No, she was convicted and the jury only took 5 hours to do so. They did not buy the abuse claims.

The appeal court ruled that her attorney did not do his job in the sentencing phase so that is the only part that was re-done and she got 20 years this time instead of 25.

I think the state only asked for second degree in that case and got it. That case was in Tx instead of Az.

IMO

It's coming back to me now. So she had a retrial on her penalty phase only. I'm watching the 48 Hours episode now.

I cannot imagine the amount of rage that goes into stabbing anyone 193 times!

I think it could hurt Jodi if she tried to trash Travis anymore than she has and in particular if she has nothing to back it up other than her testimony. What she will claim will stick in the jury's minds and if Juan pins her down with her lies the jury will remember that when it comes time to sentence her. It will disgust them. I think defense is playing with fire. jmo

My belief is it is already too late for her. From what I have heard and read, at least some members of the jury appear to have lost interest in her tales of woe, which could include her accusations against Travis. Eagerly anticipating Martinez to bring that home during his cross-examination of her, particularly that everything negative she has said against Travis he cannot refute as she murdered him.

Minor4th: Is it really legal for a lawyer to lie to a witness about the "evidence" they have?

It would probably be subjective. If Nurmi believed there was good evidence to support what he was saying, then it's probably not misconduct. Hard to say.

I don't believe the bullet came last. I don't find the medical examiner's reasoning convincing. The evidence he cites has other explanations.

He cited two reasons

1. There were no signs of bleeding from the bullet wound.

Easily explained by the evidence that the body had undergone some cleaning with water after Jodi placed it in the shower. Based on the positioning of the body in relation to the shower head and faucet, Travis's head would have received the most of the cleaning attempt.

2. The bullet shell was found on dried blood.

Bullet shells are quite bouncy. Perhaps the shell ejected into a clean corner of the bathroom but as Arias was trying to clean the bathroom after the murder she kicked the shell, causing it to bounce onto a drying blood stain.

Logic says that Travis was first shot then knifed. Even Jodi says this. In her second story about the murder she indicated that the gunshot came first. She would have had no reason to lie about this because stating an incorrect sequence of events would gain her nothing as it risked contradicting the forensic science, thereby further undermining her credibility.

I believe the ME concluded that he was shot last not just because there was no blood on the outside of the wound but also from the fact that there was little blood inside the brain. Had he been shot first there would have been blood in and around his brain matter. They must be able to tell somehow. That is what I understood. jmo

BTW - I meant to include this in my post......... In the intro to his book, Travis tallks about his drug addict mother beating him for waking her up; forgive me if you've already discovered this:

"As she progressively got more involved in drugs she progressively got less capable of raising children. Most commonly was a beating for waking her up. It hurt but we got used to it. I learned how to turn so that when she hit me she would strike my back and arms, the pain was less there."

As strange as it may sound... At times I pray that if there is any way possible.. that his parents (even tho they may have failed Travis in this life) that they will reach beyond the boundaries of this life and join together with TA's sweet grandparents who raised him, and command justice for Travis.

O/T I have three grown sons. My oldest has been married for several years. The first few years were very hard for all of us. She deliberately did anything she could to hurt him and cause him misery. I'm thankful she never tried to hurt him physically. I can't bring myself to even imagine something this horrible happening to any of my sons. While I always pray for their safety.. due to this trial I pray a lot more.

My (only) daughter broke up with a crazy boyfriend a couple of weeks ago. I have been on edge and almost drove myself crazy with worry about what he might do/could do to her. I had a tire slashed on my truck the night after she broke up with him. He swears it wasn't him but I've lived where I do for almost 20 years and have never had something like that happen. We are pretty sure it was him but couldn't prove it. People are crazy now days. We have to be hyper-vigilant to the possibilities of what people 'might' do. It's such a sad world we live in.

BK appears on a few shows and is someone who covers trials for TruTV, InSession as well as CNN. She is a correspondent. She doesn't have her own show, she doesn't represent one side versus another, she is a reporter/journalist/correspondent. She never gives her own personal opinion, she reports on what she observes and adds legal knowledge.

If NG did the same thing (reported and didn't take a 'side') then she too would be the same as B.K. But Nancy's whole schtick is to always take the side of the victim and create controversy to gain ratings. The fact that both of them used to be prosecutors is neither here nor there. It's what they are doing NOW that distinguishes their roles. From the time NG first started on a TV (she was in a show with Johnny Cochran at first), she takes one side and one side only--the prosecution's side.

Interesting isn't it that they both started out being media correspondents many years ago along with Cathrine Crier, and Diane Diamond. Beth is more soft spoken when she speaks about what she saw or heard than Nancy Grace. Two different people two different styles.

I tuned out Nancy quite a while ago. I've always liked Beth.

Yes this was after the murder. There has been speculation she had the license plate upside down on purpose so she would get a ticket in Utah...a ticket that would add to her paper trail that she was in Utah, not AZ.

This is an interesting theory. My belief has always been that she changed the license plate in order to make it less able to read while in AZ (and especially while in Travis' neighborhood) and simply forgot to change it back once she left.

Wanting to get the attention of LE after the murder? She would be more brazen than I had imagined.

Nurmi said, in open court, that an expert concluded that the letter he was talking about was probably written by Travis. As I understand it, the order denying admissibility was based on the fact that the letters were copies, not originals, rather than on conclusive determination that they were "forged."

I remember watching this on Dateline, 48 HRs, etc a couple of times (it was updated when she went to trial again). Isn't this the case where the prosecutor brought in a bed and imitated stabbing it *192* times (or if this isn't the case, it was the number in that trial)?

there is a guy who is strongly involved with jodi, possible boyfriend, idk, who sits behind the arias family everyday in court. he is going to be interviewed on jvm tomorrow night on why he believes she's innocent. last week a guy named paul something claims jodi came to him all in a panic to borrow some money for her mesa trip. they didn't give him much time to elaborate, but he did say she paid him back. this week is going to be interesting.

I guess I understand how it would be his opinion that it was "100% solid evidence" if this happened before the letters were determined to be fraudulent. He wouldn't be allowed to flat out lie though, right?

Surely one can't imagine B.K. NOT scooping up her own show though, right? If only given the chance? I know I would, especially in the interest of the victim.

What as a trial follower I cannot fathom is how witnesses do ANYTHING that is public. I do not get it. I cannot understand the frustration they are all experiencing and the pain, but if they are intelligent folks, why are people who may be very instrumental in her conviction do such?

I don't get it.......am I missing something here? It just seems so intuitively obvious that you should not do such?

I was just telling my husband (who rolls his eyes every time I talk about this case) We should have known we were in for a very very long direct when she started out with "when I was 7"

I'm still mulling around in my head her statement that punishments got more severe around age 7. Seriously, who fully remembers enough of their life both before and after age 7 to compare?

Yep. Kelly Siegler. Another prosecutor I wouldn't want to cross-exam me.
