Kentucky - Judge killed, sheriff arrested in Letcher County courthouse shooting - Sep. 19, 2024 # 3

The silence is deafening… and the sheriff’s safety would be a factor I would think .., but just because he’s offered bond, doesn’t mean he has to post it…

Wonder if he will go for speedy trial

Speedy trial, yes. Get in court and lets hear why. Bond, no. $ wasted: no personal protection outside, presently bodyguarded and securely housed from outside attack. Inside may be porous.

Pursuant to KRS 507.020 Murder.

(1) A person is guilty of murder when:

(a) With intent to cause the death of another person, he causes the death of such person or of a third person; except that in any prosecution a person shall not be guilty under this subsection if he acted under the influence of extreme emotional disturbance [EED] for which there was a reasonable explanation or excuse, the reasonableness of which is to be determined from the viewpoint of a person in the defendant's situation under the circumstances as the defendant believed them to be. However, nothing contained in this section shall constitute a defense to a prosecution for or preclude a conviction of manslaughter in the first degree or any other crime;

In other words, EED reasonable explanation or excuse is not determined in a vacuum of suspicion, conspiracy, hearsay, riddle, or innuendo but what is reasonable to the prudent juror--and under circumstances for a person in the Sheriff's position -- the lawman over the County.

To my knowledge, there wasn't then or now any threat or protection required for Stines family. Personally, I don't believe a jury will accept money laundering or corruption as a "reasonable excuse by the County Sheriff" to commit an unplanned crime of passion against Judge Mullins (i.e., EED manslaughter in the first degree). The murder of Mullins was recorded-- including Stines pausing, and firing additional kill shots before exiting. MOO

Has MS been moved to another facility or is he still being held at the jail in town?
How would a defense mount a defense of extreme emotional disturbance if no independent professional has seen him, based on the video alone? That seems pretty flimsy and dicey. MOO MOO MOO

Vinelink is currently reporting Stines as being housed in Leslie County. To my knowledge, he's never been held in Letcher County jail.

Two months after video showed him shooting a Kentucky judge at point-blank range in his chambers, former Sheriff Shawn ‘Mickey’ Stines has been indicted for murder.

The indictment, announced jointly by state and local prosecutors, charges Stines with shooting and killing Letcher County District Court Judge Kevin Mullins. Stines is scheduled to appear for his arraignment on Monday, Nov. 25.

RSBM.

Good. I don't care what "reasons" he may come up with, it was cold blooded murder, no way around it.

I believe everyone posting on here is in agreement that it was murder, and have actually seen the video.
However, there is a fairly large group who are following to try to learn the reason for his action.
The deed has been done, I care (am curious) as to why. Just in case I should someday encounter them.

I completely agree. I want to know, and I think society kind of needs to know, what compels a man like Stines to just flip and do something like this? I think it's important to understand this, if we even possibly can.

Something about his daughter and the judge????
Yes, but what? If; and apparently denied, there was no "seduction" activity, why the phone calls to her?
I am thinking there was something going on involving the judge, and the daughter became peripherally involved by knowledge of it, not any activity in it. Daughter is advised to keep quiet, but tells/slips up and let Stines know.
Then the results of his gaining that knowledge, the seriousness of it, his family being drawn in, he concludes and does.
Just a possible scenario.

Former Letcher Co. Sheriff Shawn Stines, charged with murder, is set to appear at the courthouse in 30 minutes for arraignment in circuit court. The question is if Judge Adams will set a bond. Stines has been held without bond since his arrest.

Terms and definitions can vary a little and the term "arraignment" is often misused. But since the grand jury has indicted him, my guess is that the hearing will be him advised of the charges, potential penalties, and typically in an arraignment he will enter a plea (guilty or not guilty). Clock on speedy trial "usually" begins ticking at that point.

I'd be pretty surprised if the judge sets any kind of bond. If Stines genuinely believed/believes that "they" are trying to kidnap his wife and kid, I'd be seriously concerned for whoever the "them" happen to be, if he bonds out.
