soooo.... instead of leaving the jury with a sex tape for the long weekend, they left them with she got a "nice letter" from Travis????? really???? LOL! :floorlaugh:

(Glad that they didn't get the chance to play the tape, though).

This may have been what the evidentiary hearing today was about. Whether they can admit it or not.

Is it just me or do those letters on the panties look like cheap generic iron-on letters that she found quickly at some craft store an hastily ironed on? They just don't look like letters that would be standard for a t-shirt shop or even something you would order online.

That's exactly what they look like. And seeing this photo was taken in July, after she murdered Travis, what's even creepier is the thought she could have fabricated these "shorts" AFTER she killed him.

On cross, does JM get to call additional witnesses to testify to any of the things JA is claiming/saying, or does he JUST get to cross examine her testimony?

Sorry if that didn't make good sense lol, at work and trying not to get caught not working! ;)

On cross examination he just gets to cross HER but in the rebuttal case he gets to call new witnesses to refute anything and everything they brought up in their case.

The rebuttal begins once the defense rests (hopefully in 2013) and then the fireworks really begin. Juan also gets the last word.

yes, there were. dark socks.

ETA: i am only 1/4 of the way into my first cup o' joe, so her name isn't coming to me.. but she brought socks out of an evidence bag, containing the rest of the contents of the washing machine. i will try to find the video of that day of trial (although i still don't know how to post things like that :blush:)

Not sure about that, but there will most likely be a rebuttal phase of the case when additional witnesses can be called to refute Jodi's testimony.

Yes. It's called the rebuttal phase. After the defense rests their case. He can only present evidence to "rebut" what the defense presented, not additional evidence. But Nurmi and jodi have left the barn gate for what that means wide open.

I think it will depend on how much latitude the judge gives her. What I mean is, if Martinez starts asking "so have you stopped beating your wife -- yes or no? type questions and Jodi responds with I can't answer with a simple yes or no, will the judge allow her to expound or not. I usually don't follow criminal trials so I don't know if that's come up in other cases or what the judge typically would do in that situation. Especially in a capital case where the defendant herself is being crossed.

Eta: I looked into it a little bit and found this. Just one trial lawyer's opinion, but I happen to agree with him. I didn't like it when Martinez did it with prior witnesses and I think it would be an especially bad idea to do it with Jodi.

Techniques That Don’t Work

“Just Answer Yes or No”

Television, movies, and, unfortunately, some trial skill programs in law school have encouraged trial lawyers to fall back on the command “just answer my question yes or no” as a method of controlling the runaway witness. This is not a valid controlling technique. First, most judges will not permit the lawyer to do that. Most judges will inform the witness that they may explain their answer, at length if necessary.

Second, and more importantly, this signals the jury that the cross-examiner is not playing fair. The lack of choice given the witness suggests to the jury that the lawyer is trying to “trick” the witness. Non-lawyers resent this heavy-handed attempt to strait jacket the witness. To them it appears that the lawyer is attempting to “put words in the witness’s mouth.” A lawyer resorting to this method lowers both credibility and control.

Credibility is the paramount feature of the successful trial lawyer. When the trial lawyer loses his or her credibility, the case is lost. Credibility is severely damaged when you utter the words “just answer my question yes or no.”

There are no two schools of thought on this issue:
Don’t do it.

I agree 100%. Mr. Martinez does need to take into account (and I'm sure he has) that the older jurors may have fallen for her innocent little girl testimony; may feel angered that such offensive and sexually implicit pictures and experiences have been forced upon her; may not believe that such a frail and delicate young lady could physically inflict such injuries; that she must have been driven by something horrific to possess her to kill; may not be able to 'read' the shower photos, particularly the tricky one of her dragging; may not be able to comprehend how a camera could seemingly take photos on its own; and may not be able to follow the trail of circumstantial evidence of premeditation. I had no trouble with it, and I am over seventy, but I have no doubt most of my peers would. The 'answer yes or no only' technique could cause a train wreck IMO.

I've been struck with something regarding the "accidental photo" with JA's foot in it. (anyone have it handy?)

I took a workshop last year where we had to get special martial arts shoes and they look just like what it appears she's wearing in that photo. One might call them "Ninja shoes".

Here is a pic of them. Thoughts?

Ninja "shoes" have a split in the toes. Jodi took karate when she was a kid. I'd think she's been able to kick and get away and run from a naked man.

Good morning all.... I have a big "What if" to toss in... I keep thinking about the rage involved in killing TA. It's way more than jealousy or rejection... What If... Jodi somehow got pregnant and Travis talked her into having an abortion? I've never seen it mentioned anywhere. She testified that they did eventually have V sex. (I previously thought they stuck to the other types of sex) What IF she did manage to get pregnant and felt she was pressured to have an abortion... the rage and hate that appears in the crime scene photos would make more sense. Probably didnt happen... but what if? Crazy what if.. huh?

I'm thinking she may have had a few abortions in the past.

I have a little different take on Jodi's references to being "spun around", and I think this is yet another example of how she lifts scenes from film, TV, and/or books to embellish her tales of woe.

I can think of numerous romantic scenes where the man turns or spins a woman toward him to embrace and/or kiss. This always seems to have a dramatic impact in a scene where the couple is on the verge of an argument or unsure of what should transpire in their relationship. Hence, the pause when the woman usually has her back to the man, and he spins or turns her toward him for a passionate embrace/kiss. This is what I think of whenever I've heard Jodi mention it.

But JA is most definitely talking about spinning her the other way! Because then she talks about him bending her over.....:what:

There are pictures of them in Amarillo which is 100 miles north of where I am.. It creeps me out knowing she was actually that close to where I live! Gave me the creeps when I saw the pictures. It must have been on their trip to Oklahoma on I-40.

I found someone who posted old footage on YouTube, so I'm watching there. She does look like such a meek little librarian, ha!

Thanks for that. You are right about Nurmi being the one to want to approach. Also, it was no surprise to Nurmi. He was eliciting testimony about the letter specifically.

I was instructed to purchase those exact shoes in a martial arts store for a qi gong workshop I took so the ones I posted are some kind of martial arts shoes.

my point had more to do with her premeditation and generally psychoness.

Did she come with HER Ninjawear in order to dress the part for this murder?
