Found Deceased KS - Lucas Hernandez, 5, Wichita, 17 Feb 2018 #9 *Arrest*

Wait. Have they really not searched any landfills? Do we know that for sure? I would think that would have been one of the first places LE would check. Sometimes even in so-called "runaway" cases we hear about landfill searches, just to make sure.

I have thought about the container idea. But I don't know how much weight EG could lift or how much she'd be willing to lift. I was thinking about the blue plastic barrels from the Stacy Peterson case, but those are quite large.

Given that she was moving around the time Lucas COULD have gone missing, I would think it would be a no brainer, but I personally have not heard ANYTHING about them searching landfills. I hope they are just keeping the information private, because it's been 2.5 weeks now, and there's a LOT that could be covered up in a landfill by now. :(

Checking in this morning and see some progress re: the timeline.

I keep coming back to the idea of party spots from her high school years. They would be familiar places to her and have the association in her mind as "hidden" spots.

If this happened on Friday evening/night, that might be even a stronger association as high schoolers would be at their outdoor party spots on Friday....but not in the winter, so she wouldn't be noticed by anyone (except whoever she was with, if she was with someone).

I don't know how to take EG.

On one hand, the fact that she isn't talking, makes me think that she is REALLY confident that they won't find him. She figures she'll just ride this out until they give up.

On the other hand, with CA, I feel like she was the same way, but yet Caylee was found. So maybe it's just a matter of time before she decides to start swinging her story a bit and they catch her in a lie.

What I do know for 100% certainty, is that I am tired of these games she's playing, and I really wish she would just come clean already. This is not going to simply go away.
 
I think it's already been suggested but I'm thinking she left the kids home alone whilst she went out to get drugs.
Came back and Lucas was deceased?

OR

Possibly Lucas died during FRIDAY nap time (that's where she got that story line from) and her first thought was to get drugs, then think of a plan? Maybe why Lucas was taken off the endangerment charge...he was already deceased?

She knew he was sick but didn't realise he was THAT sick (possibly didn't/couldn't take him to a doctor because of all the bruises)

Dumped the body somewhere overnight. Somewhere that she is familiar with as this wasn't planned and will need to be quick.

I think she would have been cleaning/possibly getting rid of evidence all day Saturday but she WAS home from 3pm. She wouldn't risk getting caught on camera during the supposed 'nap time'.

Would love to know what some of her google searches where during this time.

Yes, this scenario is something I've thought about as well - that he passed away due to her neglect while he was sick and that he was gone for awhile before she noticed. The "long nap" was, perhaps, the time he was gone before she realized it. I think your idea is a strong possibility. Speculation only.

Maybe the pull-up was full when she discovered him, and that fact weighs on her so she keeps mentioning the pull-up. Again, speculation.

Without going into details, we really need to have the land owners check their priorities if at all possible. There have been 2 articles about the request, but it needs to happen soon.

The family has had a very rough 24 hours. As you can imagine, in situations like this people reach a breaking point - especially with all of the negativity targeting the family.

We’re going to talk to the family again in the morning. It looks like I may be heading to Wichita soon.

From a sleuthing standpoint, I would focus on late Friday afternoon into the early morning hours of Saturday. Lucas would have been transported when it was dark outside.

Lucas had been sick for close to two weeks before he “went missing.” He had a stomach bug the first week and had been very sick. I would imagine his already fragile 45 pound body would have been in a much more compromised state.

Tim was correct when he compared EG to Casey Anthony. I’ve been thinking of Casey’s actions and patterns of behavior - I even watched a show about the case today.

I’m just wondering if anyone else in the household had the ‘stomach bug’ or just Lucas? This line of thinking would lead to a premeditated situation wherein someone was being slowly poisoned before death occurred. In which case the perpetrator would definitely need to dispose of the body and stretching that line of thinking even further the disposal would be planned out in advance. I’m just letting my mind wander here so it’s not really even an opinion that this is a possibility. Thoughts?

