let out for his protected time outside his cell, he actually crossed over to GP to assault an inmate he alleged had previously taunted him.

A segregated wing, he gets his own personal cell. As much tv as he wants in his cell. And rec time staggered with all of the other "Special" people. Probably an hour a day.

Heck yeah, cameras on him every nanosecond, I wouldn't put it past him to beat himself up somehow, and blame some guy just working his 8 hours. JS is a piece of work.

I think it was both to protect him from other inmates and suicide. Keep in mind that it was Smollett and his team that requested this protection which was granted by the court.
I could say something but I won't say the first thought that comes to mind. Instead I'll say this. If you can't do the time, don't do the crime.

As he should be!!

It was all an act, a live performance by JS when he already knew he would be serving his time in protective custody.

Following the hearing, I recall a reporter asked his grandmother about his "I'm not suicidal" comments and her response was that he likely said this to keep his family from worrying about him. More like reassurance.

I wouldn't be surprised if he previously threatened to take his life if sentenced to jail. MOO
