I'm not sure whether she did or not. I think it's quite possible that the gun jammed and she had to go to plan b. That said, even if she did bring both the knife and gun, I don't think the State can prove, or even create a reasonable inference, that she brought the knife. I don't think LE saying that no knives were missing from the scene creates such an inference under the circumstances I mentioned above. The jury may disagree. But if I were on the jury, I wouldn't be assuming she brought the knife from home. jmo
eta: the felony murder charge also would stand on the gun having been brought. So still easier with a shot first theory also jmo
BBM I agree, unless they present more evidence about her carrying a knife around. Either way, her goose is cooked!:rocker:
O/T I wanted to test out my theory about my hubby having no clue what knives we have. Our knife block has 12 and a separate drawer has 6 larger chef style knives. These are not from a matching set, just random knives from our single days. I use these all the time, my hubby uses only one knife to cut anything lol. I took two out of the drawer and asked him which were missing. He said none were missing. We've been married 6 years and have had the same knives the whole time.
