Right. And I just think it's pretty preposterous to think a medical examiner is going to come to his scientific conclusions based on the state's theory or the state's sentencing anticipation.

IMO, if the ME was going to be a yes man for the state, it would have been better for him to conclude that the gunshot was first because that's what the detective had been saying all along, and that is actually easier to understand. He didn't come to that conclusion, however, because it is not what he believes from his examination.

I think the ME's conclusions are based solely on his scientific evaluation of Travis' body and wounds. I still happen to think the gunshot was first because that is the only way I can get my mind around it, but I do not take issue with the ME or think he had any agenda other than to testify truthfully about his scientifici conclusions.

I think Flores was locked into the gunshot first because that is what Jodi told him and it sounded reasonable at the time. When she was talking about the ninja woman she made a slip and said "I was" so I can see Flores believing she was telling the story as it happened but that she was portraying herself as a victim of the two intruders. Gunshot first or stab to the heart, judge ruled it did not matter what happened afterwards was cruel and DP stands. jmo

I noticed Mark Fuhrman said the same thing on FoxNews. Maybe it is due to multiple weapons being used? In other words, uncommon for a perp to start with a knife and switch to a handgun? I believe there was also some speculation the gun may have jammed after the first shot, therefore the knife became the weapon that actually killed Travis.

Personally I cannot see how the bullet casing ended up on top of the blood pool unless the gun was used AFTER Travis had been stabbed and dragged back into the shower.

No, that HAS been discussed here. Jodi's pretty much alluded to it in her own testimony. She was selflessly sacrificing her own body to 'help' Travis. Hence the discussion.

My Opinion: When Travis made the remark - that Jodi sounded like a 12 year old girl on the phone sex tape....I think Travis was letting Jodi know: He thought she was performing a very "immature/childish" fake orgamism; and she wasn't fooling him.

In no way was Travis indicating he was interested in underage girls, sexually. MOO

But the question was whether Jodi would have a duty to retreat once she incapacitated him enough to get away -- and the answer is yes, according to Arizona's self defense/justification laws.

So, let's say Travis lunged at her and she had a reasonable fear that Travis was going to kill her ...and let's say she stabbed him first in the chest, and he went down, tried to defend himself with his hands and tried to grab the knife, but was unable to stand or pursue Jodi; once she has incapacitated him to a point that he no longer presents a threat of killing her, then she is no longer justified in using deadly force. She can't stick around and shoot him in the head and slash his throat, just to make sure he is good and dead.

I was wondering whether the ME's report includes information that constrains the State to a stabbed-first theory. If not, I think the State went with it for DP and I think it could hurt them in the case as it stands now - dp is on the table no matter what and premeditation is with a gun.

And, actually, yes. I think if the ME can ethically support the State's case, he will. He was equivocal, and properly so, imo

The ME's opinion that the stabbing came first was because the shot to the head would have impaired TA's ability to fight her off, but defensive wounds prove otherwise.

If they happened upon this crime scene after shot fired, 911 call, Jodi escapes to Utah. Blood would be fresh, body warm and my guess "certain" details would change. I think overall it is what it is and I'm glad to see that some indicated the M.E. didn't conclude on the report exactly what came first, chicken or the egg. (even if he did give some verbal answer when asked) The report would be interesting and full of his factual findings on the body.

Now if only Travis could send a message. I know I know, those things don't happen, but I want a sign of some kind.
