I can't help but wonder about the girls being asleep. I would think the molestation would have woken them. Perhaps they've blocked out the abuse.
Or told at the time they were dreaming and then further victimized for having such. IMO

Bobye Holt testified yesterday that she was told one of the girls woke up and hit him.

Anna and Josh Duggar walked into court hand-in-hand on Tuesday for day one of his child sexual abuse material trial.

In May, a source told PEOPLE that Anna, 33, was "standing by" her husband amid the controversy.

"She thinks Josh is innocent," the source said at the time, adding, "[Josh] has seen [his] children with Anna there. She has to be there."

The mom of seven also attended a Monday evidentiary hearing for Josh, during which his dad Jim Bob Duggar and family friend Bobye Holt testified.

During his testimony, Jim Bob, 56, said he couldn't remember the details of Josh's admissions that he had touched the victims, identified during the proceeding as Jane Does 1 through 4.

An insider exclusively revealed to The Sun that juror #7 was excused immediately after the judge learned of his relationship to the defendant.

The juror, whose name is not known, revealed: “I know Josh Duggar, I’m related to him. The marriage of my daughter to his brother."

According to the source, the judge was "shocked" and said the juror should've been "filtered out."

All this comes as we've learned that Josh's estranged sister [URL='https://www.the-sun.com/who/jill-duggar/']Jill and his brother Jedidiah will be testifying as witnesses at his trial.

However, it is not clear at the moment if it will be for the prosecution or the defense.

IMO Jill will likely be a witness for the Prosecution. Given reports in the news that she and her Husband are estranged from Jim Bob and Michelle for some time. And also a victim.

I am very curious about Jed testifying. Back in the day when I watched the show my Husband would ask why I was watching. He saw maybe 15 min. of 1 show and said "Something is not right with that Family" among a few other things :D Then when the vile news broke he said "I told you so"

Josh Duggar says a family friend can't testify about his alleged child molestation admissions because of 'priest-penitent privilege'

During a pre-trial hearing on Monday, prosecutors questioned a family friend of the Duggars, Bobye Holt, who testified that Duggar had told her on multiple occasions about inappropriately touching young girls — both over and under their clothing.

Duggar's defense team sought in a Tuesday court filing to block prosecutors from calling Holt to the witness stand during the trial. They cited "the clergy privilege — also referred to as the priest-penitent privilege or the religious privilege," and likened it to the confidentiality agreements between attorneys and clients, and doctors and patients.

Duggar's attorneys argued that their client had viewed Holt as a "spiritual leader," and had spoken to her in "her spiritual and professional capacity with a reasonable expectation of confidentiality."

Federal prosecutors slammed the Duggar team's arguments in their own filing on Tuesday, noting that Holt "is not clergy at all" and therefore clergy privilege doesn't apply to her, and arguing that Duggar and his father have waived any privilege by making public statements addressing the molestation allegations.

"Any claim from [Duggar] now that he thought his admissions to Mrs. Holt were privileged has been vitiated by his and his family's face-saving press tour," prosecutors wrote.

A judge has yet to rule on Duggar's defense team's motion.

I don't know much about it, but wondering of Duggar's Christian denomination is one that normally has women in positions of spiritual authority over men (if yes, no big deal for the defense) or, if they do not? If they do not, then that would sure be rich.

The issue isn’t necessarily whether she was clergy - it’s also whether Jim Bob/Josh reasonably believed she was clergy. For example, if a Catholic penitent confessed to someone with a collar in church, it’s reasonable for the penitent to believe the person is a priest. I don’t think the privilege applies here:

“Bobye said both she and her husband were giving advice to Josh, and that women don’t typically do that in their church….When the prosecution got the chance to ask redirect questions, Bobye confirmed that prayer was a daily part of their routine, and wasn’t unique to the family meeting in 2003. She thought of Josh’s confessions as coming from a moral place and not a religious one.”

I had to look up the definition of the word "vititated," which apparently means spoiled or impaired in quality or efficiency.

Once Josh is sentenced (I believe he will be) what happens to Anna and her 7 kids! Will Michelle and Jim Bob take them in. In my mind I feel like the Parents likely blame Anna for what happened after she and Josh married. IMO

This is interesting in regards to "lay clergy". Who is identified as "clergy"? I don't think that this objection is going to work.

It is interesting that Josh did confess to these folks. I wonder what precipitated this confession. Was it solicited? Did Josh just decide he felt guilt? There is a lot of context here that is missing. Why was Josh Duggar at this home? Had he been sent there?

This seems a little more on-topic now that he's been tracked down and put on the stand....Jim Bob saying he "can't remember" the sexual abuse of his own daughters at the hands of his own son? <modsnip>

I am wondering if what the article is referring to as “Bible time” is time these children spent alone or in a group. Why would girls three years younger than a young teen Josh be sitting on his lap during a Bible study? My opinion.

I hardly doubt these were his initial instances of inappropriate behavior. He is gross, and the parents are as well for turning their eye. My opinion.

From what I’ve seen from the show, Bible time is often the entire family sitting around the house. All ages.

And the testimony of that woman shows he was at it for longer than I thought. YEARS. From 12–15.

The one who was on his lap wasn't three years younger. She was 5 when it happened, as per the police report. That incident was reported as part of the initial coverage when news of the molestations broke. The girls who were closer in age to him were the ones molested in their sleep. What's new about this info is the abuse went on for much longer than was initially acknowledged, starting when he was 12 rather than 14.

Yes. But the initial police report, just to clarify, shows that one of the daughters complained twice, to her parents, about the molestation. And not the five year old. So they can try to minimize it by saying the girls were sleeping but that’s b.s. They may have started out that way but they knew he was touching them.

Digitally penetrating a child young enough to sit on Josh’s lap isn’t “curiosity.” JMO.

Nor is incest! He tried to pretend this was a hormone-driven game of doctor? The doctor game kids play is about curiosity. Not hormones. It’s no longer playing doctor when one kid is a teenager and the other is much younger and not playing back.