I agree. The people on the ground in Wichita are amazing!! Thank you all so much. Wish there was something I could do to help, besides just donate to Texas Eqquisearch.

I can get the quote feature to work, but wanted to say, IMO, ESO's info about the dump not being searched is certainly telling. LE likely has some sort of evidence that LH isn't there. There has to be some evidence about the parks, but I just can't come up with a reasonable idea why they've searched such random ones. The only thing I can even make a stretch at is that EG admitted to drug use at a park, but is claiming to have been too intoxicated to know where she was, but she's sure it was a park? ...yes, quite a stretch.

This brings up another question from me.

If they WERE to search the landfill, even if they didn't have substantial evidence that he was there, would everything be used in court?

I guess I'm just confused as to what can and can't be used in court. I've tried to do my own research, but I'm coming up empty.

If someone can point me in the right direction to information as far as the legalities and what's admissible in court and all that stuff, it would be appreciated!

Basically, does LE have to have a specific lead in order to be able to search a specific area in order for their evidence to be used? Or can they simply go off gut instinct?

Maybe we need to call the tipline and tell them to search the landfills?
 
How about these 2 spots on Harry and South Andover, where 4 mile creek goes under? Is it out of your way?

I looked at that bridge over four mile creek last week. It’s very busy right there during the day, but I don’t know what it’s like at night. We got out and looked, but it wasn’t easy to park safely.

Good point. You would imagine a one year old would have caught this sickness if contagious.. IMO

Okay... hold on. This brings up a question that I have, and while it's not about Lucas specifically, I could see how it could relate. Not just asking you ESO, so if you aren't sure, don't feel obligated to answer. I'm just quoting you because of the bolded part above. :)

So, the police can't use anything they find in EG's phone, if she volunteers, it correct?
BUT, if she puts her trash out (volunteering it), and they go through it, they can use that information in court?

The reason that the trash can be used is that once the trash is on the street, it’s considered public property. As far as cell phone records are concerned, cell phone carriers won’t release any information without one. It’s standard practice to compare what’s been pulled from the phone to the records from those companies. Even if EG had the phone when she was arrested, it goes into inmate storage to be returned upon release, or unless it’s ordered by the court to be turned over. LE could certainly get important information from those phones right away with permission, but it wouldn’t be admissible in court.

I wonder if the people at the nearest U-Haul location would remember her or somebody else buying those boxes and if the kids were with her..

Also I find it interesting that he was indeed sick, because she pointed out the reason that he was wearing pull ups was because they normally do that when he takes a nap. Why didn't she just say he's been sick?

Because something likely happened DUE to him being ill. If she said this, it would lead into "well, if he was sick, why didn't you take him to the doctor?" and then LE would know what happened, know what I mean? She's trying to remove herself from the situation completely so it can look like it's someone else's fault.

Okay, the public property thing makes sense, vs. personal property. I can see that.

You know, if I were in a situation, I'm sure I'd be thankful for these "laws" to cover my butt (in the case that I DIDN'T do anything wrong) but right now, they just make me angry. Waterboarding, plucking toenails, I'm okay with downright torture in this scenario. And I don't feel bad about it.
 
What is the fathers position? Does he have an opinion about what happen to Lucas?

I’ve asked my ex if the landfill has been searched and to his knowledge, it has not. Unfortunately, if Lucas was put in the trash, the compacting done within the truck would damage his body and make it nearly impossible to determine the cause of death. The trash companies landfill dumps are carefully documented and marked so they can be located easily if needed.

03/05/18 -- Texas EquuSearch will be TEMPORARILY suspending its search for Lucas Hernandez, but we will be returning in the VERY near future. We have been given some credible information on one of our other cases, and we need to act on this to try and bring another family closure. Again, we will be returning to continue our search for Lucas in the VERY near future. Please keep Lucas, his family and loved ones in your prayers.

I found that same thing when I drove by this am. I will go down Pawnee at lunch today. I’m so sorry you and your family is going through all of this. I think at this point I can speak for myself and everyone within WS our hearts are breaking for you. Saying many prayers for you all.
