Judge Linn just said there is no time limit on the lawyers for arguments.

The jury is coming out. Closings about to begin. Sounds like special prosecutor Dan Webb is up first. Prosecutor Sam Mendenhall will do rebuttal

Webb: This case is relatively simple. Smollett "falsely reported a fake hate crime to the Chicago Police Department as a real hate crime ...We have proven this by overwhelming evidence."

Webb: Not only is what Smollett did a crime, "beyond that it’s just plain wrong to just outright denigrate" something as serious as a hate crime, and "then to make sure it had words and symbols" emblematic of this country's racist past "

Webb says they have overwhelming evidence corroborating what the Osundairo brothers told police, and that Smollett "tailored his testimony" to fit what he couldn't deny, like surveillance footage, and lie about the rest

Webb said Smollett lied when he testified that to this day he does not know who attacked him. "That is false testimony," he says.

"I don’t think there can be any doubt in anyone's mind who sat through this evidence that is was the Osundairo brothers, who are black, who attacked him," Webb says. Smollett's story that they were white was all part of the hoax, he says.

"If I say it was whites, that makes it more real," Webb says. "It gives it more credibility (that it was a hate attack)"

Webb now showing jurors a list of what he says are six key pieces of evidence "that destroy" Smollett's story about what happened. First is withholding evidence: "I'm telling you if he is the true victim of a crime then he would not be withholding evidence from the police."

Webb noting that Smollett did not agree to turn over his cellphone, DNA or medical records to police. Smollett testified that it was due to privacy concerns; Webb saying he didn't want to hand over his cell because he didn't want cops seeing his communications with Bola Osundairo

Smollett didn't turn over his phone even though he'd told police he had gotten a threatening phone call a few days before the attack, Webb said. "Police said to Mr. Smollett ... that phone call is critical."

Smollett's medical records showed no severe injuries, which Webb is using to bolster the Osundairos' story that they were supposed to rough him up but not really hurt him badly. Webb noting that Smollett did not give cops consent to see those records a few hours after the attack.

Webb said Smollett refused to turn over his cell phone because it would show he was in recent communication with one of the brothers who was in on the hoax. "The last thing Mr. Smollett wanted was for police to reach out to Bola Osundairo."

Webb says Smollett refused to turn over his limited medical records because he didn't want police "poking around" and finding out that his injuries weren't serious. "He knew that they had pulled their punches. He knew his injuries weren't serious. So he said 'No.'"

"No real victim of a hate crime would decline to give police a DNA sample, Webb said. "He didn’t want them looking at that rope for DNA because what if Bola or Ola’s DNA is on there?"


Next key, Webb says, is that Smollett refused to give a DNA sample. (Smollett testified he was a private person.. "I won't even go on http://Ancestry.com). "This evidence is extremely powerful that he knew he had planned out a fake hate crime."

The way the rope was put around Smollett's neck, Webb says, also destroys his credibility. He's showing jurors the surveillance image of the rope loosely around his neck shortly after the attack. By the time police get there, the rope is closer to his throat.

Webb saying he tampered with the rope around his neck to make it look more serious; Smollett on the stand said he took the rope off and then put it back on before cops arrived because his manager told him it was evidence that shouldn't have been messed with.

"How would the brothers ever know to be right at that intersection right at 2 am?" Webb asks.

Webb: Smollett said he'd been in contact with Bola Osundairo before the attack to reschedule their workout for 9:30 the next morning. But there's no evidence that the next morning, after the attack, Bola showed up for the workout or Smollett contacted him to cancel

"That workout story was a bunch of hooey," Webb said.

There were multiple exits from Smollett's building, but the brothers were only staying in one place -- not splitting up to cover all the exits like they would have if they were really planning to attack him, Webb says.

Webb: Smollett initially said he would sign complaints against the Osundairo brothers, then spoke to his attorney, then said he would not sign the complaint after all.

Webb brings up the text of "support" Smollett sent to Abel Osundairo when he was in custody. "He wants the brothers to think we can keep our mouths shut. Mr Smollett is gonna keep his mouth shut and no one will ever know what happened," Webb says.

