Cotton to jurors: "This case is a terrible tragedy. ... No one can expect you to be unmoved by what you've seen over the past week. But ... you all promised us that you could put aside your passions & your prejudices and you all said that you'd give Stephen Bodine a fair trial."

Cotton: It's not an easy case. "But now you have to live up to the promise you made us last week" during jury selection.

Cotton: "Miranda Miller's testimony is imply not persuasive." The state can't say for sure how or when Evan died or who killed him. "At the end of the day the state has the burden of proving beyond a reasonable doubt. ... They simply have not done that."

Cotton to jurors: "When you go back into the jury room you have to put your passions and prejudices aside" and deliberate this case with the evidence presented.

Bodine's defense attorney, Casey Cotton, ended his closing arguments by telling jurors they don't have the evidence needed to convict.


Prosecutors can present another 27 minutes of argument if they choose now.

Judge noting that the trial started with 12 jurors and 2 alternates. One juror left last Thursday, though, for a family emergency. Judge says that absence means one of the alternates will now deliberate with the jury.


Alternates both listened to all of the evidence presented.

The alternates will find out after closing arguments who they are and which will deliberate with Bodine's jury. The other will be sequestered during deliberations.

Jurors have gone to the jury room. The alternate has been taken to another area to be alone.


Judge says he'll be clearing the courtroom now to expand the jury room so jurors can view exhibits as they wish.

*VERDICT WATCH! - Trial continues (Day 8) (@ 8:45am CT) - KS – Evan Brewer (3) (July 7, 2017, Wichita; found encased in concrete Sept. 2, 2017) – *Stephen M. Bodine (40) (BF) indicted (12/5/17) with 2 counts of 1st degree murder & 1 count of felony child abuse & 1 count of aggravated child endangerment & 1 count of aggravated kidnapping. Indicted (11/7/17) with 1 count of aggravated assault & interference with parental custody & criminal damage to property (against Evan’s father); plead not guilty; $500K bond.
Skipping over Day 1 thru 6.
10/23/18 Day 7: Jurors starting the day watching more surveillance video taken in the rental house. Sgt. Christian Cory, WPD officer. Prosecutors have rested their case. Defense attorney Casey Cotton now asks for an acquittal for Bodine on all counts. Judge denies motion. The defense rests without presenting any evidence or calling any witnesses. Jury instructions. Closing arguments by both sides. Judge noting that the trial started with 12 jurors and 2 alternates. One juror left last Thursday, though, for a family emergency. Judge says that absence means one of the alternates will now deliberate with the jury. Deliberations started about 2pm CT. Left at about 5pm CT. Will continue deliberations on 10/24.
