GUILTY IL - Anita 'Jeanie' Kustok, 58, shot to death, Orland Park, 29 Sept 2010

http://abclocal.go.com/wls/story?id=9282419

An earlier article dated October 2013, from another source - sorry, articles are posted out of order.

A remark, made by the children's attorney, at the end of the article indicates Kustok's children are standing by him and speak to him almost every day.

I'm unclear as to when the attorney made the PR statement quoted in the article.

The article recaps the circumstances of Anita "Jeanie" Kustok's death (murder).

Looks like Allan Kustok's murder trial will begin tomorrow in Cook County Circuit Court in Bridgeview.

Thanks Goodnes!

I did read (Tribune? Patch? etc.) That the children had attended the preliminary hearings up until fairly recently, but have since stopped and have not communicated their support to the press and others for a bit now. I believe this was just after the revelations of his "extra curricular" activities came to light.

(I for one, will never forget his original explanation for why he didn't call 911 or immediately transport her as "She was a proud woman" - uh huh.)

"Jury selection begins Tuesday, in the murder trial of Allan Kustok."

Potential jurors were being questioned about their feelings on marital infidelity.

Prosecutors will call several women who allegedly carried on affairs with Allan Kustok.

Both children, Sarah and Zak Kustok, have been subpoenaed by the defense.
Apparently Sarah was sitting behind her father in the courtroom today.

Pete Rush, Sarah's attorney, said it "was fair to say" she was present to show support for her father but that Sarah could not answer questions from reporters.

http://chicago.cbslocal.com/2014/02/19/seven-jurors-picked-in-kustok-murder-trial/

"Seven jurors were picked Tuesday in the murder trial of a former Orland Park man accused of killing his wife in 2010, with jury selection continuing Wednesday."

Six women and one man were selected from a pool of more than 70 potential jurors.

The judge said the trial is expected to take two weeks.

"The prosecution has indicated it plans to call as witnesses several women whom it contends had extramarital affairs with Kustok as it tries to show that he was unhappy in his marriage and wanted a divorce."

Judge Hynes ruled the women will have to identify themselves in court, denying a motion they be identified only by their initials.

Kustok's attorneys are expected to call women to the stand to testify that Kustok's marriage wasn't troubled. (How many women are there? There's a word that describes the irony of this statement but it escapes me at the moment. Ludicrous?)

"Anita Kustok was about a month shy of her 59th birthday when she died."
(Umm, that's the nice way to put it.)

Thanks for the updates Woe.be.gone.

It sure took a long time for this one to go to trial.

Should be very interesting to follow.

Allan Kustok murder trial delayed; Man accused of killing wife, Anita Kustok, in 2010

Opening statements in the Allan Kustok murder trial were delayed after an attorney on the case was injured.

(Snipped)

Defense attorney Rick Beuke slipped and fell on ice outside the courthouse Thursday morning. He had a cut on elbow that was bleeding, so he excused himself as court opened to go to the hospital.

If that is not the makings for a law suit I don't know what is.

Thank you Joe Friday.
It was good to see someone else posting because it made me sad that not many peeps seem to be paying attention to this case. Maybe that result is partly due to strategy when a case takes so long to go to trial. People forget and move on with their lives.
To me, one of the worst crimes involving murder is when a woman loses her life by the hand of the person who promised to be her partner especially when she's the mother of his children and appears to have been an upstanding citizen.

It must be agony for the grown children to have to face this trial but I'm curious as to the angle the defense is going to take when questioning them when they're on the stand in their mother's murder trial. They've both had time to process the situation and the evidence that their father killed her seems strong.

On another note, the attorney must have taken a hard fall to cause bleeding considering he was probably wearing a coat, long sleeves and possibly a suit jacket too. Hope he didn't break any bones.
My mom got dropped off in front of our library once on an icy afternoon. When stepping out of the car, she broke her ankle. We're not the suing types though. She figured she should have been more careful since the sidewalk was clearly icy.

Today, Thursday, opening statements were scheduled to take place.
Obviously court was delayed after the defense lawyer injured his arm.

Wonder if court will be in session tomorrow, Friday? (or not until Monday)

Also, I've asked a mod to place this thread in the Trials section but, for some reason, the thread remains here in the Awaiting Trial section.

I think the part that will convict him will be his statement to LE saying he found her lying dead on her back with her hands across her chest, the gun in her right hand. It would be very unusual for someone to shot themselves in the head while lying in bed and have their hand with the gun still in it, lying across their chest.

I doubt there was any Gun Shot Residue on her hand or arm either proving she never fired a weapon. The distance at which the weapon was fired from her head I think will also further prove that she never fired the weapon.

Today the ER Nurse and the Doctor testified. Their stories differ in regard to what AK told them happened to his wife in their bedroom before he decided to drive her to the hospital.

The ER nurse testified that AK said that Jeanie woke him up because she heard a noise and wanted him to investigate.
Whereas the doctor testified that AK said that he woke up to the sound of a gunshot and found his wife dead beside him in the bed.

The defense attorney pointed out some variations in the written reports about the clothing AK wore to the hospital. The nurse said she didn't notice blood on AK's T-shirt but photographs taken show a large bloodstain under the arm.

The above testimony took place this morning.

In the afternoon, a woman who had an affair with Kustok was expected to take the stand.

Here's another link to the testimony of Jeanie's brother. He wasn't aware of problems in the marriage but denies Jeanie would shoot herself or even know how to handle a gun.

The defense is saying that Jeanie shot herself because she was suffering from menopause and was living in a sexless marriage.

(Now that's the biggest flipflop excuse I've ever heard. In other words, AK is describing his angst about that season of life, not hers. So, AK couldn't support his wife through menopause so he killed her. IMO)

At hospital with dead wife, Kustok received texts from another woman

The morning Allan Kustok drove his wife’s body to a Palos Heights hospital, several text messages were sent to his cellphone from a woman he was allegedly pursuing a relationship with.

Those three texts went unanswered, Kathleen Rettke, who sent a the text messages, told a Cook County jury Tuesday morning, taking the stand in Kustok’s murder trial.

But they didn’t go unread, prosecutors indicated.
