I'm watching the day she testified this week where she's wearing a green shirt and explaining her own participation in the sex tape.

When talking about the sex part of it, she has that secret smile that Janine Driver talks about. How she's enjoying pulling something over through her lies. Or maybe she is smiling remembering the moment...whatever. That jury is sitting right there watching her SMILE.

Major creep factor.

Yes, I think it was premeditated and I think the State can prove she brought the gun, but not the knife -- regardless of whether she brought both. I wasn't speaking to whether she actually brought a knife. I was speaking more to what the State has a better chance of proving. Imo, what they can best prove is premeditation with a gun and things not going as planned, so resort to the knife. Which is the same reason I question the State's insistence that the stab came first. Apparently, they thought they needed that order for the dp qualification, but turned out they didn't. Now they're stuck with a stabbed first case where the strongest evidence of premeditation is with a gun, not a knife. jmo

There is two different scenarios that go to DP in this case. Felony murder and cruel killing, or whatever the term is...

I agree with your assertion that its easier to link it to self defense if she used a knife from the scene. I think she brought the knife though.

I'm not sure whether she did or not. I think it's quite possible that the gun jammed and she had to go to plan b. That said, even if she did bring both the knife and gun, I don't think the State can prove, or even create a reasonable inference, that she brought the knife. I don't think LE saying that no knives were missing from the scene creates such an inference under the circumstances I mentioned above. The jury may disagree. But if I were on the jury, I wouldn't be assuming she brought the knife from home. jmo

eta: the felony murder charge also would stand on the gun having been brought. So still easier with a shot first theory also jmo

I am eager to hear her explanation of such deadly weapons that trip. Even when she has given us more detail than we care to hear about her life, and the "abuse" she has never described the abuse as "bad" or that she was ever really injured.

She really seemed to indicate her mom's wooden spoon was bad. Travis, not so bad.

I don't see any statement that she was in fear of her life ever. So now, you are officially broken up, he has someone, you have someone and you surprise him with a trip to AZ, but before leaving your house you bring a gun and a knife?

Why now? He back handed you, but not really and didn't hurt. He shoved you, but not as hard as your dad.

None of these incidents rise to the level any person would suddenly be in fear for their life.

Oh wait, he bent her finger.

So now they are officially not a couple.. why bring the weapons now?

Really...just to kill him. There is no other earthly reason you would bring them if you did not plan his murder.

Her little jail buddy (Bryan), when interviewed last week, said he thought it was because Travis was insisting she meet with him (Travis), and she "wasn't sure why or what to expect" (or very close quote, sorry)...and because he HAD physically abused her in the past, she didn't know what he might do. So, she took them just in case. Oh, as if!!!!

Okay, we all know that's BS, but maybe he knows that's how the defense will lay it out? He claims they've never discussed her case in their jail visits. Who knows, but I kinda doubt that.

I am hopeful the jury will see right through that.

Are you as surprised as me that that e-mail cannot be traced?

I wonder if she still had it on her computer, or just had a saved copy of it? Has that been said? If so, I've missed it.

The blood spatter expert also testified that the blood pattern at the sink could have been caused by forceful, thrusting stabs to his body while he was standing at the sink.
wasn't there a lot of blood splatter on the bathroom walls/ceiling and blinds?

I also do not believe she ever "lent" Travis any money. I think she was paying him back for things...or writing him checks for cash. Or paying him for the car she said "he pawned off on her".

Oh how "hotttt" those must have been...irregularly shaped leg holes because they've now been cut, and I'm sure the butt section was too small, so....ummm, yeah. Why bother. :waitasec:

I have an OT question, that Jodi made me think of....

When a woman with breast implants goes to prison, who pays for the care and upkeep of them? Implants only last about 8-10 years before they need to be replaced. If a woman goes to person for life, do authorities just say, "sorry - you have to keep that set in your body forever." Or do they allow the woman to have them removed when the time comes? And if so, I imagine the prisoner would have to pay for that surgery. But how? What if she can't?

That's my totally random Saturday night train of thought. Lol!

Probably. But wrt to premeditation, the defense would have a much weaker argument if she used the gun she brought with her for the purpose of killing him. The State is arguing that she used the knife first. Which begs the question of why she didn't use the gun she brought for that purpose. The answer has to be (from a defense perspective) that something happened in the middle to make her go for a knife rather than a gun -- i.e., she was attacked and it was more handy than the gun. Which creates a space between premeditation and something else. Not saying it'll be successful. I think she'll get at least a second degree charge (if the lesser included is even available). But I think the gun first theory would be much better, cleaner and easier for the State. Clear premeditation followed by either rage or panic or both. jmo

I don't agree that she will be succesful in this story, but I like what you are saying in regards to a defense point of view, makes sense.

Yes, there was - I had forgotten about that. I am going to go back and listen to her testimony. That seems like forever ago!

That said, if she did go to plan B...That would negate any self defense claim right? Had to leave conflict to find knife.

Unless of course there happened to be a knife handy for sex games. :what:

I also do NOT believe it was Jodi's decision, against Travis' wishes to move back to Yreka. None of that fits with her behavior or the relationship. I think she ran out of money and he insisted she move back due to her "psycho behavior".
