LETCHER COUNTY, Ky. (WYMT) - Former Letcher County Sheriff Mickey Stines appeared in court Friday morning via Zoom.

Circuit Court Judge Christopher Cohron, prosecutors and defense attorneys discussed several details in the case.

Prosecutor Jackie Steele said they are still in the process of discovering facts in the case. He said the discovery process should be completed in 4-6 months.

In regards to discovery, Defense Attorney Jeremy Bartley said they will continue to go through documents presented.

An affidavit of indigency, which is a document showing a person cannot cover court costs, was also filed on Stines’s behalf.

That process could then open the door to Chapter 31 funds. These are given if the defendant cannot afford an attorney. It can also be used to fund private investigators of expert witness.

A judge made this recommendation via Zoom.

"We get the order entered in regards to competency and criminal responsibility."

That order would go through the Kentucky Correctional Psychiatric Center. Stines, being held in the Leslie County Detention Center, was indicted by a Letcher County Grand Jury on one count of murdering a public official. His attorney, Jeremy Bartley, specifically addressed the issue of criminal responsibility.

Prosecutors may take another four to six months to amass all potential evidence and complete any testing of it, according to prosecutor Jackie Steele.

'We still have some things coming in and things being tested,' Steele said.

Stines, who appeared remotely from jail for Friday's video conference, showed no emotion as he sat behind his lawyers while his upcoming murder trial was discussed.

NEW SPECIAL JUDGE APPOINTED IN STINES CASE
The Chief Justice of the Kentucky Supreme Court has appointed another special judge and special clerk in the murder trial of former sheriff Shawn Mickey Stines.
Circuit Court Judge Christopher T. Cohron, whose regular jurisdiction is Edmonson and Warren counties in the 8th Judicial Circuit, Division 1, will serve as the judge for the remainder of the case, or until the chief justice says otherwise.
Chief Justice Laurance B. VanMeter also appointed Cortney Shewmaker, circuit court clerk for Boyle County, as special clerk in Letcher County for the purposes of the Stines trail.
Stines is charged with murder in the shooting death 47th Judicial District Judge Kevin R. Mullins on September 19 of this year.

The latest such rumor came as a result of a national media outlet hearing the recorded interview of a person by a detective in the Kentucky Attorney General’s office. The interview is now nearly three years old. The person being questioned said categorically that she had seen a video, but she didn’t have it.

She said she didn’t know both people in the video, and she didn’t know when it was made. She also said it was on a cassette, a big one, something that has never been used for courthouse security cameras here, only for courtroom records. She directed investigators to someone she said did have this cassette – someone with an active warrant. Days later, the detectives were able to interview that person by telephone and he said he never had a video. He said he had an audio tape but refused to give it to the detectives.

Does any tape exist? We don’t know, and we’re not going to print details unless we do know.

WHITESBURG, Ky. (WYMT) - Former Letcher County Sheriff’s Deputy Ben Fields was sentenced to seven years in prison.

Pike County Circuit Court Judge Eddy Coleman delivered the sentencing on Thursday.

Fields faces consecutive sentences for rape and sodomy adding up to seven years.

The case was prosecuted by Barbara Whaley of the Kentucky Attorney General’s Office and was heard by Pike Circuit Judge Eddy Coleman. Court documents show hearings were held in at least three counties other than Letcher.

In return for the guilty plea, the judge followed the recommendation in the plea agreement and sentenced Fields to five years each for rape, and two tampering charges, but that time be probated for seven years with supervision for five years. The perjury sentence of 12 months was conditionally discharged for 12 months. Fields will serve six months in jail and is required to register as a sex offender and complete outpatient sex offender treatment. Protective orders will be in place and effective for 10 years.
 
Defense believes Mickey suffers no competency issue and is perfectly capable of assisting with his own defense. They are most interested in the evaluation of his criminal responsibility and his state of mind at the time of the crime. Says Mickey felt threatened by some unnamed individual(s) and worried during that drive to the next county jail if he said the wrong thing or had already said something that might cause unnamed individuals to cause harm to him or his family. It was related somewhat to the recent deposition and things around the courthouse that certain folks wanted to keep secret. Attorney discusses things (which he doesn't disclose) that were "behind the veil" at the courthouse.

The Mountain Eagle cites a portion of Stines’ deposition for the lawsuit in which he says he handed Fields a department training manual but never actually trained him on the sexual misconduct policy.

The lawsuit is still working its way through the court system.
