The only opened window?
I have been on The Voyager twice and The Explorer twice and those windows are opened by people and staff long before the time of Chloe’s death.

I took this photo in December on The Voyager for WS.
A uniformed lifeguard went along and opened the windows

Wow! How can he say he thought it wasn't opened? So obvious even in a photo.

The jury will see the photos of the windows and he will have to get a doctor to testify that he is colorblind. Not just color blind but color blind in regards to tinted windows or sunglasses etc... .
Like if he uses sunglasses that wouldn't make sense. They will look for a photo of him wearing sunglasses. Do his own regular glasses have tint? Mine tint in the sunlight.

..2 Cents...

There will be footage of him in customs, walking up the gangway and everywhere on board, even to him interacting with mum before she left him with Chloe.

Ive seen families with walkie talkies to communicate around the ship but their cell phones would’ve worked at the dock. So how did he know mum needed him to look after Chloe?

I thought the mom asked him to, ?

Well, both those were murder cases and the jury did not have the advantage of viewing direct evidence such as a video tape of the crime as in this case.

I don't think the jury will need to visit the ship in order to find him negligent.
You can clearly see him lift her over the railing and onto the window ledge. The proof is on the tape.

Imo
It will surprise the jury to see how high this "elderly" man easily lifts Chloe up! I noticed the DM article referenced SA several times as "elderly, color-blind" and they did not show the reenactment pic with the doll standing on the window ledge. Talk about putting a slant on the story...

I think you give Winkleman way too much credit. JMOO.
Lol! But IMO he'd be a fool to deliberately physically alter a video to make his point. What I think is he instead fudged on the reason for the time difference when he knew full well what the video actually showed and in what time. As a maritime attorney he knows full well how CCTV works on ships. MOO.

".....The silver-haired IT worker from Valparaiso, Indiana did not respond when local reporters peppered him questions on the way into court today, one asking: 'You knew the window was open, didn't you?'....."

"...The couple's plea refers to the findings of their legal team's unsupervised inspection of the Freedom of the Seas as it docked in Barbados on January 10...."

Unsupervised Inspection?

If they weren’t a cruise they would have requested special permission to board and I doubt very much they were left unattended. How would they know where to go and how to get off as soon as the inspection was completed if not on a booked cruise? Imo they were dressed as passengers.
RCC has facial recognition to board and security are crazy careful.

When I was takeing measurements and photos there was a couple looking at me like I had two heads.:D

There has been lies spouted on everything else so why not diddling a video?
I do agree with you.

I don’t recall where but I know I’ve seen the shortened video. What I saw was not a question of frame rate. There were clear jumps in the video where you could see people who were walking had changed location instantly. It shows them approach the window, he leans over for a second then bends down and picks her up. You see him swing her over the railing and then just seconds later he falls back after she is gone. Will see if I can find it again.

If only I took a photo of me leaning out the window. Man am I kicking myself!

IMHO The fam wants the truth covered up and for all of this to just go away. But, guess what, most of the cat is out of the bag.

SaguaroSpirit :
I am beginning to think you have had the right idea all along. I was trying to give the fam the benefit of the doubt and ignore the feeling in my gut which said this might not have been an accident. But that is becoming almost impossible to do now.

Now I'm questioning whether what I'm seeing is really a reaction to a sudden, tragic, unforeseeable occurrence.....or whether the script was written beforehand and they are all just playing their parts.......MOO AND ENTIRELY SPECULATION

Oh this case makes me so angry....and sad

Still good recent photo crispy! Don't kick yourself, there are others who need a kick.

From the DM article:

He also claims to have had difficulty telling the difference between the tinted, waist-height windows on the Freedom the Seas' 11th deck and thin air because he is colorblind.

Thin air? What? Is this something new being introduced?

ETA: On second thought I think this was DM's way of saying open air. Sheesh, they had me going for a minute. C'mon DM, speak plainly.

I cannot believe they could watch the CCTV and STILL back SA . Reckless doesn't even cover his actions leading to the fall . How can C s parents continue to support this man ? SA breached the safety rail , put there to keep passengers safe . Why even blame CL for the actions of SA ?

I asked the same questions and the only answer I can think of is.....$$$$$$$$

This pic of this lifeguard easily opening the windows without even leaning toward the railing sure shows the opposite of what the Winkleman reenactment pics show.

I have been following these threads and signed up a week ago to see court documents. Thank you everyone. I have not seen this CBS video posted. CBS actually shows some of the video and it is more clear than others. I think it must have been posted already but I can't find it.

In this video this guy is holding his camera pointed down toward the dock and his hand is outside the window and he’s not even trying.

How much proof do they need!!

The 3rd pic in this story from the Indy Star show the opposite of the story headline!

Family attorneys say cruise line's story of toddler's death is 'physically impossible'
Think about it, what is the #1 reason people say as to why they ran into a sliding glass door?

Didn't see it.

Think about it. Why didn't they see it?

They were moving too fast, walkng into it, runnig into it.

Have you ever heard of anyone bumping into a glass door, or trying to step through a glass door, after they have stood in front of it for 30 seconds?

No.

Why?

Because that gives you ample time to see that the glass,
is in fact, right in front of you!