The exercise and meal plans the brothers worked on for Smollett (remember the apple cider vinegar and StarKist tuna?) were "insignificant," Webb says. "There’s no way that’s worth $3500."
Smollett explained the "might need your help on the low" text as a request for Bola to pick him up an herbal steroid in Nigeria. Webb pointing out that Bola denies that, and Smollett could not identify the steroid when asked on the stand. "He made it up," Webb says.

Jussie Smollett was branded a 'serial liar' who 'without question' orchestrated a hoax attack in January 29, 2019, by hiring his friend and apparent sometimes lover Abel Osundairo, and his brother Ola to beat him up in an effort to boost his career.

Special Prosecutor Dan Webb tore through Smollett as he addressed the jury, telling them the actor deliberately 'tailored' his testimony to avoid the truth and lied to them repeatedly under oath.

'There is no question that Mr. Smollett is the person who orchestrated it. Mr. Smollett went on that witness stand and made many, many false statements to you.

'He lied under oath to you jurors in the course of this trial,' Webb told the jury.

Webb says the defense spent their cross-examination "mucking around" asking about side issues like Bola's guns and Ola's use of homophobic language (He may have said "🤬🤬🤬king around," actually, which would be more interesting)

Webb: "I’m not saying the Chicago Police Department is perfect, I’m not here to say that, but they busted their buns on this case." 24-26 officers worked some 3000 man-hours and reviewed 1500 hours of video surveillance footage, Webb says

Webb says Smollett's whole defense was just to try to dirty up the Osundairo brothers, asking Bola, "Oh you're a bad guy and you bought drugs for Smollett." Bola also "had a right to buy guns and he ha a card to legally have those guns."

And the attempt by the defense to show that "somehow the brothers are homophobic" had nothing to do with the evidence in the case, Webb says.

Webb: "The police really busted their rears for this hoax."

Police spent thousands of man hours knocking on doors, reviewing surveillance video, interviewing cab drivers, and the defense says "all this is is a rush to judgement by the Chicago police Department," Webb said. "And that's not fair."

Webb says he's "running out of time" and is going to wrap up. The judge told him there were no time limits, but I think he's hit the right notes.

We're basically walking through the indictment now: Six counts of disorderly conduct/false report to police. That's for six false reports over the course of four police interviews, Webb says.

Smollett knew "the attack was fake, he consented to it ... he reported it as a real crime when in fact it was a fake crime," Webb says.

Webb wrapping up: "When you decide this case as a jury you are allowed to use your common sense and intelligence ... All I can ask is for you to return a fair and impartial verdict." Short recess before defense closings.

Smollett's attorney, Nenye Uche, is starting by talking about "the elephant in the courtroom," which is assumptions.

Uche: 'The entire prosecution case was built like a house of cards, and we all know what happens to a house of cards when you apply a little pressure. It crumbles."

Uche calls the Osundairos "sophisticated liars and criminals." "You have to have your guard up with them mentally, emotionally, even spiritually … they are highly intelligent, really smart, and they know how to dumb it down so you think they’re victims."

They said "I don't know" dozens of time on the stand, Uche says. "They responded like Robocop. Yes, no, yes, no, I don't recall, almost like someone is telling them what to say."

Abimbola Osundairo took multiple bathroom breaks during his testimony, Uche points out. "What’s he doing in the bathroom??"

The lead detective testified he did not know the results of testing from the guns found in the Osundairos' apartment. Uche: "You don’t want to know if the gun is part of a violent crime or if it’s used by a gang who targets a group of celebrities? Because that happens."

Uche says cops were in such a rush to judge Smollett that they ignored the fact that the Osundairos had heroin and guns in a safe in their home. "Are you kidding??"

Uche: "The Osundairo brothers are the worst because they have a brotherly culture of lying, a brotherly language of lying and a culture of criminality ... The 'blame the victim' scam. It’s bigger than the 'African prince' scam. Don’t fall for it."

I'm not the brothers, or African American, but I am offended by the statement by the attorney in the last part of this post.
